About this file

This is Addendum No. 1 issued by the California Environmental Protection Agency Department of Resources Recycling and Recovery (CalRecycle) for RFP(S) DRR24036, "Study on the Availability of Postconsumer Recycled Plastic in the Market." The addendum provides clarifications and updates to the original RFP, including an attached list of interested parties. The RFP timeline and task completion dates will remain firm, with no extensions granted to the proposal deadline. The scope involves conducting a comprehensive market analysis of postconsumer recycled plastic to support decision-making regarding postconsumer recycled content standards.

The project is funded through the California Beverage Container Recycling Fund. The cost proposal amounts are fixed and cannot be modified, with all rates and fees remaining firm for the duration of the contract. While initially required, Small Business (SB) participation has been changed to "encouraged," though contractors can still qualify for SB preference by subcontracting at least 25% of services to a California-certified SB. The addendum includes a list of five interested parties: Accenture LLP, Resource Recycling Systems Inc., Source Management, Tetra Tech BAS Inc., and Crowe. CalRecycle declined requests for milestone-based pricing or fixed-fee per deliverable payment structures, maintaining the time and materials, task-based resource structure.

RE: “Study on the Availability of Postconsumer Recycled Plastic in the Market, DRR24036”

Addendum No. 1 To the Request For Proposal, Secondary (RFP(S))

CalRecycle is issuing Addendum No. 1 to provide the following information.

1. Attachment 1 includes a list of interested parties.

2. Revisions have been made to the RFP(S) within the electronic bid system and a Summary of Changes is available here https://sb.cityinnovate.com/teams/calrecycle?challenge_id=11038. The revisions will replace all prior versions of the RFP(S). Below is a list of changes that were made. Please refer to the Summary of Changes. Changes made in the documents are shown as: Text additions are displayed in bold and underlined. Text deletions are displayed as strike-through.

· Link to the Contractor’s Certification Clause has been added. Refer to Attachment 9.

· The Small Business (SB) participation has been revised from required to encouraged.

· Link in 2.2 COMMITMENT, Exhibit D, ATTACHMENT 15 SAMPLE STANDARD AGREEMENT has been replaced with Exhibit D: Special Terms and Conditions.

3. The following questions were received during the Questions and Answers period.

Q
1
Will CalRecycle consider a two-week extension on the proposal deadline?
A
1
No, CalRecycle will not be extending the proposal deadline.
Q
2
Can you confirm whether 25% of the budget must be allocated to a small business (SB)?
A
2
Allocating a portion of the budget to a SB is not mandatory. While SB participation is encouraged, it is not required. However, to qualify for the SB participation preference, the Proposer must subcontract at least 25% of the total contract services to a California-certified SB.
Q
3
Is there flexibility to some or all the start/end dates prescribed in "Contract Task Timeline"? If so, which tasks have inflexible or flexible dates?
A
3
No.
Q
4
What is the funding source for this project?
A
4
The funding is sourced from the California Beverage Container Recycling Fund.
Q
5
Is there flexibility to some or all the not to exceed budget amounts identified within “Cost Breakdown,” especially as the work plan is finalized?
A
5
No. The amount identified in ATTACHMENT 4: COST PROPOSAL SHEET may not be changed and will remain in effect for the life of the Contract. All rates and fees are firm fees to which the Contractor or any subcontractors will be contractually bound for the length of the contract.
Q
6
With the interest of increasing the probability of receiving multiple qualified offers, given the complexity of obtaining and processing the data set, and the nature of the scope of work, can CalRecycle waive the SBE participation requirement, or if not, make it optional?
A
6
Yes. CalRecycle has changed the Small Business (SB) participation goal from required to encouraged.
Q
7
To facilitate the administration of the contract and to provide the most flexible delivery approach, would CalRecycle be amenable to a milestone-based pricing sheet or fixed-fee per deliverable payment structure instead of time and materials, task based by resource?
A
7
No.
Q
8
Can clarification be provided on what "e. Consumer participation rates" is referring to in Task 4 economic factors? For example, is this referring to participation in return of CVR containers specifically, any recycling participation, or participation in demanding products with higher recycled content? Is this referring to participation in California or globally?
A
8
"Consumer participation rate" means the volume of plastic material collected for recycling after its intended use by consumers. This includes, but is not limited to, plastic beverage containers subject to California Redemption Value (CRV) assessment.
Q
9
Will CalRecycle be amenable to recommended changes in study timeline or duration with the focus of optimizing the timing of data collection and submission of deliverables?
A
9
Refer to A3 response.
Q
10
We may encounter challenges in obtaining comprehensive, high-quality data on the number of suppliers and the origin of postconsumer recycled plastic due to the fragmented and opaque nature of the supply chain, inconsistent reporting practices, competition for feedstock across industries, and the absence of centralized or standardized tracking systems. Could CalRecycle please elaborate on the specific expectations for these two metrics and any preferential data sources or methods?
A
10
The purpose of this contract is to provide a comprehensive market analysis of postconsumer recycled plastic that provides the department with the decision support needed to access the appropriate postconsumer recycled content standard, among other aspects stated in the scope of work. The department is relying on the expertise of the chosen contractor to assess the scope and the methods employed to meet the goals of this project.
Q
11
How does CalRecycle currently measure or track compliance of minimum postconsumer recycled standards by beverage manufacturers?
A
11
Beverage manufacturers are required to submit an annual “Plastic Beverage Container Virgin and Postconsumer Resin Report” (CalRecycle 251). The results are captured in Microsoft Excel. The reporting results are then published on CalRecycle’s Plastic Minimum Content Standards and Reporting for Beverage Manufacturers (AB 793) https://calrecycle.ca.gov/bevcontainer/bevdistman/plasticcontent/ as required by Public Resources Code Section 14549.3(d).

All other terms, conditions, and requirements of this RFP(S) will remain the same.

If you have any questions relating to this solicitation process, please contact me by e-mail at contracts@calrecycle.ca.gov.

Sincerely, Nadine Mills Nadine Mills Contract Analyst, Administrative Services Branch Attachment
