About this file
This is a Draft Purchase Order issued by the County of Sacramento for the procurement of one new diesel-powered, two-axle dump truck. The vehicle specification requires a 2026 or current model year unit with a gross vehicle weight rating of thirty-three thousand (33,000) pounds and a five (5)-cubic yard capacity, fully equipped and meeting all requirements outlined in Specification 171-455 and Request for Bid 2026-RFB-0082. The goods are to be delivered in accordance with FOB delivery terms and delivery dates agreed upon between the contractor and the County requestor. The purchase order references the contractor's bid response, opened on an unspecified date in 2026, and incorporates by reference the RFB and the contractor's bid response as binding contract documents.
The purchase order establishes standard contract terms including a thirty-day termination without cause provision and termination for cause after thirty days' written notice and opportunity to cure. The contractor must maintain comprehensive insurance coverage as specified in Appendix G and provide indemnification to the County. The contractor is required to comply with California Air Resources Board regulations, including the Advanced Clean Fleets regulations for vehicles with a gross vehicle weight exceeding 8,500 pounds. Additional compliance obligations include SB 1383 recycled-content and organic waste reporting requirements, Sacramento County Employees' Retirement System reporting on a bi-annual basis, and adherence to California Executive Order N-6-22 regarding economic sanctions. The document does not specify pricing, contract value, or funding sources.

3. REMEDIES
In the event of a material breach of this Contract by CONTRACTOR, COUNTY may avail itself of any and all remedies available at law or in equity, including, but not limited to, damages and/or equitable relief, in a court of competent jurisdiction.
4. TERMINATION
4.1 COUNTY may terminate this Contract without cause upon thirty (30) days written notice to the other party. Notice shall be deemed served on the date of mailing. If notice of termination for cause is given by COUNTY to CONTRACTOR and it is later determined that CONTRACTOR was not in default or the default was excusable, then the notice of termination shall be deemed to have been given without cause pursuant to this paragraph (1).
4.2 County may terminate this Contract for cause after giving CONTRACTOR written notice of material breach of this Contract and thirty (30) days to cure in the manner specified.
In the event of such termination, COUNTY may proceed with the work in any manner deemed proper by COUNTY.
