About this file
This document is a Disabled Veteran Business Enterprise (DVBE) Program Information file issued by the State of California's Department of General Services, Office of Small Business and DVBE Services, applicable to state contracts including the California Department of Fish and Wildlife's IFB P2580035 for hazardous waste testing and disposal services. The document provides comprehensive instructions and requirements for contractors bidding on state contracts to meet DVBE participation goals. Contractors may satisfy the minimum 3% DVBE participation goal by either performing at least 3% of the contract value as a certified DVBE contractor themselves, or by subcontracting at least 3% of the contract value to other DVBE firms. All participating DVBE contractors, subcontractors, and suppliers must be certified through the Office of Small Business and DVBE Services (OSBDS), with certification verification required and available on the OSBDS website at http://www.eprocure.dgs.ca.gov. The prime contractor is responsible for ensuring all listed DVBEs are utilized for their specified scope of work and for maintaining communication with participating firms regarding project timelines.
Contract compliance requires prime contractors to report DVBE participation on the Disabled Veteran Business Enterprise Participation Summary Form (STD 840), specifying the type of work, DVBE company name, dollar amounts, percentages, and OSBDS certification numbers with attached certification letters. If a contract is amended to increase value, the prime contractor must maintain compliance with DVBE participation goals for the amended amount. The State reserves the right to audit all records pertaining to subcontractor payments and DVBE compliance, with contractors required to maintain such records for three years after final payment. Contractors may request substitution of proposed DVBE subcontractors or suppliers with written justification submitted to the State for approval.

Each listed DVBE must be utilized for the specific nature of work, as indicated in your Statement of Qualifications. It is the prime contractor’s responsibility to keep all DVBE’s informed, and to give them reasonable notification of the time frame in which their participation will take place on the project.
In the event the contract is amended to increase the amount, prime contractors are required to comply with the State’s DVBE participation goals for the amended amount.
Contract Audits Contractor agrees that the State or its delegate will have the right to review, obtain, and copy all records pertaining to performance of the contract, including but not limited to reports of payments made to subcontractors during the term of the contract. ANSWERS TO FREQUENTLY ASKED QUESTIONS:
The following questions are among the most frequently asked regarding DVBE program:
Q: If I am awarded the contract, either with partial or full goal attainment documented, am
I required to use the subcontractor/supplier proposed in my Statement of Qualifications?
A: Yes, unless you have requested and received approval from the State for substitution.
Written requests should include the person’s or firm’s name to be substituted, the substitution reason, the reason a non-DVBE subcontractor is proposed, if applicable and describe the business to be substituted including its business status as a sole proprietorship, partnership, corporation or other entity and the certification status of the firm, if any.
Q: If I am a disabled veteran business enterprise, can I meet the 3% contract goals as a single company?
A: Yes.
Q: If my submitted response meets the contract goal and the State decides to make multiple awards to the contract, could my response be considered non-responsive?
A: No. The State’s decision to make multiple awards will not jeopardize compliance.
