About this file
This is a Sole Source Justification document for a brand name purchase order submitted by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), located in Panama City, Florida.
The Government seeks to acquire Mesa Labs instrumentation from Mesa Labs, Lakewood Manufacturing Facility (12100 W 6th Ave, Lakewood, CO 80228) to support unmanned diving operations within unmanned hyperbaric chambers at the Navy Experimental Diving Unit (NEDU). The required items include one Met Lab ML-800 High Cell unit, two Met Lab ML-800 Ultra High Flow units, two Swagelok 1 1/2" to 1" reducers, two Swagelok 1" to 1/2" reducers, three PEL 1650 cases with foam for ML-800 units, Certificates of Conformance and Calibration Certificates, and shipping. The acquisition will be conducted using simplified acquisition procedures with a total dollar value exceeding micro-purchase levels but not exceeding the simplified acquisition threshold. The justification is based on FAR 12.102(a), Restricting Competition for Commercial Acquisitions Below the Simplified Acquisition Threshold. Mesa Labs instrumentation is determined to be the only equipment that provides necessary functions and compatibility with existing hardware and software control systems already installed at NEDU. The Contracting Officer has determined this sole-source award represents best value, ensuring mission readiness while avoiding costly delays and operational impacts from extended equipment downtime. No competitive market research was conducted, as Mesa Labs is identified as the sole source capable of meeting the Government's requirements. The justification notes that using alternate equipment would incur significant costs and introduce new parameters potentially harmful to diving systems tested and maintained at NEDU.

REDACTED
Subj: SOLE SOURCE JUSTIFICATION TO ACQUIRE MESA LABS
INSTRUMENTATION (Purchase Request TBD)
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order to Mesa Labs, Lakewood Manufacturing Facility, 12100 W 6th Ave, Lakewood, CO 80228 to provide instrumentation in support of unmanned diving operations inside the unmanned hyperbaric chambers at NEDU.
3. A description of the supplies or services required to meet the agency’s needs.
(including the estimated value). The contract effort is to acquire the following:

REDACTED. The Government's minimum needs have been verified by the certifying technical and requirements personnel. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold. REDACTED. This memo does not authorize acquisition for other requirements. REDACTED.
4. Justification rationale. This acquisition is conducted under the authority of FAR 12.102(a), Restricting Competition for Commercial Acquisitions Below the Simplified Acquisition Threshold. The determination has been made that only one source is reasonably available to meet the Government's minimum needs.
The equipment is being acquired as new equipment to meet testing requirements of diving operations at NEDU. As a critical piece of instrumentation used in the evaluation of diver’s life support equipment, the Mesa Labs instrumentation requested is the ONLY equipment that provides the necessary functions and is compatible with the current installed hardware and software control systems, for use with Mesa Labs flow calibration cell units already in use at NEDU. In summary, using alternate equipment would prove costly in time and dollars to the government and to the mission. Use of another system may change or introduce new parameters that may be harmful to all diving systems tested and maintained at NEDU. Therefore, it is in the Governments’ best interest to award on a sole source basis to Mesa Labs.
As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.
Therefore, it is in the Governments’ best interest to acquire these critical components from Mesa Labs.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 12.102(a).
The Contracting Officer has determined that this order represents the best value to the Government. This determination is based on the unique and time-sensitive mission requirements of Special Operating Forces. Awarding this as a sole-source order is the most advantageous approach. The best value is achieved by ensuring mission readiness and avoiding the costs and operational impacts of extended equipment downtime.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Mesa Labs is the only brand that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov. REDACTED.
7. Any other facts supporting the justification.
Same type of system installed at NEDU and the controlling system required for operation already in use across command.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, the Mesa Labs instrumentation is the only equipment that can meet this requirement.
