About this file
This is a Documented Quote issued by the State of Colorado Department of Human Services for the procurement of an Automated Toxicology Analyzer. The Department seeks quotes for a five-year lease with annual renewal options and reagent pricing, with a requirement for no price increases guaranteed throughout the entire five-year period. The analyzer must utilize automated biochip array technology with chemiluminescent immunoassays capable of detecting multiple drug classes and metabolites from a single specimen. The preferred test menu includes over 40 analytes ranging from common drugs of abuse (amphetamines, cannabinoids, opiates) to prescription medications and adulterants. The equipment must be fully self-contained with specified maximum dimensions (90 inches width, 45 inches depth, 60 inches height), include a PC-based data management system with LIMS interface, and handle multiple specimen types including serum, urine, oral fluids, and hair. Based on workload statistics from February 2014 through January 2015, the anticipated volume includes 4,378 patient urine drug screens, 237 urine ETG tests, 100 K2/spice tests, 184 hair drug screens, and 50 hair ETG tests, with additional desired testing panels for various prescription medications. The quote deadline was April 8, 2015 at 10:30 a.m., with the contract term running from July 1, 2015 through June 30, 2016, renewable for four additional one-year periods.
All pricing must be quoted FOB Destination and Installation with cost submitted on a per-reportable basis. All equipment must be new with manufacturer warranties included. Vendors must provide a Uninterruptible Power Supply (UPS) capable of maintaining eight minutes of operation during power outages, comprehensive training for at least one operator at the manufacturer's facility, complete in-house setup with linearity and precision studies, and business hours service (Monday–Friday, 8:00 a.m.–5:00 p.m.) with eight-hour or next-day onsite service availability. Service must include all parts, labor, and travel expenses with a minimum of one preventive maintenance visit annually. Payment terms must exceed 45 calendar days. The State intends to make a single vendor award based on the most beneficial offer, considering not only unit price but also administrative costs, delivery conditions, and proximity to user sites. Funding is contingent upon legislative appropriation with the State providing 45 days' written notice should funds not be allocated. Evaluation will prioritize registered Vendor Self Service (VSS) vendors, with non-registered vendor quotes considered only if inadequate competition exists among registered vendors.

Vendors are responsible for ensuring and confirming that FAX or Electronically submitted Quotes are received by the submission time and due date. The State is not responsible for Quotes not received due to FAX malfunctions or failure of electronic submissions.
Pricing: All pricing shall be FOB Destination. Vendors shall specify any minimums, special charges, restrictions, or conditions. The failure of the vendor to note any special conditions or exceptions shall be deemed a waiver of any such condition or exception.
Quote Evaluation. The State will be the sole judge in determining the acceptability of an offer and in determining the most beneficial offer(s) for the State. Documented Quote evaluation will consist primarily of comparing unit price quoted for the listed items.
Evaluation of Documented Quote will also take into account administrative costs, payment terms, delivery conditions (any restrictions, minimum order quantity or dollar amount), and any exceptions taken to any requirement of the Quote, volumes at individual user sites, and proximity of user sites. Administrative costs include, but are not limited to, time and costs associated with ordering, receiving, stocking and paying invoices. Colorado Procurement Rule R24-103-204-03, which states; “may determine whether or not a response is acceptable and may compare the relative value of competing responses, not solely the price.”
The State may make such investigations as may be deemed necessary to determine that the Vendor possesses or can acquire: (1) sufficient financial ability; (2) the services of properly qualified personnel; (3) the equipment, facilities and capacity necessary for adequate performance; and (4) has an overall satisfactory record in the performance of prior contracts which the Vendor may have been awarded.
Award: The state intends to issue a single vendor award. Awards will be made on the basis of the Quote most beneficial to the State.
Vendor shall extend contract pricing to other Human Services divisions if the vendor has a presence in that area (i.e. Pueblo, Grand
Junction).
Term of Award: The period of award made as a result of this Quote is one year from date July1, 2015 to June 30, 2016 and maybe renewed for four (4) additional one (1) year period.
Quote Review. After the award is made, any vendor that wishes to recap the Quote may do so at the Department of Human Services.
Bid Tabulation Available by Request.
Performance/Remedies: Awarded vendors shall comply with the requirements as to brand, quality, quantity, time frames, container size, etc. If the awarded vendor fails to perform, the State reserves the right to take remedial action (upon written notice), including canceling the original award, in whole or in part, for cause, and making an award to the next in line responsive and responsible vendor. Cause is defined as failure to meet requirements of the within specifications and conditions, or failure to correct deficiencies upon receipt of notice. Failure to maintain satisfactory performance after notice will be sufficient cause for immediate cancellation of the award.
Quantity of Goods/Services: The State may increase or decrease the quantity of goods/services based on the rates established in the
Purchase Order or associated Statement of Work or Service Agreement when mandated in the sole discretion of the State by changes in mission or programmatic level of goods/services requirements.
FISCAL FUNDING. (A) As prescribed by State of Colorado Fiscal Rules and §23(B) below, this Lease is dependent upon the continuing availability of funds beyond the term of the State's current fiscal period ending upon the next succeeding June 30, as financial obligations of the State of Colorado payable after the current fiscal year are contingent upon funds for that purpose being appropriated, budgeted, and otherwise made available. While the act of appropriation is a legislative act, Tenant will take appropriate actions under the laws applicable to Tenant to timely and properly budget for, request of and seek and pursue appropriation of funds from the General Assembly of the State of Colorado permitting Tenant to make payments required hereunder during the period to which such appropriation applies. If funds are not appropriated, this Lease shall terminate at the end of the then current fiscal year, with no penalty or additional cost to Tenant. Tenant shall notify Vendor of such non-allocation of funds by sending written notice forty-five (45) days prior to the effective date of termination.
Because of Limited competition expected from registered Vendor Self Service (VSS) and additional methods of vendor notification and may make the specifications available to non-registered vendors through additional means. However, quotes, bids or offers submitted by nonregistered vendors will not be opened or considered (except as necessary to determine VSS registration status) unless, after examination of quotes/bids/offers submitted by VSS registered vendors, it is determined that there is not adequate competition among VSS registered vendors. If adequate competition exists among registered vendors, quotes, bids, or proposals from non-registered vendors will not be considered.
