Section A - Solicitation/Contract Form
EXECUTIVE SUMMARY
A.1 Objective -The objective of this contract is to procure services from a contractor to perform International
Remediation and Environmental Services. Contractors will perform Military Munitions Response (MMR) services involving Munitions and Explosives of Concern (MEC), Material Potentially Presenting an Explosive Hazard (MPPEH), Chemical Warfare Material (CWM), and Biological Warfare Material (BWM); Environmental Compliance and Remediation Services (ECRS) involving primarily Hazardous, Toxic and Radioactive Waste (HTRW) including Biological Waste and Munitions Constituents (MC), and Other Munitions Related Services (OMRS) as necessary to permit lands and waters to be safely and efficiently used for their intended purpose.
A.2 Contract Type. The U.S. Army Engineering and Support Center, Huntsville (CEHNC) intends to award Multiple Indefinite Delivery/Indefinite Quantity (ID/IQ) type contracts to both large and small businesses.
The Government intends to award a contract or contracts resulting from this solicitation to all qualifying offerors as stated in FAR 15.304(c)(1)(ii). This requirement will be competed on an unrestricted basis and will result in Multiple Award Task Order Contract (MATOCs). The total programmatic capacity for the MATOC is $750 Million for services. Individual capacities will not be assigned to each contract. Under this MATOC, task orders will be awarded as Firm Fixed Price (FFP) and Cost- Plus Fixed Fee (CPFF).
A.3 Contract Term. This MATOC will have a base ordering period of thirty-six (36) months with two (2) 12-month option periods. There is no guarantee that the option will be exercised on the awarded contract. The period of performance shall be set at the time of award. The Government may extend the ordering period in accordance with terms in FAR 52.217-8, Option to Extend Services. The evaluated rates in effect during the last exercised option period will remain in effect during any extensions executed under the stated clauses; not to exceed six months. Pricing for FAR 52.217-8 will be evaluated at the Task Order Level.
The Government may extend the term of the contract in accordance with FAR 52.217-9, Option to Extend the Term of the Contract. The Government reserves the right to make staggered awards. Later awarded contracts will have an initial period of performance that will be less than the full 36-month base period in duration and will end on the same date as all other contractors which receive a basic MATOC award.
Option periods will be the same for all awardees. If determined to be in the Government’s interest to hold discussions, discussions may be held with offerors remaining in the competitive range after initial awards have been made to some offerors.
A.4 Contract Ordering. Task orders will be awarded against the base MATOC/IDIQ contracts using the fair opportunity procedures pursuant to FAR PART 16.5 and in accordance with the instructions listed in Section H.3, Method of Ordering. The Government is under no obligation to issue any orders against this contract in excess of the minimum contract obligation of $3,000.00. The only authorized ordering office is the U.S. Army Engineering and Support Center, Huntsville, Alabama. Other agencies may be delegated this authority, in which case, an advance written notice will be given to the contractor. In addition to, or in lieu of mailing an order, the Contracting Officer may issue an order orally, by facsimile or by electronic commerce methods, at his / her discretion.
A.5 Contract Capacity. The estimated maximum contract capacity is $750,000,000.00 over a period of five years (if all options are exercised) for this acquisition. The Contracting Officer will ensure cost/price is evaluated at the task order level. Values provided under the Contract Line Item Numbers represent the estimated capacity only and the Government reserves the right to move capacity between CLINs and performance periods as necessary.
A.6 Minimum Guarantee. The government’s minimum guarantee of $3000.00 extends throughout the period of performance of the Indefinite Delivery Contract. Funding for this minimum guarantee will be obligated on the first task order, issued at the time of base contract award. This is the minimum ordering amount; not a minimum payment. Payment under the subsequent task order award(s) in an amount meeting/exceeding the minimum guarantee satisfies the minimum guarantee. The initial task order may then be deobligated and closed.
A.7 Contract On-Ramps/Off-Ramps. In an effort to increase competition, the CEHNC Contracting Officer may evaluate the market every 12 - 18 months throughout the life of the MATOC to determine if it is in the Government’s best interest to open a contract “On-Ramp.” Whereas, “Off-Ramp” are considered at the exercise of an option year. During a contract “On-Ramp” the Government will accept and evaluate new proposals with the intention of adding additional contractors to the MATOC pool, to refresh the pool’s competition. These proposals shall be subject to the same proposal instructions and evaluation procedures as contained in the original solicitation. During a contract “Off-Ramp”, the Contracting Officer may not exercise an option. The file should be documented to show the Contracting Officer decision not to exercise an option. Alternatively, Contractors can request to be placed in a dormant status if they are knowingly unable to propose for a period of time. A contractor who is in dormant status cannot be “Off-Ramped”.
Dormant Status. Due to extenuating circumstances (not related to performance), contractors that do not propose can request to be placed in a dormant status. Contractors in dormant status cannot compete in new task order solicitations; however, they may continue to work on awarded task orders. Dormant status is granted for a defined finite time period, at the expiration of the time the contractor will be expected to compete on task orders. The Contracting Officer is the approving authority for dormant status.
Competition for inclusion in the MATOC pool will be sought, promoted, and sustained by querying the System of Award Management (SAM), synopsizing proposed actions, and posting the solicitation in the Government-wide point of entry website (https://beta.sam.gov/).
Only a warranted Contracting Officer acting within their delegated limits, has the authority to issue modifications or otherwise change the terms and conditions of this contract. If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract you shall not proceed with the change and shall immediately notify the Contracting Officer.

INTERNATIONAL REMEDIATION AND ENVIRONMENTAL SERVICES 2

1.0 OBJECTIVE.
1.1 The objective of this Multiple Award Task Order Contract (MATOC) is for Contractors to perform Military Munitions Response (MMR) services involving Munitions and Explosives of Concern (MEC), Material Potentially Presenting an Explosive Hazard (MPPEH), Chemical Warfare Materiel (CWM), and Biological Warfare Materiel (BWM); Environmental Compliance and Remediation Services (ECRS) involving primarily Hazardous, Toxic and Radioactive Waste (HTRW) including Biological Waste and Munitions Constituents (MC); and Other Munitions- Related Services (OMRS) as necessary to permit lands and waters to be safely and efficiently used for their intended purpose.
1.2 This work may occur at sites located Outside Continental United States (OCONUS), i.e., outside the United States and Outlying Areas as defined by FAR 2.101 primarily at international locations to include, but not limited to Afghanistan, Iraq, Japan, Jordan, Kuwait, Lebanon, Poland, South Korea and Ukraine. Work may involve International Operations (IOP) supporting US Army missions in Afghanistan and other OCONUS locations. The services provided under this contract will be used in support of various Department of Defense Commands and Installations, other federal agencies, or foreign governments/agencies where sponsored by an appropriate U.S.
Government agency.
1.3 The Contractor will provide services to safely locate, identify, recover, evaluate, manage, and make final disposition of MEC (including MC), CWM, Depleted Uranium (DU), and BWM under MMR; safely locate, identify, recover, evaluate, manage, and make final disposition of HTRW including Biological Waste; implement and conduct ECRS involving primarily HTRW and MC; provide OMRS involving military munitions not accounted for under MMR (e.g., anomaly avoidance, construction support, etc.); reduce munitions stockpiles wherever they exist to include foreign jurisdictions at locations specified by Paragraph 1.2, herein, as required by task orders. Work may involve the Contractor providing range MEC and MPPEH clearances, post-battlefield MEC and MPPEH clearances, demining operations, booby trap clearance in non-combat situations, anomaly avoidance, construction support and non-DoD ammunition depot management. With the exception of CWM, the Contractor may be required to assess, package, transport, manage and make final disposition of the above mentioned materials. Work performed under this contract may include: project planning; assessments; inspections; surveys;
investigations; studies; engineering evaluations; cost analyses; remedial or removal actions; spill response;
sampling and analysis; engineering containment; recovery; storage; treatment; transportation; and disposal of MEC (including MC), HTRW, and BWM. Work may include: monitoring; data management; training; permitting;
public involvement; and logistical, medical, and security support. Work efforts may require use of robotic technology where feasible and practicable.
1.4 Specific services and task activities are listed in Paragraph 3 and subparagraphs, herein. The listed descriptions of services to be provided and task activities to be performed portray a general understanding of various functions to be performed by the Contractor via task orders which will contain specific performance-based requirements.
2.0 GENERAL.
2.1 The Contractor shall perform MMR services which generally include response actions which may include investigations, environmental footprint reduction, removal actions and/or remedial actions to address the explosives safety, human health, or environmental risks or hazards presented by MEC, CWM, and BWM, primarily associated with military actions and training. The Contractor shall perform Environmental Compliance and Remediation Services to protect human health and the environment from risks primarily associated with HTRW and MC. Additionally, the Contractor shall perform OMRS which pertains to work involving military munitions not accounted for under MMR such as anomaly avoidance, on-call construction support, vegetation removal in a MEC contaminated area, etc.
2.2 Overseas Response. To facilitate potential expedited responses the Contractor shall maintain current passports for the following personnel: site supervisory and management personnel, Unexploded Ordnance (UXO) personnel, environmental personnel, and geophysical personnel.
2.2.1 Technical specialists based on project requirements may include but are not limited to: chemists, health physicists, risk assessors, engineers, biologists, hazardous waste coordinator, transportation and disposal coordinator, geologist/hydrogeologist, etc.
2.2.2 The Contractor must comply with applicable entry and exit requirements of the country where the work will be performed to include work visa, medical screening, and other specific OCONUS requirements (see Section 2.4 and subsections below). The Contracting Officer may identify additional requirements for overseas travel on a site-specific basis.
2.3 Permits and Licenses. The Contractor shall obtain the permits and licenses necessary to conduct work required by this contract. The Contractor shall comply with all applicable in country laws and regulations. Task orders will have the specific standards applicable.
2.4 Applicable Laws and Regulations. The Contractor shall perform this work in accordance with all applicable laws and regulations including in-country laws and regulations. The Contractor shall be responsible for acquiring the latest version of applicable regulatory or agency guidance including those referenced herein, and those included in task orders.
2.4.1 Work performed by the Contractor may be subject to other requirements or restrictions such as those issued by a U.S. Department of Defense theater-level Unified Combatant Commander (COCOM), e.g., CENTCOM Clauses, which are provided under this contract with revisions provided under separate task orders, as applicable.
2.4.2 Entry and exit requirements to countries within the CENTCOM AOR, including Iraq and Afghanistan, are contained within CENTCOM Clauses, specifically, 252.225-79995 Contractor Personnel performing in the United States Central Command Area of Responsibility. 2.4.3 Pre-deployment training requirements for Contractor personnel deploying to Iraq and Afghanistan (and other countries as applicable) can be found at: https://www.bliss.army.mil/crc/contractors.html.
2.4.4 Access to bases and installations within Iraq and Afghanistan (and other countries as applicable) will be subject to varying operational, security, and force protection conditions. The Contractor shall coordinate with the CENTCOM (or other COCOM as applicable) LNO for the current status of such conditions for the bases and installations of interest. Granting access to bases and installations within Iraq and Afghanistan may take up to 30 calendar days following request or notification of intent to enter.
2.4.5 Antiterrorism/Operational Security. The Contactor will be required to fill out an Antiterrorism (AT)/Operational Security (OPSEC) review cover sheet which will document Contractor review of: (1) PWS language pertaining to OPSEC, information assurance (IA), physical security, law enforcement, and foreign disclosure, and (2) Additional PWS language relating to the above provided by the review cover sheet.
2.5 Defense Base Act (DBA) Insurance shall be required for OCONUS work for US citizens and nationals, including short-term travel in country. LNs and TCNs must also be covered by DBA unless there is a waiver from the Department of Labor (DoL).The Continental Insurance Company (CNA) single-provider, DBA requirements contract, that supported the United States Corps of Engineers (USACE), the U.S. Central Command Joint Theater Support Contracting Command (C-JTSCC), and the 408th Contracting Command, expired on 30 September 2013. No additional options or extensions are available. USACE did not replace its requirement contract. Therefore, the Contractors shall obtain DBA insurance from either a DoL authorized insurance carrier or utilize a self-insurance program to conduct OCONUS work unless subject to a waiver. The DoL has approved multiple insurance carriers which promote a competitive market environment. The DoL approved carriers and self-insured employers are available at http://www.dol.gov/owcp/dlhwc/lscarrier.htm.
2.6 Publications and References. All work under this contract shall be in accordance with the applicable publications referenced herein and those included in task orders.
2.7 Data Ownership and Data Rights. All reports, data, technical information, designs, including electronic data and software, generated under this contract will have unrestricted use by the Government. For task orders the Contractor will be required to specifically identify in accordance with (IAW) DFARS 252.227-7017 to the extent known all technical data or software that will be generated or delivered with restrictions on its use, release, or disclosure. Proprietary restrictions placed on deliverables, information, data, designs, or drawings after award of task order shall not be binding unless addressed in writing in the proposal and accepted by the Government.
2.8 Safety and Health Program. The Contractor shall develop and implement a written Safety and Health Program IAW guidelines specified in EM 385-1-1 and EM 385-1-97. The Contractor shall develop Accident Prevention Plans (APP) for task order work in accordance with EM 200-1-15 Section 4.5. The Contractor shall ensure that its subcontractors, suppliers, and support personnel follow all safety and health provisions established in the CEHNC-accepted Accident Prevention Plan (APP) for the site. A Site Safety and Health Plan (SSHP) shall be included in the APP. No work shall be undertaken at a project site by a Contractor without an CEHNC-accepted APP/SSHP. The Government reserves the right to stop work under this contract for any violations at no additional cost to the Government. The Government will verify that the Contractor has implemented corrective action before allowing continued performance under the contract.
2.8.1 Medical Surveillance. All personnel performing onsite activities shall participate in an ongoing medical surveillance program minimally meeting the requirements of 29 CFR 1910.120 for general industry work and 29 CFR 1926.65 for construction industry work. More stringent surveillance requirements may be required while conducting work at certain location as required by task order.
2.8.2 Personal Protective Equipment. The Contractor shall have a written Personal Protective Equipment (PPE) program (including respiratory protection) minimally conforming to the requirements of EM 385-1-1 and EM 385-1-97. More stringent PPE requirements may be required while conducting work at certain location as required by task order.
2.9 Munitions with Unknown Liquid Filler. During conventional munitions or other munitions related operations, if the Contractor identifies or suspects an unknown liquid filled munition, the Contractor shall immediately withdraw upwind from the work area and contact the responsible Contracting Officer and the appropriate point of contact in their Work Plan or UFP-QAPP. The Contractor shall secure the area and provide two personnel located upwind of the suspect unknown liquid filled munition to secure the site until relieved by the Department of the Army emergency response personnel. Additional support may be required by the emergency response personnel, e.g., construction of blast mitigation controls. Additional reporting instructions are contained in the Interim Guidance Chemical Warfare Materiel Responses and Related Activities, dated 1 April 2009.
2.10 Improved Conventional Munitions. (ICM). Prior to entering areas/ranges contaminated with non-practice Improved Conventional Munitions (ICMs) or submunitions a Deviation Approval and Risk Acceptance Document (DARAD) prepared in accordance with DA Pam 385-30 as determined at the task order level must have been prepared and approved by the affected installation. If an ICM or submunition which cannot be confirmed to be practice is found at a site not previously known to contain ICMs or submunitions, work shall cease, the Contractor shall evacuate the affected area, and the Contractor shall contact the responsible Contracting Officer and the appropriate point of contact in their Work Plan or UFP-QAPP for direction.
2.11 HTRW Encounter During MMR/OMRS. While conducting MMR or OMRS the Contractor may encounter HTRW material containers, landfills, Open Burning/Open Detonation (OB/OD) areas, ground spills, contaminated surface water, or contaminated groundwater. If suspected HTRW of unknown origin and nature is encountered, the Contractor shall immediately stop work in the affected area, and notify the responsible Contracting Officer and the appropriate point of contact in their Work Plan or UFP-QAPP for direction.
2.12 HTRW. In the absence of other requirements work performed at HTRW locations may generally follow the RCRA Corrective Action process for U.S. installations or applicable host nation requirements depending on the location. If HTRW disposal is required under a task order, the Contractor shall ensure that all hazardous waste is properly transported to and disposed of at a permitted Treatment Storage and Disposal Facility (TSDF) or international equivalent in compliance with all applicable regulations and requirements, unless specified otherwise by the task order PWS. Specific manifesting and associated signature requirements will be as specified by the task order PWS.
2.13 Laboratory Capabilities.
2.13.1 Laboratories must demonstrate compliance with the DoD Quality Systems Manual (DoD QSM) (latest version in affect when sampling begins) through accreditation by the DoD Environmental Laboratory Accreditation Program (DoD ELAP) for all project-required parameters. A list of laboratories accredited under DoD ELAP can be found at the DoD ELAP Denix web site at http://www.denix.osd.mil/edqw/Accreditation/AccreditedLabs.cfm. The laboratory used shall have experience handling media potentially contaminated with munitions constituents and shall be identified early in the project planning (at the proposal stage). For additional details on laboratory requirements, see DID HNC-005.03 and EM 200-1-15.
2.13.2 Any laboratory performing chemical analysis must provide its DoD ELAP accreditation certificate and supporting documentation to the applicable Military Munitions Design Center (MM DC) in order to be approved by that MM DC. If the laboratory fails to meet project-specific requirements, the Contracting Officer may require the Contractor to stop using this laboratory and obtain analytical services from another qualified laboratory that can meet project-specific requirements. The contract laboratory may not subcontract analytical services to another laboratory without the approval of the Contracting Officer. The subcontracted laboratory must meet all requirements for the contract laboratory.
2.13.3 Geotechnical Testing Laboratories. Geotechnical testing shall be conducted in accordance with the requirements of ER 1110-1-8157, Geotechnical Data Quality Management for Hazardous Waste Remedial Activities, to include laboratory requirements specified in ASTM D-3740. The laboratory shall have experience performing physical testing of materials potentially contaminated with HTRW or MC. The types of laboratory services anticipated under this contract include, but are not limited to, mechanical analysis (sieve analysis), hydrometer analysis, Atterberg Limits, soils classifications, permeability, standard and modified proctor tests and relative density tests.
2.13.4 The Contractor will be required to identify the primary laboratory and secondary laboratory(ies) to be used for geotechnical laboratories and laboratories performing chemical analysis under task order proposals.
2.14 Performance-Based Milestones/Objectives: The Government defines Performance Based Milestones/Objectives as the desired outcome(s) that have been defined in the Performance Work Statement in clear, simple, concise, results-oriented, measurable and legally enforceable terms. The Government defines the completion of a Performance Based Milestone/Objective as: an outcome that has been completed and approved and accepted by the Government. Simply meeting the Milestone/Objective, (i.e., submittal of a document for review) is not the same as completion of the Milestone/Objective. Only upon the completion and approval and acceptance by the Government will the Government pay for that Milestone/Objective.
2.15 A Performance Work Statement (PWS) for a task order will to every extent possible:
- Define desired results/outcomes.
- Define what level of performance is expected and use performance standards and Quality Assurance
Surveillance Plans (QASP). A QASP template is provided in EXHIBIT 3.
- Provide all information known about the site(s), or where it can be located and accessed by the Contractor.
- Define incentives and disincentives.
- Define requirements using clear and concise language avoiding vague or broad statements.
3.0 SPECIFIC SERVICES.
3.1 Task Orders. Task Orders issued under this Contract may be Firm-Fixed Price and/or Cost-Reimbursable depending on the type of work being performed in each individual task order. For each task order under this contract, the Government will provide a specific PWS describing, at a minimum, the work required to be performed, performance metrics, schedule requirements, and types and numbers of submittals. The Contractor shall, upon award of a task order, supply all personnel, tools, equipment, communications, transportation, materials and supervision to integrate, manage, and execute all specified aspects of the task order. If GFP/GFE is to be provided to the Contractor under a task order the Contractor will be required to develop and submit a Property Control Plan for Contracting Officer approval, and the property shall be accounted for in accordance with the plan. If property is acquired by the Contractor under a Cost-Reimbursable task/task order in the performance of the work, the Contractor acquired property (CAP) will also be accounted for in the same manner.
3.2 Site Visit.
3.2.1 Pre-proposal. A site visit may be authorized by the Contracting Officer to assist in the preparation of the Contractor’s proposal. Cost for this site visit will be at the Contractor’s own expense. The Government strongly encourages, but does not require, the Contractor to prepare an Abbreviated Accident Prevention Plan (AAPP) to ensure extra safety precautions are taken to avoid an accident. No intrusive activities shall be conducted during the site visit and site access restrictions may apply.
3.2.2 Post Task Order award. A site visit may be authorized by the Contracting Officer to assist in the preparation of the initial Work Plan or Uniform Federal Policy for Quality Assurance Project Plan (UFP-QAPP) for field activities as required by the task order PWS. Contractor incurred cost for this site visit will be covered under the task order. The Contractor shall prepare an Abbreviated Accident Prevention Plan (AAPP) and submit it to the responsible Contracting Officer for acceptance before conducting the site visit. The format of the AAPP shall comply with current USACE guidance. The Contractor will not be permitted to conduct any intrusive activities during the site visit.
3.3 Work Plan/UFP-QAPP. The Contractor shall prepare and submit, for Contracting Officer acceptance, either a Work Plan or a UFP-QAPP as required by the task order PWS describing how the required effort will be accomplished. Work Plans shall be prepared in accordance DID HNC-001.03, DID HNC-002.02, DID HNC- 013.02, EM 200-1-15, and other guidance as specified by the task order PWS. When required, a UFP-QAPP shall be prepared and submitted in accordance with EM 385-1-1, EM 385-1-97, EM 200-1-15, and other guidance specified by the task order PWS. Additionally, work for International Operations (IOP) projects may require a Mobilization/Demobilization Plan and/or a Physical Security Plan as specified in the task order PWS. The Contractor may not mobilize to the site or begin working until the Contracting Officer has accepted the Mobilization/Demobilization Plan ,Work Plan or UFP-QAPP, as applicable and issued a Notice to Proceed (NTP).
When applicable, MEC-related operations may not begin until applicable explosives safety plans (i.e., Explosive Safety Submission (ESS), Explosive Siting Plan (ESP), Chemical Safety Submission (CSS), Chemical Siting Plan (CSP), Interim Holding Facility Siting Plan (IHFSP) have been approved.
3.4 Task Activities. Typical activities under task orders to this contract may include, but may not be limited to:
3.4.1 Administrative and Permanent Record Files. Establish and maintain Administrative and Permanent Record files for projects in formats required in the project task order.
3.4.2 Air Monitoring. Conduct on-site work area and site perimeter air monitoring for protecting workers, visitors, the public, and the environment.
3.4.3 Anomaly Avoidance. Provide support to field operations as necessary to avoid buried anomalies and surface munitions.
3.4.4 Anomaly Investigation. Excavate and evaluate target anomalies to determine their identity, size, composition, depth, location and condition.
3.4.5 Blast-Effects Engineering Analysis. Perform complex engineering analyses of the effects of the overpressure, heat, fragmentation, and related factors resulting from detonations and effective mitigation measures.
3.4.6 Chemical Sampling and Analysis. Perform chemical sampling and analyses (both on-site and off-site) for MC, CWM, HTRW, BWM, and other target compound list chemicals as required.
3.4.7 Conduct hazardous building materials surveys.
