Due Diligence Posting of Notice of Intent to Accept a Best Value Offer from Star Poly Bag Inc. for Trash Bags
The Department of Transportation – Highway Operations (“MassDOT” or “Department”) of the Commonwealth of Massachusetts announces its intent to Accept a Best Value Offer, pursuant to the Commonwealth’s Due Diligence Posting policy, to contract for the following with Star Poly Bag Inc. (“Offeror”), pending the results of this Notice of Intent (“Notice”):
Description MassDOT Highway Operations plans to continue sourcing a variety of customized yellow trash bags to support statewide roadside cleanup. These products are vital to maintaining safety and visibility during daily trash removal, particularly along medians, ramps, and high-traffic areas.
The custom trash bags are designed for efficient manual collection, with a plastic removable handle that improves ease of use, and a bright yellow color that ensures visibility for worker safety. The distinctive color also serves a practical purpose—it prevents confusion with standard black residential bags and ensures they stand out in the field and discourages misuse by separating official disposal from public trash. Vendor must provide both the custom bag and standard bag as shown below and in the bid attachments. The quantity in the quote is ordered yearly. However, the bags are ordered twice a year with half the listed quantity in each order.
Trash bags are delivered to one location.
Trash Bag A (Figure A):
24” X 34” X 3” (Material 0.0035 Mil thickness with handles and tie) Preferred Color - Bright Yellow This product also has a clear plastic removable handle
Trash Bag B:
(Material 0.0035 Mil thickness with no handles and ties) Preferred Color - Bright Yellow The 55 gallon bag size is 36 x 60
MassDOT would seek to enter into a ten (10) year contract agreement with Star Poly to provide these customized trash bags.
A copy of the vendor quote is included in the COMMBUYS Due Diligence Posting.
The Department is posting this Notice rather than conducting a full procurement because the Department believes this opportunity represents best value to the Commonwealth and is utilizing this Due Diligence Posting to ensure that the process is open, fair and competitive.
Determination of Other Interested Vendors The intent of this posting is to determine if there are any other interested and qualified vendors.
Any such vendors must:
• Submit documentation that they can provide a comparable or better offer
Response Requirement and Deadline All Interested Vendors and Offerors interested in responding to this Notice, regardless of prior communications with the Department, must submit a Response to this posting containing evidence of their qualification and interest via COMMBUYS. This includes the interested offeror. All required information must be submitted by 2:00PM (prevailing Eastern Time) on Tuesday, October 21, 2025 as follows:
• Quote for both products to include specs and pricing
• Prompt Pay Discount Form
• Bidders who meet the criteria for phase 2 of the evaluation will be asked to submit product samples
If, after the posting deadline has passed, interest is generated by this Notice, the Department will review all Responses and will determine whether they will: (i) withdraw the notice and not accept the Offeror’s offer (and cancel the Notice of Intent) or (ii) accept the offer from the Offeror or (iii) accept an offer from another vendor offering a comparable or better value than the Offeror in their Response or (iv) accept the offer from the Offeror and from any other offerors offering similar value in their response.
Small Business Purchasing Program
The Massachusetts Small Business Purchasing Program (SBPP) was established pursuant to Executive Order 523 to increase state contracting opportunities with small businesses having their principal place of business within the Commonwealth of Massachusetts. Pursuant to the SBPP, it is the intention of the issuing department to award this Small Procurement to one or more SBPP participating business as described below. Small Procurements are defined as procurements with an estimated annual value equal to or less than $250,000. While all businesses, no matter the size or principal place of business, may submit responses to this solicitation, should an SBPP participant respond and meet the best value criteria as described in this solicitation, the SBPP participant shall be awarded the contract. The review team will not evaluate submissions from non-SBPP participants unless no SBPP Bidder meets the RFR’s best value evaluation criteria.
