CONSENT TO SUBCONTRACT

PRIME OFFEROR:

PROPOSED SUBCONTRACT ARRANGEMENT: (i.e. T&M; FFP)

DESCRIPTION OF SERVICES TO BE PERFORMED BY SUBCONTRACTOR:

In accordance with FAR 44.202-2(a), Considerations: Review of Contractor's Request for Consent to Subcontract, please provide the following information for approval to Consent to Subcontract in accordance with the solicitation requirements:

(1) Is the decision to subcontract consistent with the Offeror’s approved make-or-buy program, if any (see 15.407-2)?

(2) Is the subcontract for special test equipment, equipment or real property that are available from Government sources?

(3) Provide justification for the selection of the particular supplies, equipment, or services.

(4) Is the Prime Offeror complying with requirements regarding—

(i) Small business subcontracting, including, if applicable, its plan for subcontracting with small, veteran-owned, service-disabled veteran-owned, HUBZone, small disadvantaged and women-owned small business concerns (see Part 19); and

(ii) Purchase from nonprofit agencies designated by the Committee for Purchase From People Who Are Blind or Severely Disabled (Javits-Wagner-O’Day Act (41 U.S.C. 48)) (see Part 8)?

(5) Explain, if applicable, how adequate price competition was obtained. If no adequate competition was obtained, justify why. If this is a sole-source, the Prime Offeror must thoroughly detail why it was not competed and provide documentation on how price/cost reasonableness was determined fair and reasonable.

(6) Did the Prime Offeror adequately assess and dispose of subcontractors’ alternate proposals, if offered?

(7) Provide a sound basis for selecting and determining the responsibility of the subcontractor.

(8) Provide the cost or price analysis performed. If none was performed, provide the price comparisons and if certified cost or pricing data and data other than certified cost or pricing data was obtained. Please include a copy of the subcontract negotiation memorandum.

(9) How is the subcontract type appropriate for the risks involved and consistent with current policy?

(10) Has adequate consideration been obtained for any proposed subcontract that will involve the use of Government-provided equipment and real property?

(11) Describe how has the prime contract technical requirements been adequately and reasonably translated into subcontract requirements.

(12) If applicable, how did the Prime Contractor comply with applicable cost accounting standards for awarding the subcontract?

(13) Confirm that the proposed subcontractor in the System for Award Management Exclusions?
