2. The Corporation will compensate the Contractor based on actual quantities performed by modifying the contract to add or deduct units for changes in quantities per the appropriate unit prices. The unit prices will also apply to contract modifications generated because of any change in the project scope.

DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

SPECIAL PROVISIONS

C.1. PROJECT BACKGROUND

The Saint Lawrence Seaway Development Corporation (“Corporation” or “SLSDC”) is a wholly-owned U.S.

Government corporation within the U.S. Department of Transportation which operates and maintains that portion of the St. Lawrence Seaway in U.S. territorial waters between Lake Ontario and Montreal, Canada. The SLSDC’s mission is to facilitate the safe and efficient passage of commercial vessels through the Seaway, a major part of which is the operation and maintenance of the Wiley-Dondero Canal navigation channel as well as the Eisenhower and Snell Locks which are in Massena, New York. To facilitate this mission, the SLSDC is acquiring a new deep-draft tug. To accommodate the increased draft of the new tug, it is necessary to dredge the SLSDC marine services operating areas at the Marine Base mooring area and the Eisenhower Lock Spare Gate assembly areas to a deeper depth. These areas are located outside the navigation channel boundaries in the “Intermediate Pool” section of the

Wiley-Dondero Canal that is located between Eisenhower and Snell Locks.

C.2. WORK SITE REQUIREMENTS.

a. General. The Dredging Contractor acknowledges that he/she has satisfied himself/herself as to the nature and location of the work, the general and local conditions, including but not restricted to those bearing upon transportation, disposal, handling, and storage of materials, availability of labor, water, electric power, roads, uncertainties of weather or similar physical conditions at the site, the conformation and conditions of the ground and structures, and the character of equipment and facilities needed preliminary to and during prosecution of the work. The Dredging Contractor further acknowledges that he/she has satisfied himself/herself as to the character, quality and quantity of surface and subsurface materials or interference from existing structures or related facilities to be encountered insofar as this information is reasonably ascertainable from an inspection of the site as well as from information presented by the contract drawings and these specifications. If the Dredging Contractor fails to properly acquaint himself/herself with the available information and existing work site conditions, he/she will not be relieved from responsibility for properly estimating the cost of successfully performing the work.

b. Utilities. The Dredging Contractor shall be responsible for providing and maintaining at his/her own expense, any utilities required for the performance of the work.

c. Potable Water. Any potable water required shall be provided by the Contractor at his/her own expense.

d. Sanitation. The Dredging Contractor shall provide toilets within his/her work areas and on their floating plant, which shall comply fully with the New York State Department of Health Standards. The capacity of the toilet facilities shall be sufficient to provide for the needs of the Dredging Contractor’s people, and all waste material from the toilets shall be disposed of away from the site. The Dredging Contractor shall be responsible for keeping his/her work areas clean of refuse of any kind and shall dispose of all refuse off the sites.

e. Parking Areas. The Contractor and his/her work crews may park their vehicles and equipment in designated areas at the Marine Base and at the spoil disposal site at the north side of Snell Lock. The Contractor shall keep the guide wall surface and adjacent paving along the north side of Snell Lock free of vehicles and equipment.

f. Work Areas. The work sites required by this contract are the above-mentioned dredging sites in the Wiley-

Dondero canal and the spoil disposal site on the north side of Snell Lock as shown on the Contract Drawings. The spoil disposal site may be used also for equipment and materials staging. Be aware that land access to the spoil disposal area is through a 13’-6” posted highway tunnel under Eisenhower Lock. Certain areas at the Marine Base may be made available to the Dredging Contractor for equipment and materials staging as arranged through the

COTR.

g. Restricted Areas. The Dredging Contractor will be required to confine his/her operations to the work areas, as designated in the previous subparagraph. Except for specifically designated areas, the adjacent access roads, parking areas and SLSDC buildings shall be kept free of the Dredging Contractor’s personnel, materials and equipment. When necessary for the Dredging Contractor’s personnel, materials, or equipment to occupy or transit these restricted areas, the COR shall be notified so that this can be coordinated with SLSDC operations.

Floating plant access to all work sites and activities therein are controlled by the SLSDC Eisenhower Vessel

Traffic Control Center (VTC) and must be coordinated through VTC. This is discussed more thoroughly in C.13

“Communications” in the Technical Provisions.

h. Existing Conditions and/or Existing Features.

Dredging Areas: There are two dredging areas. One is located just east of the spare gate assembly towers at the end of the Eisenhower Lock downstream north approach wall. This area is designated as the Eisenhower Lock spare gate assembly area. The other dredging area is adjacent to the SLSDC Marine Base/Maintenance Facility at 251 Fregoe Road, in Massena, New York. This area is designated as the Marine Base mooring area. Both areas are near the navigational channel within the St. Lawrence Seaway Wiley-Dondero Canal between Eisenhower and Snell Locks but are located outside the specific boundaries of that navigational channel, as shown on the contract drawings. There is no appreciable current at the dredging areas except that there may be some periods of slight turbulence immediately downstream of Eisenhower Lock while water is being released from the lock chamber. The water level in the Intermediate Pool is relatively constant, being regulated at or near elevation

199.5 feet. All water levels and channel bottom elevations are based on the International Great Lakes Datum

(IGLD) 1985.

Spoil Disposal Area: The spoil handling and disposal site (“Spoil Disposal Area”) is located just north of the north approach wall at Snell Lock. It is covered with weeds, brush and scattered small trees and contains unimproved roads and trails leading to previous dredging spoil disposition areas. It is adjacent to the upstream guidewall at

Snell Lock, and is shown in the contract drawings. Ground surface elevations shown on the Contract Drawings are based on the IGLD 1955. The Dredging Contractor shall develop the disposal site as necessary to receive the dredged material, and shall operate the site in conformance with all applicable storm water permits and storm water pollution prevention plan.

C.3. LAYOUT OF WORK.

The Dredging Contractor shall provide all labor and equipment for layout of the work as described in the Technical Provisions.

C.4. ENVIRONMENT PROTECTION.

a. General. For this specification, environment protection is defined as the retention of the environment in its natural state to the greatest possible extent during project construction and the enhancement of the natural appearance in its final condition. Environment protection requires consideration of air, water, and land and involves noise, solid waste management, and management of radiant energy and radioactive materials, as well as other pollutants. To prevent, and to provide for abatement and control of, any environmental pollution arising from the construction activities in the performance of this contract, the Contractor and his/her subcontractors shall identify and comply with all Federal, State, and Local laws and regulations concerning environmental pollution control and abatement. Any non-compliance shall be immediately corrected and the Corporation be immediately notified. The project is subject to dredging permits issued by the US Army Corps of Engineers (USACE) and

New York State Department of Environmental Conservation (NYSDEC). These permits are the responsibility of the SLSDC who will provide them to the Dredging Contractor. SLSDC will have a consultant obtain on behalf of SLSDC a NYSDEC SPDES stormwater discharge General Permit (SPDES Permit) discharges and develop a

Storm Water Pollution Prevention Plan (SWPPP) that is associated with that permit. The Dredging Contractor shall conform to the requirements of the SPDES Permit and SWPPP for this project. The SLSDC will provide these documents to the Dredging Contractor if when they become available, but will be after award of this contract. Bidders may use the previous project SWPPP in Technical Attachment 4 as a guide in preparing their bids since the SWPPP for this project is not expected to differ substantially from the previous one.

b. Notification. The COTR will notify the Dredging Contractor of any noncompliance detected by the

Corporation with these Federal, State or Local laws or regulations. Such notice, when delivered to the Dredging

Contractor or his/her authorized representative at the site of the work, shall be deemed sufficient for the purpose.

The Dredging Contractor shall, after receipt of such notice, immediately inform the COTR of the proposed corrective action and take such action as may be approved. If the Dredging Contractor fails or refuses to comply promptly, the COR may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop order shall be made the subject of a claim for extension of time or for excess costs or damages by the Dredging Contractor. The Dredging Contractor shall be responsible for all costs to promptly clean up and abate any environmental pollution he/she is responsible for. If the Dredging

Contractor does not promptly do so, SLSDC may do so at the Dredging Contractor’s expense.

c. Protection of Land Resources. The land resources within the project boundaries and outside the limits of permanent work performed under this contract shall be preserved in their present condition or be restored to a condition after completion of construction that will appear to be natural and not detract from the appearance of the project. The Dredging Contractor shall confine his/her construction activities to areas defined by the plans and specifications.

d. Protection of Water Resources. The Dredging Contractor shall follow all provisions of the permits and shall not pollute protected waters with fuels, oils, bitumens, calcium chloride, acids, insecticides, herbicides, or other harmful materials. The Dredging Contractor shall comply with all applicable Federal, State and other applicable laws and regulations concerning the protection of protected waters. Dredging methods shall be carried out in such a manner as to minimize the release of suspended solids into the water. Barge overflow will not be permitted. All environmental monitoring required by the permits is the responsibility of the Dredging Contractor and must be carried out per the permit requirements.

d. Storm Water and Runoff Management. Runoff water shall not be allowed to enter the waterway unless suspended solids and other pollutants are removed and mitigated in accordance with the SWPPP.

C.5. MISPLACED MATERIALS

Should the Dredging Contractor, during the progress of work, lose, dump, throw overboard, sink or misplace any material, plant, machinery, or appliance which in the opinion of the COR may be dangerous to or obstruct navigation, the Dredging Contractor shall recover and remove the same with utmost dispatch. The Contractor shall give immediate notice, with description and location of such obstructions, to the COR and to VTC; and when required, mark or buoy such obstructions until they are removed. Should he/she refuse, neglect or delay compliance with the above requirements, such obstructions may be removed by the Corporation and the cost of such removal may be deducted from any money due or to become due to the Contractor or may be recovered under his/her bond. The liability of the Dredging Contractor for the removal of a vessel wrecked or sunk without fault or negligence shall be limited to that provided in Sections 15, 19 and 20 of the River and Harbor Act of

1899.

C.6. PLANT.

The Dredging Contractor shall furnish all plant to meet the requirements of the work. This plant shall be in satisfactory operating condition and capable of safely and efficiently performing the work. The plant shall always be subject to the inspection of the COTR. The Dredging Contractor shall furnish with his/her bid the minimum plant which he/she agrees to place on the job in the "Statement of Plant". The Statement of Plant shall give the ID name or number of each major floating and land-based piece of equipment, a full description of the item, the capacity in cubic yards of bucket type dredges, the inside diameter of the discharge pipe for pipeline dredges, engine horsepower of major units, volume of scows and hauling units, and other such information as necessary to analyze the type of equipment being furnished. The listing of such equipment is not to be construed as an agreement on the part of the Corporation that the equipment is adequate for the performance of the work.

C.7. FLOATING PLANT.

All floating plant must be of United States registry, have proper U.S. Coast Guard inspection and certifications and shall conform to the requirements specified in the “Seaway Regulations”. All operators of self-propelled craft shall be in possession of current certification appropriate to the class of craft operated. All permits required to operate and transit floating plant are the responsibility of the Contractor. The Dredging Contractor shall follow and be responsible for compliance with all applicable rules and regulations of the U.S. Army Corps of Engineers, the U. S. Coast Guard, the State of New York and the SLSDC “Seaway Regulations” (33 CFR Part 401) concerning construction and navigation in and upon the navigable waters involved in this contract.

C.8. DISPOSAL OF SPOIL.

Dredging spoil shall be disposed of in accordance with the requirements stated in the Technical Provisions. Rip rap from the Marine Base shall be stockpiled and re-used as per the Contract drawings and Technical Provisions.

Other waste materials generated from the project shall be disposed of off-site in accordance with all applicable

Federal, State and local regulations.

C.9. DISPOSAL BY BURNING.

Burning will not be permitted.

C.10. SAFETY.

The Dredging Contractor shall be responsible for performing all work in accordance with all applicable

Occupational Safety and Health Administration (OSHA) regulations and all applicable United States Coast Guard regulations.

C.11. WAGE RATES.

a. In accordance with the requirements of Clause (a), Davis Bacon Act, (40 U.S.C. 276 a-7), see Part II, Section

I, General Provisions, Clause 52.222-6 of this contract, the minimum wages to be paid to laborers and mechanics on this project, as most recently determined by the Secretary of Labor to be prevailing for the corresponding classes of laborers and mechanics employed on projects like this one in the pertinent locality, are as set forth attached to this contract. The complete determination is incorporated in the contract specifications regardless of whether the Contractor will employ all the classes of laborers and mechanics listed.

b. Any class of laborers and mechanics not listed which will be employed on this contract shall be classified or reclassified by agreement between the Dredging Contractor and the class of labor concerned, subject to the prior approval of the Contracting Officer.

C.12 WORK SCHEDULES

Pursuant to the conditions of the permit, the NYSDEC must be notified at least 48 hours before project startup. The

SLSDC will make this notification. The Dredging Contractor most notify the SLSDC at least five (5) business days before project startup to give sufficient time to notify the NYSDEC. The Dredging Contractor will be working near an active navigation channel; thus he/she must be in constant communications with the SLSDC Eisenhower Vessel

Traffic Control Center (VTC) to prevent interference with marine traffic. All movements of floating plant in the navigation channel shall be made in accordance with C.14 “Maintenance of Navigation” below. The above described restrictions do not apply to land-based operations at the disposal site.

C.13. COMMUNICATIONS.

The Dredging Contractor must have an Automated Identification System (AIS) system on the dredging plant and on the craft used to transport dredged materials to the disposal site. The AIS shall automatically broadcast the location of the dredge and transport craft to VTC and to other ships in the vicinity. The Dredging Contractor shall also equip all powered floating plant with a VHF marine radio capable of transmitting and receiving on Marine

Channels 11, 12 and 14. Whenever the Dredging Contractor is operating in or near the navigation channel, radio watch must be maintained on these frequencies. All vessel movements must be coordinated with VTC and other vessels in the vicinity by means of radio communications. The Dredging Contractor shall follow the radio procedure given in the Seaway Handbook, which is available on-line at http://www.greatlakes-seaway.com/seaway_handbook/table-of-contents-e.html. For communications between the Dredging

Contractor’s own personnel and equipment at the work sites, the Dredging Contractor shall use another frequency of his/her own choosing, subject to the approval of the COTR so as to not interfere with other SLSDC used frequencies.

C.14. MAINTENANCE OF NAVIGATION

The Dredging Contractor shall ensure that the equipment and plant used for the work do not interfere in any way with maritime traffic. For any movements of floating plant within the navigation channel, the Dredging Contractor http://www.greatlakes-seaway.com/seaway_handbook/table-of-contents-e.html http://www.greatlakes-seaway.com/seaway_handbook/table-of-contents-e.html must coordinate his/her activities with VTC and shall always keep VTC informed of the location of equipment either while anchored or in transit. VTC can provide the shipping schedule which is typically available no more than 12 hours in advance at any time. The shipping schedule may also change at any time without prior notice.

The Dredging Contractor shall maintain AIS equipment in an operational mode at all times the floating plant is in use, in transit or at any location other than at the designated mooring location(s) at the Marine Base and/or spoil site. Commercial and military vessels navigating the Wiley-Dondero Canal will do so in the navigation channel and will have priority. Delays to the Dredging Contractor to navigate within or to cross the navigation channel are expected to be minimal. Work areas in this contract are not within the navigation channel. SLSDC is not responsible for any costs incurred associated with such delays.

Materials: Other than the existing sheetpiling wall stability berm rip rap which will be re-used upon completion of dredging, the SLSDC will furnish no materials for this project.

C.16. CONTRACTOR-FURNISHED MATERIALS.

The Dredging Contractor will need to supply rip rap for the Marine Base stability berms. New rip rap will be required for the Zone C berm and may also be needed to supplement existing rip rap for the Zone B berm. New rip rap shall be crushed ledge rock of particle sizes 6 to 18 inches. Submit description and source for approval.

The Corporation will modify the contract pursuant to actual quantities per the contract unit price per Item No. 6 to compensate the Dredging Contractor for additional materials he/she uses.

C.17. SITE VISIT.

Bidders are recommended to visit the work site prior to preparing bids to better determine the extent of work required. Failure to visit the site will not relieve the successful bidder of the responsibility for completion of the intended work. A site visit will be conducted on July 28, 2020 and August 5, 2020 at 10:00 A.M. Arrangements must be made with the SLSDC Office of Engineering, Phone (315) 764-3240 (no collect calls) at least three business days in advance so that any requirements to enter SLSDC property can be conveyed and adhered to by the bidder. Any expenses incurred in the site visit will be borne by the bidder.

TECHNICAL PROVISIONS

C.18. DESCRIPTION OF WORK.

1. The Dredging Contractor shall furnish all plant, labor, equipment, materials and perform all work for the dredging, transporting and proper disposal of bottom material from the designated dredging areas as shown on the Contract

Drawings and specified herein. The work also includes the before-dredging removal of the rip rap stability berm next to the Marine Base anchored sheetpiling wall and its after-dredging reconstruction in the same location, per paragraph C.22 and the contract drawings.

2. The Dredging Contractor shall comply with all conditions of all permits. A copy of the permit with all referenced documents and conditions shall always be available for inspection at all project sites. The

NYSDEC permit sign(s) shall be posted in a conspicuous place at all work sites and be adequately protected from the weather. The SLSDC will furnish one copy of the sign but the Dredging Contractor shall make such additional copies as needed to cover all work sites. The Contractor shall permit and facilitate inspection visits by any NYSDEC, USACE, and/or SLSDC representatives to any work site or Contractor’s plant.

3. The Dredging Contractor shall use dredging methods that will minimize suspended solids in the water. Rip rap at the Marine Base sheetpiling wall may be handled with a clamshell, grapple, backhoe, etc. Dredged material shall be transferred from the dredge to a scow by direct release from the dredging bucket, or by pumping into a scow either adjacent to the dredge or moored outside the navigation channel. Equipment shall not be operated directly in the water, but rather be operated from floating plant or on land.

4. The dredging sites are shown on the Contract Drawings. The specific areas within the dredging sites that are above elevations designated on the drawings and thus require dredging will be determined from the

SLSDC pre-dredge hydrographic surveys. Within these specific areas, all material shall be removed that is above the designated elevation. The depths corresponding to those elevations are referred to as the

“Minimum Pay Depths”. The hydrographic surveys on which the contract documents are based depict a representative condition of the existing channel bottom that is provided for informational and bid purposes only. Quantity determinations for payment purposes shall be based on pre-dredge and post-dredge hydrographic surveys performed by SLSDC. All material (except rip rap) removed to bring the designated areas to the required elevation shall be disposed of at the disposal site shown on the Contract Drawings.

The material placed in the spoil site shall be stabilized and managed such that neither the spoils themselves nor any runoff from the spools can enter any water body or wetland area. Rip rap removed from Zone B at the Marine Base site shall be stockpiled at a location designated by the COTR for re-use.

5. A filter fabric turbidity curtain weighted along the bottom and suspended at the top by floats shall be placed to completely enclose the dredging site prior to commencing any dredging operations. The curtain shall remain in place and fully functional during all phases of the dredging work and remain in place for at least two hours after dredging termination and until turbidity inside the curtain no longer exceeds the ambient levels. The water downstream of the dredging site shall always be as clear at that upstream.

6. At the Marine Base mooring area, where the dredging is conducted adjacent to the sheetpiling wall, immediately after completion of the dredging in that area, construct stability berms of rip-rap per zones indicated on the contract drawings and Paragraph C.22. Rip rap used for Zone B shall be that which was stockpiled per C.18.4 above, supplemented by new as needed. New rip rap will be needed for Zone C. The

Contractor shall also remove and dispose of the 10” diameter iron pipe indicated on the drawings. It is the intake for the fire pump house and is approximately 500 feet in length. The pipe may be cut where it comes out of the seawall, then cut in additional lengths as deemed necessary for handling and disposal. The pipe is expected to have minimal sediment cover, maybe zero to a couple of feet.

7. All work required to be completed at the Marine Base area shall be completed by no later than September 14, 2020. This is a required milestone completion date which is before the expiration of the period of performance.

C.19. SUBMITTALS.

At least two (2) weeks prior to mobilization, the Dredging Contractor must submit the following to the Contracting

Officer’s Representative (COR) for approval.

1. List of all plant in accordance with C.6 “Plant”.

2. List of all personnel to be used on site, with their work classifications and assignments.

3. List of all subcontractors, their portion of the project and personnel and equipment lists.

4. Project work plan providing a general summary of how the Dredging Contractor plans to perform the project with dredging procedures, procedures for operation of the spoil/staging area and a general layout and grading plan of the spoil disposal site area.

5. Project specific health and safety plan.

6. Project-specific plan for managing and controlling petroleum product spills on land or in the water.

7. A project schedule showing a time line for execution of the work.

8. Laboratory testing is not specifically required for this project, however, if any is done, the laboratory must have current New York State Department of Health certification.

9. Rip rap source, description and particle size gradation.

It should be noted that the Long Sault Canal is the former name of the Wiley-Dondero Canal and that Robinson Bay Lock and Grass River Lock are the former names of Eisenhower Lock and Snell Lock respectively.

C.21. CHARACTER OF MATERIAL TO BE DREDGED.

In 2019, the SLSDC conducted a project environmental/ geotechnical investigation. The report of this investigation is attached for bidders’ and Contractor’s informational purposes. The complete report is furnished, however, certain appendices (chains of custody, etc.) are omitted in the interests of brevity. The full report with all appendices may be reviewed upon request. Sediment at the Marine Base site consists primarily of Sand-Silt-

Clay mixtures in varying proportions, including Lean Clay (CL), Lean Clay with Sand (CL), Sandy Silty Clay

(CL-ML), Clayey Gravel (GC), Silty Clayey Sand with Gravel (SC), and Silty Clayey Sand with Gravel (SC-

SM). The sediment fines are generally cohesive in nature. The materials encountered generally trend coarser with increasing depth. Next to the Marine Base sheetpiling wall, there is also about 3 feet of rip rap (boulders and cobbles) overlying about 3.5 feet of granular material, which in turn overlies a native stratum of sandy lean clay glacial till. Borings at the Eisenhower Lock spare gate site encountered primarily Sand-Silt-Clay mixtures in varying proportions, including Lean Clay (CL), Lean Clay with Sand (CL), and Silty Sand (SM). Except for B-

1, which encountered a primarily silty sand, the sediment at this site was generally cohesive in nature with an increasing gravel content with depth. Based on the observed resistance of the in-place soils to the sampling equipment, unusual difficulty in excavation to the dredging depths is not expected. See the attached report for more detailed information regarding environmental and geotechnical conditions. The Dredging Contractor could also encounter boulders, logs, snags and other miscellaneous debris which shall also be removed and disposed of at the designated disposal site. Bidders and Contractors are responsible for their interpretation of the subsurface conditions as described in these contract documents or any other SLSDC records and have the option of further investigating the work site and deciding for themselves the character of the materials at his/her own expense.

There is also a 10-inch cast iron pipe to be removed as shown on the drawings.

C.22. MARINE BASE STABILITY BERMS

Upon completion of dredging, stability berms are to be constructed adjacent to the Marine Base sheetpiling wall at locations indicated on the drawings (Zones B and C). The stability berms maintain lateral stability of the sheetpiling wall. Dredging at Zone B will first require removal of the existing rip rap stability berm as shown on the Reference Drawings. This removed rip rap shall be stockpiled for later use in reconstructing the stability berm once the dredging is complete. The rip rap shall be placed adjacent to the sheetpiling wall per the contract drawings to re-create the original stability berm cross-section which will be at a lower elevation due to the dredging. Zone C and possibly Zone B will require new rip rap, which shall consist of 6-to-18-inch crushed quarry stone.

C.23. REPORTING REQUIREMENTS

The Dredging Contractor shall prepare and maintain a daily report of operations and furnish an electronic copy daily thereof to the Contracting Officer’s Representative (COR). The report shall include a list of all major equipment items used, names and classifications of all personnel, a summary of daily activities, locations of areas dredged, estimated quantities of material excavated (estimate by scow or bucket count), estimated quantities of material placed in the disposal site (load count), plant and materials delivered to the work areas, visitors to the dredging and disposal sites, hours worked, weather conditions, turbidity monitoring and any water sampling and testing, and other pertinent information. Results of any sampling and testing performed by the Dredging

Contractor shall also be forwarded to the COR as received by the Dredging Contractor.

C.24. MEASUREMENT AND PAYMENT

1. Dredged material will be measured for intermediate payments using in-place measurement methods. Quantities will be determined using the “average end area” method where cross sectional areas are calculated using electronic computation methods. The total amount of dredged material to be paid for under this contract will be that quantity of dredged material removed from within the pay limits as described herein and disposed of in accordance with these specifications. The dredging soundings shown on the contract drawings show the conditions existing at the time the survey was taken, however they are intended only to provide quantity estimates for bid purposes. A new survey will be done as discussed below to determine the “before” soundings for payment purposes. The “after” dredging minimum pay depth is final dredge depth required as shown on the contract drawings which varies among the locations in this scope. The “after” dredging maximum pay depth is the in-place quantity allowed for dredging over-depth or inaccuracies as described below. It is the responsibility of the Dredging Contractor to compute and verify such limits before the commencement of dredging. Determination of payment quantities will be based on

“before” and “after” dredging surveys conducted by the SLSDC’s Inspection Contractor. The “before” surveys will be conducted before the Dredging Contractor commences dredging and the “after” survey will be conducted as soon as practicable after completion of the dredging at that site, to verify the minimum pay depth and/or the maximum pay depth. The Dredging Contractor may also perform quality control surveys as he/she deems necessary to verify proper dredging depths, but payment will be based on the SLSDC pre-dredge and post-dredge surveys. The

Dredging Contractor shall give at least a two-week advanced notice to the SLSDC as to when an area is ready for a post-dredge survey. The SLSDC will grant one post-dredge survey for each dredging site. If the SLSDC post-dredge survey reveals areas above the dredging depth required, the Dredging Contractor shall be responsible for the costs associated with any subsequent post-dredge survey(s), to be completed by SLSDC’s Inspection Contractor, to verify complete removal of dredged material after the Dredging Contractor has re-attempted to achieve the dredging depth required. The Dredging Contractor, at his/her discretion may attend any SLSDC surveys he/she so chooses.

2. During dredging operations, the side slopes at the in-water boundaries of the specific areas to be dredged shall be maintained as indicated on the drawings or if not so indicated, shall not be flatter than a ratio of 1 vertical to 2 horizontal to maintain continuity of side slopes between dredging areas and areas not requiring dredging. The Dredging Contractor shall not dredge outside the designated limits nor on the side slopes adjacent to the dredging areas except to remove material that is within the minimum to maximum pay depth limits.

3. To cover inaccuracies of the dredging operation, material removed from within the specific scope of work areas to be dredged between the minimum pay depth, and a depth of one foot below these limits; which is defined as the maximum pay depth, will be computed and paid for at the contact price. Materials dredged from beyond the specific area depth limits as described above will be deducted from the total amount of dredging as excessive over-depth dredging or excessive side slope dredging and will not be paid for.

4. Payment will be made at the unit price for dredging, which price shall include all costs for labor and equipment for dredging, transporting and disposal of material specified herein and as shown on the contract drawings.

5. For the Marine Base Zone B stability berm, payment will be made in accordance with the lump sum (LS) unit price, which includes in-situ rip rap that is re-used. For additional rip rap needed in Zone B, and for rip rap used in Zone C, payment will be made by the ton for the placed material. Count shall be made by truck load delivery tickets.

6. The Dredging Contractor shall take care to not alter the navigational channel depth in any way, such as filling in material and reducing available draft within the channel. The Dredging Contractor shall immediately notify the COTR if he/she does and take prompt action to restore the navigational channel to previous, or improved condition at his/her own expense.

C.25. LAYOUT OF WORK

1. It shall be the responsibility of the Dredging Contractor to ensure accurate vertical and horizontal control measurements for all phases of the dredging program, including topographic surveying of the spoil area.

2. A list of existing bench marks that may be used by the Dredging Contractor is included with this document.

The Dredging Contractor may use satellite based Global Positioning System (GPS) methods with the benchmarks and other land-based control points identified and located by the Contractor.

3. The Dredging Contractor shall layout the work from the horizontal and vertical control provided and shall be responsible for all related measurements. The Dredging Contractor shall furnish at his/her own expense all stakes, templates, platforms, range markers, survey equipment and labor as may be required in laying out any part of the work from the survey control provided. The Dredging Contractor will be held responsible for the execution of the work to such lines and grades as may be established or indicated by the COTR. It shall be the responsibility of the Dredging Contractor to maintain and preserve all stakes, ranges and other marks established throughout the project. It shall be the responsibility of the Dredging

Contractor to remove any temporary stakes after project completion.

C.26. DISPOSAL OF DREDGED MATERIAL & SPOIL DISPOSAL SITE MANAGEMENT

1. The material dredged shall be placed in the designated spoil area located north of the upstream guide wall at Snell Lock as shown on the Contract Drawings. The Contractor shall not place dredged materials into the spoil area prior to receiving the SWPPP. Rip-rap removed from adjacent to the sheetpiling wall prior to dredging there shall be temporarily stockpiled nearby for re-use in the Zone B re-constructed stability berm per paragraph C.22. The rip-rap stockpile shall be located as designated by the COTR.

2. The dredged material shall be moved to the disposal area by methods that will prevent the loss of any water or material. The Dredging Contractor will not be permitted to deposit any dredged material in the waterway for rehandling into the spoil area or any other purpose. If the dredged material is transferred from scows to the disposal area by bucket-type equipment, provisions shall be made underneath the transfer equipment to catch drippings of water and dredged material and prevent release of such water and materials outside of the disposal area.

3. The mooring area at the end of the upstream guide wall at Snell Lock is available for use by the Dredging

Contractor provided all equipment can be moored well outside the navigation channel. No equipment is to be stationed/moored in the navigation channel.

4. The Dredging Contractor shall perform any development work at the site as necessary at his/her own expense to render the area functional for his/her purpose, shall maintain the dock and access roads in good condition, and upon completion of work, perform any required clean-up and restoration work to the satisfaction of the COR.

5. The methods, equipment and layout of operations for transporting the dredged material and sequence of placement in the disposal area shall be submitted to and approved by the COR. Materials deposited in the disposal area shall be maintained at or below elevation 204.00 feet (IGLD 85 datum).

6. If the Dredging Contractor elects to use trucks and /or earth moving equipment to handle spoil material it shall be the Dredging Contractor’s responsibility to obtain all necessary permits and licenses.

7. The Dredging Contractor shall perform all topographic surveying and field investigations necessary to plan disposal and placement of the dredged material. The Dredging Contractor shall prevent runoff from the disposed material to the waterway and shall perform any site work necessary to suit the above purposes. The operation of material disposal shall be conducted in a manner that will prevent visible suspended solids discharging into the waterway from any drainage or seepage that may unavoidably leave the area. If visual examination indicates that the suspended solids concentration exceeds the visible limit, use of the disposal area must be stopped immediately and measures taken to reduce the suspended solids concentration in released waters to acceptable limits. Use of the disposal area shall not resume until the

Dredging Contractor demonstrates to the satisfaction of the COR that the operations have been modified such that discharged waters contain acceptable levels of suspended solids.

8. All expenses incurred in developing the disposal area, all materials deposited thereof and all operations in connection therewith shall be borne by the Dredging Contractor and therefore are to be included in provide pricing.

9. Sunken logs, snags, stumps, and other miscellaneous organic debris shall be disposed of in the same approved upland disposal area as the other dredged spoil. Any non-organic items shall be disposed of off-site as appropriate to the type of material. i.e. scrap metal, etc. This does not apply to rocks, which shall be disposed as dredge spoil.

10. Experience has shown that deposited spoil will naturally develop a satisfactory vegetation cover, thus the

Dredging Contractor is not required to provide a vegetation cover. However, the Dredging Contractor shall grade the deposited spoil to minimize erosion and runoff.
