SUPPORTING J&A DOCUMENTATION FOR
PR MAPR615161112
1. Contracting Activity: U.S. Department of Transportation, Maritime Administration, DAO-380
2. Description of the Action Being Approved: Award of a sole source purchase order action to
Seaward Marine Services, 5409 Beamon Rd., Norfolk, VA 23513 for work on the Training Ship Empire State for a period beginning August 10, 2016 through August 31, 2016.
3. Description of Supplies/Services: The contemplated contract action will provide for services to conduct underwater hull inspection and lamp ray inspection of the Training Ship Empire State in August 2016 for a total purchase order period amount of $
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C.
2304(c)(1). Only one responsible source and not other supplies or services will satisfy agency requirements.
5. Rational Justifying Use of Cited Statutory Authority: In accordance with FAR 6.302-1(a)(2), full and open competition need not be provided for when services are available from only one or a limited number of responsible sources and no other type of services will satisfy agency requirements. This requirement supports the use of the authority cited in 10 U.S.C. 2304(c)(1) because only Seaward Marine Services, Inc. can perform the services described herein within the required timeframe. In FY 2000, the Training School Ships completed a prototype testing of a new technology application for conducting Underwater Inspection in Lieu of Drydocking. The new technology was an automated hull-crawling machine which accomplishes the following:
• Continuous video of the underwater hull, with audio feed from the operator, for topside monitoring by the Surveyor.
• Near-continuous thickness gauging of the hull’s steel plate, recording approximately 100 individual gaugings per hull plate.
• Near-continous reading of the hull coating system thickness.
• Near-continuous reading of the hull electrical potential, which indicates the effectivenetss of the hull’s cathodic protection system.
This technology was developed by a company called Imetrix, and was implemented in conjunction with hull scamping and diving support by Seaward Marine. Seaward subsequently purchased Imetrix and owns the technology. Seaward, using the Imetrix System, is currently under long-term Basic Ordering Agreement contract with the U.S. Navy, to conduct intermediate surveys on naval ship hulls. Seward has been the contractor for the Navy for worldwide hull cleaning for 30 years. For a 2009 solicitation requirement with the Navy, only two offerors responded: Seaward Marine and another firm who was awarded the contract for the east Coast in August 2009. The east coast contractor failed to meet material contract requirements, impacting fleet assets and schedules. They failed to properly remove hull fouling causing a serious detriment on the ship speed, fuel consumption and noise. Based on performance as the original source, Seaward Marine has demonstrated that they have the highly specialized waterborne hull tina.gillespielucas

cleaning requirements on the east coast. While it is possible to conduct a U/WILD without the Imetrix technology, doing the survey via divers cannot provide anywhere near the quantity or quality of technical data that is received by this system. In view of the criticality of ensuring hull integrity on the Training Ship (which embarks over three hundred students on each training cruise), it is requested that a sole source contract be issued to Seaward for the hull cleaning and inspection of the Training Ship State of Maine.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: No additional market research will be conducted because it is not practical based on the reasons cited in paragraph 5 above, for any company other than Seward to provide the required services.
Also, Seward Marine is the only ABS authorized service provide with this patented technology.
The requirement will be advertised and a combined synopsis/solicitation on The Federal Business Opportunities website and if any sources express an interest, those responses will be considered.
7. Determination of Fair And Reasonable Costs: Seward Marine has accomplished Lampray hull assessments on the Training Ship State of Maine and Aviation Maintenance Ship T-AVB3 SS Wright. For the Wright, the effort was contracted to Seward Marine via the Ship Manager, Crowley Technical. The Contracting Officer will review the pricing from the TS State of Maine purchase order and will obtain a price analysis from Seward Marine.
8. Actions to Remove Barriers to Competition: MARAD will advertise this requirement to
FEDBIZOPs and if any potential sources emerge, MARAD will assess whether competition for future requirements is feasible.
