LIMITED SOURCE DETERMINATION

FAR Subpart 13.106-1(b) and FAR Subpart 11.105(a)(1)

1. CONTRACTING AGENCY: The U.S. Army Corps of Engineers (USACE), Walla Walla District, 201

North 3rd, Walla Walla, WA 99362.

2. DESCRIPTION OF THE ACTION: The U.S. Army Corps of Engineers, Walla Walla District has a requirement for the purchase of a Motor Control Center, to replace original existing equipment, which include Brand Name Schneider Square D Model 6 Motor Control Center (MCC) for use at Dworshak Lock and Dam.

3. DESCRIPTION OF THE SUPPLIES: Approval is being requested for a new firm-fixed-price, brand name requirement for the procurement of a Schneider Square D Model 6 Motor Control Center.

4. AUTHORITY CITED:

FAR 13.106-1 (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

FAR 11.105(a)(1), Items Particular to One Manufacturer. The particular brand name, product, or feature is essential to the Governments’ requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs.

5. REASON FOR AUTHORITY CITED:

A. BACKGROUND: The current GCQ2 Motor Control Center (MCC), support power distribution for maintenance equipment at the Main Hatchery Building Spawning Room and Mechanical 1 Building at

Dworshak National Fish Hatchery (DNFH) is old, outdated, and in need of replacement. Some of the operating handles do not work as designed. Some of the breakers on the existing MCC buckets cannot be turned on and off without opening the MCC door, which is a critical safety concern. Some of the cabinet doors do not open and close easily, and the existing MCC control scheme is outdated and does not meet current hatchery operational requirements. GCQ2 was also a custom built MCC during original Hatchery construction and does not meet current UL Standards. The current control centers cannot be modified to do so without complete MCC replacement.

Schneider Square D Model 6 MCC cabinets are the standard at Dworshak Project. Dworshak National

Fish Hatchery and Dworshak Powerhouse currently have over 15 MCCs of this model and style in operation.

B. JUSTIFICATION: It is in the Government’s best interest to standardize electrical distribution equipment wherever possible. Standardization ensures electrical crews are familiar with the system, reduces training requirements, utilizes common test equipment, and ensures spare and replacement parts are available for emergency repair of critical systems.

Dworshak Project maintains a limited assortment of spare parts for the Schneider Square D Model 6

MCC in the Powerhouse warehouse, such as contactors, fuses, and switches, but this resource is not exhaustive. These components have been acquired by retaining components removed during 15 years’ worth of changes, upgrades, and modifications to the existing MCCs. The existence of other MCCs matching the ratings of the new MCC provides for temporarily swapping out more specialized

13. CONTRACTING OFFICER CERTIFICATION: In accordance with the authority of 10 U.S.C. 2304(c)(1), as implemented by FAR 13.106-1(b) and based upon the foregoing, I hereby determine that a brand name procurement is authorized and is in the best interest of the Government.
