4. Add the following to the Special Contract Requirements, Page J-10:
Section 110. — ARCHAEOLOGICAL PROTECTION
Description
110.01 This work consists of protecting archaeological resources contained within the project limits, soil deposits, etc. This work includes allowing access for the Archaeological Monitor on site during all ground breaking and excavation work.
110.02 Definitions.
(a) Resources. Prehistoric, historic, and recent 20th century artifacts, including charcoal, human bone, ash, fire rocks, human building materials that indicate the presence of past human occupation, bullets, and other artifacts.
(b) Archaeologically Sensitive Areas. Areas that have been determined to contain significant in-the-ground archaeological resources.
(c) Non-sensitive Areas. Areas that have a low likelihood of containing significant archaeological resources.
(d) Archaeological Monitor. Representative of the Government designated to record and collect cultural resources for compliance with Government regulations to protect in-the-ground resources.
110.03 General. Although the project has the potential to contain archaeological resources, no archaeologically sensitive areas have been identified within the project limits, except as noted below. If, during the course of construction, archaeological resources are discovered within the project limits, notify the CO immediately of the findings, and follow the requirements of this Section, as directed by the CO.
The following areas have the potential to become archaeologically sensitive areas:
Stone Culvert along Richardson Avenue over Richardson Run.
Paving of Piper Lane.
Pry House Access Road.
Maryland Battery A, Light Artillery marker and New Jersey, Hexamer’s Battery marker.
Any work in sensitive areas as outlined in Subsection 108.01.
110.04 Submittal. Submit a Daily Work Schedule, detailing construction work in archaeologically sensitive areas 15 calendar days before the start of any ground disturbing activity. Key the schedule to the drawings and include the following information, as applicable:
(a) Starting and ending dates of ground disturbing construction.
(b) Locations of temporary facilities, such as barriers, field offices, staging areas, sanitary facilities, borrow pits, and haul and access roads.
(c) Types of construction, such as clearing, topsoil stripping, structure or trench excavation, landscaping, and post construction cleanup.
(d) Methods and equipment for each type of construction.
(e) Plan for relocating work in the event of temporary work stoppages at each archaeologically sensitive area.
110.05 Quality Assurance. Meet with the CO and Archaeological Monitor at least one week before on-site work begins to discuss the Daily Work Schedule, equipment, and special methods to be used in archaeologically sensitive areas. The Contractor is responsible for ensuring that the approved Daily Work Schedule is followed throughout construction.
The Contractor, CO, and Archaeological Monitor will conduct weekly inspections of structures and monuments adjacent to the project to identify any damage caused by construction operations.
Execution
110.06 Observation. The Archaeological Monitor will observe all ground-disturbing site work, including construction of temporary facilities, at all archaeologically sensitive areas, from a safe location mutually agreed on by the Contractor and Archaeological Monitor. As new ground is broken, the Archaeological Monitor will examine excavated materials, using construction layout centerline and perimeter staking as a reference point to record locations of findings.
110.07 Discovery of Resources. If the Archaeological Monitor discovers resources, relocation of the work to a non-sensitive area may be required to allow the Archaeological Monitor to take soil samples and record resources. While the Archaeological Monitor is documenting resources in sensitive areas, the Contractor will relocate work to non-sensitive areas where monitoring is not normally required.
If resources are discovered while the Archaeological Monitor is absent, stop work immediately and report the discovery to the CO.
110.08 Work Stoppage. The Contractor will plan, schedule, and execute the work to prevent stoppages at one area from stopping all work at the construction site.
Measurement and Payment
110.09 Do not measure archaeological protection for payment. See Subsection 109.05.
5. Add the following to Subsection 401.01 of the Special Contract Requirements, page J-17:
For pay item Superpave Pavement, ½-inch Nominal Maximum Size Aggregate, <0.3 Million ESAL, Type V Roughness (Brown Aggregate) supply a Polymer Modified Asphalt (PMA) binder that meets one of the following AASHTO M320 performance grades (PG): PG 70-28 or 64-28.
6. Add the following to Subsection 401.03 of the Special Contract Requirements, page J-17:
For pay item Superpave Pavement, ½-inch Nominal Maximum Size Aggregate, <0.3 Million ESAL, Type V Roughness (Brown Aggregate) provide a job mix formula that uses either brown river gravel or brown aggregate, brown screenings and a tan to brown colored sand. Do not use a sand source that is white in color. Do not use grey or black aggregate and screenings.
Superpave consensus aggregate property for coarse aggregate angularity requirements for the Superpave surface course is waived for this pay item.
Prior to beginning surface paving on Piper Lane or Pry House Access Road, submit samples of aggregate for approval. Construct a test panel 4 feet wide by 5 feet long using the proposed asphalt mix and thickness overlay. Treat the surface of the panel according to Section 409 for CO approval. Retain the approved test panel and construct roads to match the approved test panel. Do not construct the test panel as part of the final surface. Do not begin surface paving on these roads until the CO has inspected and approved the appearance of the test panel.
7. Add the following to Section 401 of the Special Contract Requirements, page J-22:
401.18. Add the following:
Measure asphalt for test panels by the ton.
8. Delete the reference “402.02” from Subsection 404.02 of Amendment 0001, page 5, and substitute the following:
404.02.
9. Add the following to Subsection 602.03 of the Special Contract Requirements, page J-29:
The stone retaining wall near station 67+00 on Branch Avenue has been identified as historic and cannot be disturbed by construction activities, except as shown in the plans. Replace the existing pipe by removing the pavement and excavating down to the pipe between the edges of pavement, then working outward to the ends of the pipe. Stones can be removed from the existing wall below grade only to accommodate the larger proposed culvert. Submit alternate plans to replace the culvert without disturbing the existing wall to the CO for approval at least two weeks prior to the start of construction.
10. Add the following to the Special Contract Requirements, page J-30:
Section 609. — CURB AND GUTTER
609.10. Add the following:

Questions/Clarifications
The following questions and issues were submitted via email at eflhd.contracts@dot.gov. The Government response or clarification is provided. Due to the repetitive nature of several questions and issues, the wording of the questions may have been revised and some questions have not been included. The Government’s direct response to the sender may also have been updated below for better clarity.
1. This question is in reference to item 40950-0000, Asphalt Surface Removal Treatment.
Can you direct me to any contractors that have performed this work in the past? We are have trouble finding interested contractors with the knowledge or experience to complete this work. Do you intend to do a water blasting or shot blasting operation to achieve the desired surface?
Response: Typically the Government does not specify material sources and subcontractors. It is the obligation of the bidder to determine their material sources.
Brown colored aggregate and completed examples of the asphalt surface treatment can be found at the following locations:
DTFH71-09-B-00020 - WHHO 407(1) - Pennsylvania Avenue at the White House (Wash DC) - Fort Myer Construction Corporation (Prime Contractor)
DTFH71-08-R-00001 - RICH 300(1), 305(1) – Richmond (VA) National
Battlefield Park - Firvida Construction Corporation (Prime Contractor)
In these projects the following sources were used: ½-Inch Nominal Maximum Size Aggregate (#7’s) Brown River Gravel supplied from Vulcan Materials Curles Neck Sand and Gravel, Richmond, VA plant and the #10’s (screenings) from The H&K Group’s Sanatoga Quarry in Pottstown, PA. These are examples of aggregate sources that were accepted by the NPS.
The specifications allow both water blasting and shot blasting and both were used on the projects listed; contact the prime contractor for further information.
2. We need definitions/clarifications on- “#1 Asphalt surface removal treatment" & “#2 Resurface asphalt sidewalk with aesthetic treatment"
Response: Both statements apply to the same work, which is paid for as item 40950- 0000. The work is described in Section 409 of the SCR’s.
3. Liquid asphalt for the Minor Hot Asphalt Concrete. Add. 1 states the liquid is to be a polymer modified with a performance grade of PG70-28 or PG64-28. Is a non polymer modified asphalt that meets 70-28 or 64-28 acceptable (70-28 is probably not available but 64-28 has historically been available from Ashland in Ohio). Typically, a neat asphalt (no polymer modification), is a whole lot less expensive than a polymer modified one. Also, polymer modification may make the asphalt too tough to strip away using shot or water blasting techniques for the Asphalt Surface Removal Treatment.
Response: A polymer modified asphalt is required as specified to provide a better resistance to raveling of exposed aggregate. PMA PG 70-28 was used on a recent project and there were no problems with exposing the aggregate.
4. In the Special Contract Requirements, page J-17, Asphalt binder is designated as performance grade PG 70. This is not readily available in our climate. Can PG64-22 be substituted?
Response: The asphalt binder requirement for Superpave asphalt concrete pavement (40101 items) will be revised to PG 64-22. The asphalt binder requirements for minor hot asphalt concrete (40401 items) will be revised to PG 70-28 or 64-28. These revisions have been included in Amendment 3.
5. Please see attached picture** with regard to the Asphalt Treatment. Is this what the owner is looking for?
Response: Yes, this is a general depiction of what is desired, however, final acceptance of the asphalt surface treatment is subject to CO and owner approval. (**Picture attached at end of this Questions/Clarifications document)
6. Is the contractor responsible for water/debris reclamation with regard to the Asphalt Treatment?
Response: Yes.
7. Special Provision section 409 (Asphalt Surface Treatment) does not state to what depth or size will be accepted by the owner. Please clarify to what extent the contractor will be required to treat the asphalt.
Response: The depth of asphalt surface treatment will be determined based on evaluation of the control strip required in Subsection 409.06 of the SCR’s. Subsections 409.07, 106.02, and 106.04 describe the evaluation and acceptance requirements.
8. What are the line widths for the road striping? 4" or 5"? What are the line widths for the stop bars and crosswalks?
Response: Pavement striping is 4 inches for edge lines and centerlines, or multiples of 4 inches as shown on Plan Sheets S-50 and S-51. Stop bars are 12 inches; crosswalks are 8 inches. Plan Sheet S-49 shows symbol dimensions.
9. Shouldn't there be a separate bid tab for the different widths of lines? For instance a 24" wide stop bar is a lot different than a piece of 4" Double Yellow centerline.
Response: See the third paragraph of Subsection 634.13 of the FP for clarification.
10. We need clarification on pay item no. 30301-3000, estimated quantity (40.00STA) shoulder and ditch reconditioning. Could you please verify if this is Linear ft or what.
Response: Refer to Subsection 109.02(n) for the measurement definition of Station.
11. Who provides the signs detailed on Sheet S-54? These are the ARRA signs. There is not a bid item or listing for this in the quantities.
Response: The signs detailed on Sheet S-54 will be provided by the Contractor.
Additional quantity and requirements have been included in Amendment 3.
12. Bid items 60201-0500 Threw 60211-0600 what type of pipe is this CMP, RCP and Class, or HDPE.
Response: Acceptable culvert pipe types are listed in Subsection 602.03 of the SCR’s.
13. Bid item 60415-0000 Trench Drain I have looked at site 4 cornfield avenue, seem like it maybe under drain and not trench drain I am not sure. Cannot find a detail for trench drain.
Response: The trench drain to be installed is a slotted trench drain with an ADA-compliant grate.
14. Bid item 60103-0200 I do not see a detail for the headwall just the stone headwalls item 62011-0200.
Response: A concrete headwall detail has been included in Amendment 3.
15. Bid item 60409-1000. The concrete top for PCC inlet Site 5 there is no detail for a PCC inlet.
Response: A concrete inlet top detail has been included in Amendment 3.
16. Plan Sheet R08 Section A-A indicates Grouted, Class I Riprap is to be placed under the Sherricks Run Bridge at abutment 2. Please provide an appropriate pay item for this work, as the only riprap item is Item 25101-3000 Placed Riprap Class 3.
Response: The quantity for pay item 25101-3000 Placed Riprap, Class 3 has been revised and a new pay item for Grouted Riprap, Class 1 has been added in Amendment 3.
17. Plan sheet C4 Summary Quantity Schedule C indicates there is 810 square yards of Removal of Existing Pavement at site 18 (Trails). The only removal shown on the site 18 drawings is on plan sheet D41 and is only approx. 80 square yards. Please advise as to the location of the remainder.
Response: The quantity is incorrect. Quantity corrections have been included in Amendment 3.*
18. Plan Sheet B3 Typical Sections indicates existing asphalt is to be removed to a width of 1 foot in areas to be widened. This quantity of Removal of Asphalt Pavement has not been accounted for in the bid quantities. Please clarify measurement and payment for this removal.
Response: The quantity is incorrect. Quantity corrections have been included in Amendment 3.*
19. Knowing that the Asphalt Removal for the widening was not accounted for, I question if the Roadway Excavation for the same widening has been included. Please verify the Roadway Excavation quantity includes the widening excavation.
Response: The roadway excavation quantity is correct.*
20. We are in receipt of Amendment No. 001 on the above project. Please review Item 4 on page 5 of 7. This item says to “add the following to Subsection 404.02 of the Special Contract Requirements on page J-24”. The very next line says “402.02 Add the following.”
Section 402 is not on page J-24 but Section 404 is. Is this just a typographical error? There isn’t a section 402 in the Special Contract Requirement. Please clarify.
Response: The wording is incorrect. This has been corrected in Amendment 3.
21. Also, this amendment adds an adjustment clause for liquid asphalt but it says that the “BPI” will be provided by the Government “after” award of the contract. Can this be provided now so that we know what index we should base our bid?
Response: The Base Price Index for asphalt cement, as stated on Amendment 001, page 3, will be provided by the Government after contract award. Bidders can determine their own BPI’s for estimating purposes by contacting the appropriate service. It is our understanding that temporary (free) subscriptions can be obtained from the Oil Price Information Service (OPIS) for asphalt cement BPI’s.
The asphalt cement price adjustment provision provides the Contractor a method to be compensated for an increase in the material costs used in the construction of the applicable pay items if those prices increase after award of the contract. Any increases in price will be administered under a Contract Modification provided that the necessary documentation is submitted to the CO according to Subsection 109.06 of the
FP.
22. For the roadways marked for 1' and 2' widening, do you want the existing edge of asphaltto be sawcut, so the new base asphalt has a straight uniform surface along the edge to tie into? If sawcutting the edge of asphalt is part of the road widening, will the contractor be paid for the removal of this asphalt under item 20303-1600?
Response: Sawcutting is required around the edges of pavement removal as stated in the notes on the Typical Sections (Plan Sheets B1 to B8) and in Subsection 203.04 of the FP. The removal of asphalt pavement is paid under item 20303-1600. There is no direct payment for sawcutting. Please see Subsection 109.05 of the FP for further information regarding scope of payment for direct and indirect work. Each bidder will have to determine where they absorb their indirect costs.
23. The note on the lower half of the page says ' Raise roadway 3" average. Please define what you want done on this roadway to raise it an average of 3 inches. Do you want the surveyor to establish a new grade for the road based on the existing road data? Do you want the paving contractor to raise the road with asphalt to the new raised grades and how do you want the asphalt courses to be placed( truing & leveling course, binder course, surface course etc,)?
Response: The profile of the road will be raised by eliminating the asphalt pavement milling between stations 7+00 and 10+00. The ‘raise roadway’ note will be removed from the Plans and a new typical section will be added to address the section from station 7+00 to 10+00. Construct pavement transitions at all tie-ins according to Plan Sheet S-9 (Detail E401-1). The revised plans have been included in Amendment 3
24. Please clarify the Structural Concrete and Concrete Repair items. It appears the Structural Summary on plan sheet C6 has the quantities reversed (the quantities for Richardson Avenue are for Sherricks Run and vice versa).
Response: The quantities are reversed. The affected plan sheets were corrected in Amendment 1.
25. Is there a site plan or distance from the loop(s) to the traffic counter post?
Response: Place loops in the area specified on Plan Sheets D1 and D21 and as directed by the CO.
26. There are specs that do not seem to pertain to this project, i.e. lights, panels etc. Are they applicable?
Response: All information provided in Section 636 of the SCR’s applies to this project;
the Section title reference to lighting is the same as shown in the FP. Any references to panels pertain to material test panels and sign panels.
27. Is there a subcontracting plan for MBE requirements for this project?
Response: Subcontracting plans are only required from “All other than small business”. As only 8(a) firms are eligible to bid on this project, no subcontracting plan is required.
28. Sheets B-2 & B-3, Mill & Overlay With Widening; The cross section details show a removal of one foot of the existing roadways. Is one foot of the adjoining existing asphalt roadway to be removed with all road widenings?
Response: The Typical Sections (and notes) indicate the removal of the existing asphalt by sawcutting along the longitudinal length of roadway from Sta x to Sta y. If the bidder's phrase "adjoining existing asphalt roadway" means going into the existing intersection or going beyond the station limits, this is not what we are asking for. The hatching on the Plan Views (D Sheets), indicate where the widening is required and how it tapers back to match existing.
29. The local quarries have relayed to me that they will be submitting a Maryland DOT classified riprap which is used throughout the State of Maryland, but may not meet the percent of rock by mass' criteria listed in the FP-03 specification. Please be informed that the FP-03 specifications are generic specifications for Federal projects, but they do not take into account the fact that different regions across the country cannot supply certain contract materials because they are not indigenous to the region.
Response: For placed riprap, MDSHA Class 0 is an adequate gradation substitute for FP Class 1 and MDSHA Class 2 is an adequate gradation substitute for FP Class 3.
Rock durability and other requirements would still have to meet the FP requirements.
30. Same narrative as riprap question except it applies to the aggregate base, grading 'C' & 'D' in Table 703-2. We will be submitting a Maryland DOT crusher run or GAB subbase material that is used throughout the State.
Response: See Subsection 703.05 of the SCR’s; a MDSHA substitute is allowed.
31. Please clarify the following questions concerning the installation of the traffic counters:
a) are these traffic counters to be solar panel powered
b) if so, what type of pole do you want for the solar panels - timber, steel, etc.
c) how high do you want the solar panels off the ground
d) how do you want to communicate with the counters; i.e. wireless modem w/ site specific software
e) does the visitors center have an IPS and does that provider have wireless coverage in this area
f) will the park service be providing the exterior paint, if not - what color paint is required
g) how far off the edge of pavement do you want the pole for the solar panels? The subcontractor bidding this item said that he has installed counters at other National Parks and these are issues that have arisen in the past.
Response: The traffic counter is to be solar powered; no pole will be necessary. Other specifics and details for the traffic counter system have been included in Amendment 3.
32. Page J-36 (middle of the page) says to "install traffic counters". Do they need electric?
The drawings don't show any other connections.
Response: Traffic counters are to be solar-powered. Traffic counter requirements have been included in Amendment 3.
33. What is the intention of the Accelerated Stabilization? We cannot find an item anywhere for this but the E+S section of the plans show this and we do not know what it is.
Response: See Sections I-C and II-A-7 on Plan Sheet M-1.
34. I am attempting to put together a bid for the Antietam National Battlefield Project (DTFH71-10-B00011); however I have old specifications for Super Silt Fence for the Federal Highway Administration. Is it possible for you to send me some that are current?
Response: A revised super silt fence detail has been included in Amendment 3.
35. 60201-1100-42” Pipe Culvert. The plans (pg. S-20) show that we are not to disturb the stone masonry walls at this location, but if we open cut the road to install the 42” pipe we will need to remove pavement and stone walls to do so. Is it your intension to open cut the road and remove and replace the walls and if so will we be paid to reconstruct the road and walls at this location or are we to bore the new pipe through?
Response: The existing hole will be expanded to accommodate the 42 inch pipe. No other wall removal is necessary. Alternate plans for replacement of the culvert without disturbing the historic wall can be submitted to the CO for approval during construction. This has been revised in Amendment 3.
36. The bid schedule and the schedule summary call for these walls to be stone masonry, but the existing headwalls on Branch Ave are concrete and the new headwalls have to be constructed between the existing concrete walls and dowelled to the existing. Are the new headwalls to be completely constructed of stone masonry? Are they to be concrete headwalls faced with stone masonry? Are they to be concrete headwalls to match the existing? The notes on sheet D-28 say ' construct new concrete headwall for a 42" pipe ' but they are listed to be stone masonry headwalls in the contract. Please clarify.
Response: The description of work at these sites has been revised in Amendment 3.
37. If the local or State jurisdictions require additional traffic control signage beyond what is defined in the summary & schedule sheets, will the contractor be compensated under item # 63504-1000?
Response: The traffic control signage has been approved by the MDSHA. We do not anticipate additional traffic control signage. See response for #39.
38. Can the contractor determine that he needs a flagger(s) for any legitimate contract operation and be paid under item 63506-0500, or is the need for a flagger determined by the CO? Such as: work on other sites prior to the roadways being closed to traffic.
Response: See Subsection 635.26 which states that Section 635 items (flaggers) will be measured as applicable when ordered by the CO. Typically the Contractor and CO can agree when and where flaggers are required. See response for #39.
39. If the durations for the contractor's operations cause the required flagger time to exceed 800 hours, will the contractor be compensated for the additional hours in excess of 800?
Response: Quantities shown on the Plans and Bid Schedule are estimated and all items are bid and paid for on a unit price basis. The Contractor will be paid for the amount of work ordered by the CO, completed and accepted per the specifications. Please note all quantities of work must be ordered by the CO; if the Contractor performs work not ordered, the Government will not pay for it. See the last paragraph of Subsection
109.05 of the FP.
