About this file
This document is a Sole Source Justification (SSJ) for a naval contract with Drake Controls-West LLC to overhaul and restore two EDG governors. The Naval Sea Systems Command's Northwest Regional Maintenance Center/Puget Sound Naval Shipyard is seeking a non-personnel services contract to repair specific governors (part number 9900-550) to original equipment manufacturer (OEM) specifications. Drake Controls-West is the only authorized service provider due to proprietary technical data restrictions, and they will troubleshoot, overhaul, calibrate, and potentially replace parts for the governors.
The contract will be a firm-fixed price award with a period of performance from 22 December 2025 to 24 February 2026. The justification emphasizes that no functional spare EDG governors are currently available, and the current spare governors are in "F" condition (nonfunctional). Per NAVSEA instructions, the ship cannot depart without functional spare governors, making this OEM repair essential. The contract is being awarded under 10 U.S.C 3204(a)(1), which allows sole source procurement when services are available from only one responsible source, and no alternative services will satisfy the agency's needs.

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR
CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FEDERAL
ACQUISITION REGULATION (FAR) 13.5
On the basis of the following justification, I hereby approve the use of a sole source proposed contractual action pursuant to the authority of 10 U.S.C 3204(a)(1).
Procurement Request Number: N4523A26Q5703
1. Agency and Contracting Activity
Naval Sea Systems Command contracting activity Northwest Regional Maintenance Center/Puget Sound Naval Shipyard and Intermediate Maintenance Facility, Bremerton, WA proposes to enter into a sole source contract with Drake Controls-West LLC., 7050 Village Dr.

2. The nature and/or description of the action being approved.
This is a new action under FAR 13.5, for a sole source requirement for EDG governors. This is a non-personnel services contract to complete overhaul and restoration of two (2) ea EDG governors, part number 9900-550, to OEM specifications. Puget Sound Naval Shipyard requires the original equipment manufacturer (OEM) to provide repair, maintenance of the EDG governors at their facility.
3. A description of the supplies and/or services required, including the delivery schedule and/or the period of performance (inclusive of all option periods), and the estimated dollar value of the acquisition.
Puget Sound Naval Shipyard requires services to complete overhaul and restoration of two (2)
ea. EDG governors to OEM specifications. The contractor shall troubleshoot and overhaul to identify deficiencies in the EDG governors. If required, the contractor shall determine and acquire replacement parts. The contractor shall accomplish calibration as specified by Puget Sound Naval Shipyard per the Governor Data Sheet provided and deliver the completed data sheet with the governor. Drake Controls-West is the original equipment manufacturer (OEM) for the maintenance. Proprietary data restraints apply. The period of performance is 22 December 2025 – 24 February 2026.
4. The statutory authority permitting sole source.
Under 10 U.S.C 3204(a)(1): the services needed by the agency are available from only one responsible source and no other type of services will satisfy the needs of the agency.
5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the authority.
Drake Controls – West LLC is the original equipment manufacturer’s (OEM) authorized service provider for the EDG Governors. Proprietary data restraints apply, and the OEM is the only vendor authorized to provide the overhaul and restoration of the EDG governors to OEM specifications. Drake Controls is the only authorized service provider that has the technical data, but also the expertise required to repair and overhaul the EDG Governors.
PSNS&IMF has conducted business with Drake Controls on similar units with positive and timely results. Utilization of this vendor is believed to reduce the margin of error that could compromise ship deployment schedule. Failure to meet the required delivery date directly impacts ship deployment schedule.
6. A description of efforts made to ensure offers/quotes are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized in FEDBIZOPPS (as required by FAR 5.2) and, if not, which exception under 5.202 applies.
This requirement is not required to be synopsized, as it is excepted under FAR 5.202(a)(13).
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the contracting officer that the anticipated cost to the government will be fair and reasonable.
This will be a Firm-Fixed price award.
Based on the independent government estimate and market research quote the
Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this sole source document will be fair and reasonable.
8. A description of the market research conducted, and the results or the reason market research was not conducted.
The customer requested a market research estimate from Drake Controls. Drake Controls – West LLC is the original equipment manufacturer’s (OEM) authorized service provider for the State of Washington of the EDG Governors. As such, Drake Controls is the only company able to service the equipment due to the proprietary controls on the technical data. Conducting market research would not result in any additional viable options for the Government. No other market research was performed.
9. Any other facts supporting the use of sole source.
There are no EDG spare governors available in “A” condition. The spare EDG governors are currently “F” condition, which are nonfunctional. Drake Controls will repair the equipment and restore them to “A” condition. Per NAVSEA instructions, the ship is not authorized to depart without functional spare EDG governors. The OEM is required to overhaul and restore the EDG governors.
