About this file

This document contains Contract Required Clauses for the Mississippi State Department of Health (MSDH), governing the terms and conditions for contractors doing business with the agency. The clauses outline comprehensive requirements for contractors, including compliance with state and federal laws, equal opportunity employment, e-verification of employment eligibility, payment modes, procurement regulations, and specific provisions related to contract termination, property rights, and public records transparency.

The document emphasizes critical contractual protections for MSDH, including conditions for fund availability contingent on legislative appropriations, electronic payment protocols, and the agency's right to terminate the contract with 10 business days' written notice if funds are insufficient. The clauses also detail potential consequences for contract breaches, such as termination, loss of business licenses, and exclusion from future contract awards. Importantly, the contract is subject to Mississippi law, requires approval from the Public Procurement Review Board and/or the Office of Personal Service Contract Review, and mandates that contract details be publicly posted on the state's transparency website.
