About this file

This is a Sole Source Memorandum justifying a noncompetitive award to United Contamination Control for oxygen cleaning services on pressure gauges.

The Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) is acquiring O2 cleaning services for 450 non-magnetic pressure gauges (part number 1120-012) from United Contamination Control, located at 241 Zimmerman Lane, Langhorne, PA 19047. The contract will be awarded as a firm fixed price purchase order using simplified acquisition procedures, with a total dollar value above micro-purchase levels but not exceeding the simplified acquisition threshold. Performance requirements specify that 60 gauges must be completed within 10 business days of material receipt, with the remaining 390 gauges completed within 30 days. The Government will handle all shipping to and from Pennsylvania. The sole source justification is based on FAR 6.302-1(a)(2)(iii)(B), as services are available from only one responsible source and no other supplies or services will satisfy agency requirements. NSWC PCD conducted market research by soliciting quotes from four vendors—DP Industries, General Dynamics Information Technology, Chase Defense, and United Contamination Control—but only United Contamination Control possesses the unique qualifications and clean-room facilities necessary to perform the required O2 cleaning process. The urgency is driven by critical backorders at NAVSUP that directly impact fleet readiness and EOD operational capability, with delays potentially resulting in high-priority Casualty Reports (CASREPs) related to the MK 16 Mod 1 and VIPER underwater breathing apparatus platforms.

Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE O2 CLEANING OF PRESSURE GAUGE FROM

UNITED CONTAMINATION CONTROL, 1120-012 (1301346077)

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source” Justification.

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare

Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts

Department Code 02).

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order, on a sole source basis, to United Contamination Control, 241 Zimmerman Lane, Langhorne, PA 19047.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated).

The contract effort is to acquire the following:

ITEM NO. DESCRIPTION QTY.

1 PRESSURE GAUGE NON-MAG 450

REDACTED. shipping to and from the location in Pennsylvania will be done by the Government. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold. 60 gauges will be completed within 10 business days of receipt of material, with the remaining being completed within 30 days of receipt. REDACTED

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C.

2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency

Requirements FAR 6.302-1(a)(2)(iii)(B).

This action is executed under the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1, as services are available from only one responsible source and no other type of supplies or services will satisfy agency requirements. NSWC PCD is the designated depot and technical authority for all EOD Diving and Life Support underwater breathing apparatus

(UBA) components. During a recent end-of-life procurement, part number 1120-012 was acquired from the original manufacturer, EATON, with the contractual requirement that the parts be delivered O2 cleaned for use in the MK 16

Mod 1 and VIPER UBAs. Upon receipt, EATON failed to provide the required Objective Quality Evidence (OQE) to certify this cleaning was performed. To comply with SEA00C's continued certification standards, these parts cannot be placed into service or inventory without documented proof of O2 cleaning. To resolve this deficiency, NSWC PCD conducted market research by soliciting formal quotes from four vendors in the industry: DP Industries, General

Dynamics Information Technology, Chase Defense, and United Contamination Control (UCC). The other three vendors formally declined to bid, stating via written correspondence that their facilities lacked the specific capabilities for this process; only UCC possessed the unique qualifications and clean-room facilities necessary to perform the required service. This gauge is now in extremis. There are critical backorders at NAVSUP, which directly impacts fleet readiness. Delays in certifying these parts will prevent the restoration of mission-capable MK 16 UBAs, likely leading to the submission of high-priority Casualty Reports (CASREPs) and a degradation of EOD operational capability. Due to this urgent and critical need, this award is being processed on a sole-source basis to United

Contamination Control.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, UCC is the only source that can meet the Government’s needs and expedited timeline.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, UCC is the only source that can meet this requirement.
