DTNH22‐13‐R‐00652 AMENDMENT 02 National and Regional Media and Communications Support Services

AMENDMENT 02

NHTSA RFP: DTNH22-13-R-00652

1. Amend Sub-Paragraph G.1.2 of the RFP to read as follows. Changes are highlighted in yellow.

G.1.2 STATUTORILY-MANDATED ADVERTISING (SMA)

As defined and discussed in Attachment 1, Statutorily-Mandated Advertising is an Other Direct Cost category under this contract. Throughout the term of the contract, the United States Congress will provide special funding to NHTSA to be used for specifically-defined advertising campaigns. This Statutorily-Mandated Advertising (SMA) requires that 100% of this funding be used to secure advertising airtime and or secure print/internet space. No SMA funds may be diverted to pay for any other cost (either direct or indirect) nor may any SMA costs be retained by the Contractor as fee or profit.

Costs associated with SMA can be substantial. During CY 2012, the Contractor invoiced the government 15 times to cover SMA costs averaging $1.5 million per invoice. One invoice reflected incurred costs of $5.5 million.

To fulfill the advertising requirements of the resultant contract, the Contractor must have sufficient financial resources to incur these large costs and to carry these costs until reimbursed by the Government. In recognition of the burden Statutorily-Mandated Advertising costs may have on the Contractor, the Contractor may submit invoices for SMA every 15 days. The Government has established procedures by which proper SMA invoices are processed for payment within 15 days after their receipt at the location designated in Section G.3 of this Contract. However, as these expedited payments are considered contract financing payments, failure of the government to make payment within 15 days is not subject to interest penalties.

2. Insert the following statements under the heading “Submission of Invoices” of

Section G.3.

G.3 SUBMISSION OF INVOICES

With the exception of invoices covering Statutorily-Mandated Advertising costs, the Contractor shall submit invoices on a monthly basis. Payments will be made in accordance with FAR 52.232-7 “Payments under Time-and-Materials and Labor-Hour Contracts” and FAR 52.232-25 “Prompt Payment.”

Recognizing the possible financial burden associated with the incurrence of SMA costs, the Contractor may submit invoices for SMA every 15 days. SMA invoices must be submitted separately from those of all other costs.

3. Change Sub-Paragraph L.7.2.2.c “Step IV” to read as follows. Change is highlighted in yellow.

Step IV (Exchanges with Offerors, up to 45minutes) Following Phase III, the Offeror and Government attendees will meet again. During this Phase IV, the Government may ask the Offeror questions regarding any portion of its Technical Proposal (both oral presentation and written materials.) This question and answer period shall be considered “Clarifications” (as defined in FAR Part 15.306(a)) and / or “Communications” (as defined in FAR Part 15.306(b)) as applied to exchanges with offerors. Following exchanges between the government and the offeror, the Offeror will be dismissed.

4. Replace Enclosure 4 “Task Order 01 Cost/Price Proposal” with Enclosure 4 appearing on the following page.
