PART 1. INSTRUCTIONS TO OFFERORS

SUBPART 1.A GENERAL INFORMATION

1.A.1 General

This Request for Proposals (RFP) is issued by the Federal Highway Administration, Eastern Federal Lands Highway Division (EFLHD), in cooperation with the Virginia Department of Transportation (VDOT), the United States Department of Defense (DOD), and the County of Stafford, Virginia (County) to solicit competitive proposals for a design/build contract for a series of roadway and intersection improvements near the United States Marine Corps Base Quantico (MCBQ). These improvements are necessary to improve traffic operations at the intersection of Telegraph Road and U.S. Route 1 which provide critical ingress/egress to a DOD facility on the MCBQ. This RFP is issued as a design/build selection process. Those Offerors selected are invited to submit Proposals to design and build the Project according to the requirements and procedures contained in this RFP. Selected Offerors are those firms/teams who were notified in writing by EFLHD inviting them to participate in the selection process.

Offerors are directed to FAR Subpart 9.5 and must describe any actual, apparent, or potential organizational conflict of interest if awarded the contract. Offerors shall also describe any action(s) it has taken or proposes to take to avoid or mitigate any conflict, and shall set forth any other information that the Offeror believes would be helpful to the Contracting Officer in analyzing the situation.

The Offerors invited to submit proposals are as follows:

1. *******

2. *******

1.A.2 Description of Project

The intersection of Telegraph Road and U.S. Route 1 is located in Stafford County, VA near the MCBQ. These roadway and intersection improvements are necessary to improve traffic operations at the intersection of Telegraph Road and U.S. Route 1, which provide critical ingress/egress to a DOD facility on the MCBQ. The base contract for the project includes, but is not limited to, the design and construction of the following improvements:

Intersection and connecting roadways design and construction – Design turn lane improvements as shown in the Government provided preliminary plans and analyze impacts to the intersection’s level of service. Construct the expansion from 2 to 3 lanes on eastbound Telegraph Road west of U.S. Route 1 and lengthening of the U.S. Route 1 northbound left turn lane. Through lanes and turn lanes are to be designed to meet VDOT design and construction standards except where otherwise excluded in the RFP and the Government provided preliminary plans, or by a VDOT and EFLHD approved design waiver or exception, which will be the responsibility of the Contractor to obtain. Provide connections to all driveways connecting to U.S. Route 1 and maintain access during construction. Replace or reset all of the roadway elements to include, but not limited to, traffic signals, signs, pavement, etc., that are impacted by construction.

1A-2

Perform an operational analysis and warrant study for traffic operations of the intersection according to VDOT requirements. Incorporate in the analysis traffic numbers and models included with this RFP, and incorporating planning data from VDOT, DOD, and the County planning traffic models for the area. The Contractor will be required to use the FHWA toolbox that can be found on VDOT’s website for determining level of effectiveness for the intersections traffic models and analysis.

Provide Street lighting that meets the requirements of VDOT standard and specifications for street lights, and other documents that cover street lighting. Provide street lighting to replace existing street lighting impacted by construction operations within the Project limits.

Design and construct Storm Water Management (SWM) water quality and quantity requirements to VDOT’s MS4 requirements.

Coordinate with all utility owners for relocation of their utilities impacted by the Project. The Contractor will be responsible for the utility owner’s incurred design costs. Follow the procedures used in the VDOT Utility Manual 2011 for determining shared costs for construction relocation of gas, electric, fiber optic, and communication utilities both overhead and underground. Present documentation for the CO’s and VDOT’s review and approval of UT-9 determinations and forms, and other documents supporting the Contractor’s shared cost and utility owner’s shared cost. Provide all utility owner Plans and Estimates (P&E) for the CO’s and VDOT’s review.

Additional utilities design and construction requirements are as follows:

(a) Note: the Stafford County Department of Utilities reserves the right to provide the Contractor a design for all water mains and appurtenances to be relocated in public right of way or dedicated easement for their utilities. The Contractor will be responsible for all costs covering Stafford County Utilities design, and Stafford County Utilities cost for providing inspection services during construction. The Contractor will be responsible for the design of all sanitary sewer lines and appurtenances, meeting the requirements of the Stafford County Utilities. The Contractor will be responsible for all construction, including costs. The costs for betterments will be provided by the utility owners directly to the Contractor.

The Contractor will be required to sign an agreement with Stafford County Utilities prior to sanitary sewer design and construction relocation. No change in the agreement language will be allowed.

(b) Steel plates covering open trenches are forbidden under U.S Route 1 traffic.

(c) Replace all utility pipe and conduits under pavement within the Project Limits that are made of clay, or evaluated as deteriorated upon inspection.

The design, relocation of utilities, and construction cost for award is expected to fall within the price range of $1,000,000 to $2,500,000. This project is “Subject to Availability of Funds”.

In addition to the work outlined above, there will be one option that EFLHD has the right to exercise. The option at this time is “Subject to the Availability of Funding”. EFLHD has the

1A-3 right to exercise this option within 3 months after the contract Notice to Proceed.

Option 1 consists of constructing a new southbound right turn lane on U.S. Route 1 to westbound Telegraph Rd. Design the turn lane to minimize right of way acquisitions and utility relocations and to meet current VDOT design standards.

Government personnel will be available to clarify requirements at key sites. A written record of the conference will be furnished to all Offerors.

EFLHD will coordinate the site visit to the Telegraph Road and U.S. Route 1 area of the site following the Pre-Proposal Conference.

1.B.3 Evaluation and Selection Procedure Steps

EFLHD will use a Best Value Selection procedure as described in Subsection 1.B.5.

The selection procedure will involve the following major steps:

(a) EFLHD receives Technical and Price Proposals.

(b) Technical and Price Proposals are separated and Evaluation Panel (Panel) begins reviewing the Technical Proposals.

(c) Technical Proposals evaluated by the Panel in accordance with the technical evaluation factors in subsections 1.B.4.b

(d) Price Proposals evaluated by the Panel.

(e) Relationship of quality versus price evaluated per Section 1.B.5, with the overall proposal providing the best value to EFLHD forwarded to the Selection Official.

(f) Contracting Officer makes determination of award.

1B-4

1.B.4 Proposal Submittal

1.B.4.a Review of Price Proposal

The Price Proposal will include the Contract Bid Price total (from Table 1 of Price Form 01, Subsection 109.06 of the Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects FP-03 Is Table 1 of Price Form 01 available electronically) plus the Government’s Contract Administration Costs based on $1,100 per calendar day necessary to complete all contract work from Notice to Proceed (NTP) to final construction completion. The Offeror shall submit prices for each Lump Sum Bid Item, unit prices and quantities for each Statistically Accepted Bid Item, and unit prices for each Contingent Fee Bid Item as described in Section 109. In addition, the Offeror shall also provide the number of calendar days that they will commit to completing the project. The number of calendar days cannot exceed beyond June 1, 2014 for final completion of the project. The number of calendar days indicated by the Offeror will thereby establish the final completion date stated in Section 108, in which liquidated damages will be assessed for work required beyond that date.

The price used for evaluation purposes will be the sum of the Contract Bid Price and the Contract Administration Cost as shown on Price Form 01. The Government may reject a proposal if the prices shown are materially unbalanced between line items or sub-line items. A price proposal is materially unbalanced when it is based on prices significantly less than the cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the price proposal will result in the overall best value to the Government, or if it is so unbalanced as to be tantamount to allowing an advance payment.

See Subsection 1.C.3 for the required documents to be submitted with the Price Proposal.

The price provided will not be disclosed to individual technical evaluators prior to completion of technical evaluation.

1.B.4.b Review of Technical Proposal

EFLHD will use the evaluation criteria shown in 1.C.4 in assigning a numerical technical rating for each Offeror. The main categories of the technical proposal and maximum scores for each category are listed below:

• Technical Approach to Design and Construction. Maximum Score = 500.

• Project and Management Plan of how the contractor plans to accomplish the work.

Maximum Score =250.

• Acquisition of right-of-way, permanent and temporary easements. Maximum Score =

• Project Controls. Maximum Score = 50.

1.B.5 Best Value Determination

The Government will select the offer that represents the best value to the Government by using the trade-off process described in FAR Part 15. This process permits tradeoffs between price and technical (“noncost”) factors and allows the Government to accept other than the lowest priced

1B-5 offer. The award decision will be based on a comparative analysis and an integrated assessment of proposals against all source selection criteria in the solicitation.

All evaluation factors other than cost or price, when combined, are approximately equal to cost or price. The Government is concerned with striking the most advantageous balance between technical merit (“quality”) and cost to the Government (i.e., the price). The degree of importance of price could become greater depending upon the equality of the technical proposals. If competing technical proposals are determined to be essentially equal, price could become the controlling factor.

1.B.6 Award

The Selection Official will select for contract award the proposal which offers the best value to the Government.

The technical proposal will be incorporated into the contract by reference and the contractor shall be bound by its contents.

1C-1
