MEMORANDUM

From: Firozul Chowdhury To: Procuring Contracting Officer

Subj: JUSTIFICATION TO PROVIDE GOVERNMENT PROPERTY UNDER

SOLICITATION NO. N6339423Q0020

Ref: (a) Federal Acquisition Re gulation (FAR) 45.102, Policy

(b) Defense Federal Acquisition Regulation Supplement (DFARS) 245.103-70, Furnishing Government Property to Contractors

(c) DFARS Procedure, Guidance, and Information (PGI) 243.103-70, Furnishing Government Property to Contractors

Encl: (1) Government Furnished Property (GFP) Attachment to Solicitation No. N6339423Q0020

The purpose of memorandum is to document the basis for providing Government property to the Contractor awarded Contract No. (TBD). The Government Furnished Property (GFP) is provided to support the timely execution of work involved in manufacturing/service of Rainfall Test for the Min MOD Cell Covers (Part Number: 10706-A-001) .

In accordance with Reference (a), Contractors are ordinarily required to furnish all property necessary to perform Government contracts. However, in regard to this specific effort, providing property to the Contractor is in the Governments best interest and is demonstrated below using the guidance within References (b) and (c).

Element 1: Providing GFP is in the Government’s best Interest.

Providing GFM is in the Government’s best interest in relation to the following factors.

(A) Economy Providing GFP: This is not an applicable factor to the GFP.

(B) Standardization: This is not an applicable factor to the GFP.

(C) Security: This is not an applicable factor to the GFP.

(D) Expedite Part Delivery. This is not an applicable factor to the GFP.

(E) Scarcity: GFP are Diminishing Manufacturing Sources (DMS) assets that are no longer available commercially or through supply. These are equipment specifically made to be compatible with _______________ and are not commercially available anywhere.

(F) Maintain the industrial base. This is not an applicable factor to the GFP.

(G) Contract type: This is not an application factor to the GFP.

Element 2: Overall benefit.

The Government will receive cost savings and expedited delivery by providing GFP. As stated above, the GFP provides non-duplicative cost avoidance to the Government. The readily available GFP also provides capability for Contractor to rapidly provide support for Rainfall Test on the Min MOD Cell Covers.

Element 3: Government assumption of risk.

Providing GFP does not substantially increase the Government’s assumption of risk. The GFP have been purchased and available to provide to the contractor.

Element 4: Government requirements cannot otherwise be met.

If GFP is not provided, Government requirements cannot otherwise be met without substantial duplication of costs and delays in task execution. The materials being provided are important to NATO Sea Sparrow Missile Systems (NSSMS) program. Some of these assets are one of a kind and are available nowhere else. It is critical that these assets are maintained in order to avoid long delay times in providing needed assets to the fleet.

Based on the justification above, the Requiring Activity has made the decision to provide GFP.
