The Design Professional reserves the right to require all Bidders to state the materials upon which the Bid is based prior to execution of the Contract.
The Drawings and Specifications do not undertake to illustrate or set forth every item necessary for the Work, as it is assumed that with his Bid submission, the Contractor acknowledges that he is expert in the several lines of the Work and is capable of interpreting the detailed requirements thereto.
Wherever a manufacturer of a product is specified, and the term "approved equal" is used, the substituted item must conform in all respects to the specified item. Consideration will not be given to a claim that the substituted item meets the required performance requirements if it is of lesser construction (such as lesser grade lighting fixture housing, etc.). Performance as delineated in Contract Documents, or as a function of the performance characteristics of the unit specifically named, shall be interpreted as minimum performance requirements. The burden of proving the proposed product is equal in all respects rests with the Contractor.

In such an event, it will be deemed that the Contractor has not complied with the provisions herein specified and shall bear the risks of all delays as if no submittal had been provided.
(d) Any data submitted which is illegible or does not have the proper space for a submittal stamp will be returned and not reviewed. In such an event, it will be deemed that the Contractor has not complied with the provisions herein specified and shall bear the risks of all delays as if no submittal had been provided.
(e) The Design Professional will review submittals only for conformance with the design concept and the information in the Contract Documents. Approval of a specific item does not constitute approval of an assembly in which the item functions. Approval does not authorize a change to the Contract requirements nor shall it be construed as an order for extra work. Such claims shall be made in accordance with the Contract conditions.
(f) Where items are required to be resubmitted, the required number of corrected copies shall be included with direct specific indication in writing of the correction requested by the Design Professional.
(g) The comments “No Exceptions Taken,” “Make Corrections Noted,” “Amend and Resubmit” or “Rejected Resubmit” marked on a shop drawing or other information submitted does not assure that the Design Professional or Owner attests to the dimensional accuracy or dimensional suitability of the material or
JS-10
equipment involved or the performance of the equipment. Comments on the shop drawings do not invalidate the requirements shown on the Drawings and Specifications if the shop drawings are in conflict with the Drawings and Specifications.
(h) Costs for preparing submittals shall be borne by the Contractors including all shipping charges.
If material or equipment is installed before submittal approval from the Design Professional, the Contractor shall be liable for removing and replacing same at his own cost if in the opinion of the Design Professional, the material or equipment does not meet the intent of the Drawings and Specifications.
After shop drawings and samples have been approved, no changes will be permitted unless satisfactory evidence is presented by the Contractor and approved by the Design Professional. Evidence must include the fact that the manufacturer cannot make scheduled delivery of approved material and the substitution of a suitable material is an urgent necessity, or that other conditions become apparent which indicate the approval of changes to be in the best interest of the Owner.
Where packaged (factory assembled) electrical equipment is furnished, a certificate shall be included with the submittals stating that the equipment complies with OSHA, National Electric Code, and applicable Underwriters Laboratories Standards and is approved by all regulatory agencies.
(13) Minor Deviations
