SCOPE OF WORK

Background

Green Mountain Reservoir in the White River National Forest is managed by the U.S.

Forest Service (USFS). The Colorado Division of Parks and Wildlife, (CPW), entered into a partnership with the USFS to implement watercraft inspection and decontamination stations to protect these reservoirs from possible introduction of zebra mussels, quagga mussels, or other ANS.

The stations were operated by the former Colorado Division of Wildlife (DOW) previously, and it is now their intent to have them operated by a private contractor.

CPW is the sole party to this agreement with the Contractor. The contractor(s) will be trained and certified by CPW and will be provided with the necessary authorizations to operate at these reservoirs.

Site Specific Tasks

Staffing and Certification:

Hours of operation for Heeney Marina, McDonald Flats, and Big Green Boat Ramps will be (pending water levels):

Heeney Marina May 22, 2015 – September 30, 2015 7:00 am – 7:00 pm 7 days a week

McDonald Flats June 16, 2015 – September 30, 2015 7:00 am – 7:00 pm 7 days a week

Big Green (Only open when launching at McDonald Flats not available) May 22, 2015 – September 30, 2015

7:00 am – 7:00 pm 7 days a week

Opening and closing dates are pending weather, ice conditions and available funding.

Daily hours of operation will not change during the season. All supervisors and inspectors will be certified to conduct the proper inspections and decontaminations according to the state regulatory procedure by obtaining a valid certification as an authorized agent (in both inspection and decontamination) from CPW prior to beginning work on the boat ramps. State certification training will be provided by CPW prior to opening day, with additional the-job training by CPW Staff the remainder of the first week. The inspection stations must maintain a quality control rating of 70% or better throughout the 2015 boating season.

2015 Operational Plan:

Inspections at Green Mountain Reservoir will follow a similar operational plan to what was implemented by the former DOW from 2009-2011, and the Heeney Marina at Green Mountain from 2012-2014. Consistent with the 2015 State ANS WID Curriculum protocols, trailered and motorized watercraft will be inspected and decontaminated, when necessary, prior to launching at and exiting the reservoirs. The contractor must operate all stations with the capacity and readiness to perform decontamination at any time during open hours.

There are three boat ramps on Green Mountain that must be staffed for inspections – Heeney Marina, Big Green, and McDonald Flats which must be staffed according to the above schedule.

Big Green boat launch is open to launching only at times when water levels are not appropriate for launching at McDonald Flats. When McDonald flats is open – Big Green will be closed to launching of trailered watercraft.

The contractor will be responsible for all hires and schedules to ensure adequate certified staff is on-site while the boat ramps are open to efficiently move boats in and out of the ramp following proper inspection. There will be no change in hours of operation allowed without prior consent of the CPW Invasive Species Coordinator and notification of the USFS.

Equipment expenses are paid to the Contractor on a reimbursable basis only.

Equipment which will be provided by the contractor includes the list of mandatory equipment on Page 14 of the State ANS Handbook (2009).

It is a high priority that temporary offices and secure locations for decontamination unit storage (temporary sheds or trailers) be located at the boat ramps / inspection stations so the inspectors have safe shelters to work in and the public can have a professional office. The CPW will provide decontamination units and data collection devices for each inspection station that must be stored in a secure locked location on-site. It is the contractor’s responsibility to arrange for delivery of these shelters for both staff offices, equipment and decontamination unit storage between opening day and closing day.

Shelter installation will be coordinated with CPW and the USFS. Any sign placement or traffic management changes must be coordinated with both CPW and the USFS prior to implementation. Equipment loaned to the contractor will be inventoried and non-expendable items (traffic cones, decontamination unit, data collection devices, flashlights, cameras, safety vests, step ladders, etc.) returned to the CPW within 14 days of the closing date. The contractor is responsible for replacing any equipment items not returned to CPW upon closing the stations for the season, or 14 days later.

Installation and traffic management will be coordinated with both CPW and the USFS.

The contractor will conduct the hiring and supervision of all inspectors, and the management of the day-to-day operations of the inspections stations. The contractor must have a supervisor on location for the entire term of this contract.

21. The contractor will be permitted to discharge water produced as part of its decontamination activities in a location approved by the CPW and USFS.

Discharge methods must comply with all local, state, and federal regulations regarding the discharge of water. If such on-site discharge is not available, the contractor will dispose of the produced water at a site and in a manner that complies with all applicable federal, state or local laws.

22. An Annual and Final Report will be provided by the contractor to CPW on or before December 31, 2015. The report must include a complete accounting of the contractor’s in-kind contribution (if any), including other full-time employees contribution.

Performance Monitoring

The Invasive Species Program Office will monitor the contract through the following methods:

1. Quality Control Evaluations – Per State Parks regulation#802E, CPW will conduct secret shopper quality control evaluations of the contractor and will report the results to the contractor. There are three types of evaluations that may be performed during the season by CPW (1) secret shopper evaluations, (2) phone inquiries and (3) on the job evaluations. The contractor is expected at a minimum to score passing at 70% or above, but is preferred to maintain an average score of 80% or better to be in “good standing” compliance with statewide procedures, with a score of 90% or better considered excellent.

a. CPW will monitor Contractor’s adherence to the Contract terms to manage Contractor’s quality control and assurance. It is expected that contractor will remedy the error through re-training of staff.

Full decontamination paperwork is due to the Program office with 24 hours.

Failure to send in monthly paperwork or provide notification of a mussel boat full decontamination as outlined in section 3.3 is a violation of this contract.

4. Monthly Meetings – The CPW Invasive Species Program Staff will meet with the Contractor via conference call monthly to monitor the operations.

1. CPW and the Contractor shall in good faith endeavor to resolve all controversies concerning the work, work products, or work staff for this project by mutual agreement as expeditiously as possible and within 10 business days after receiving notice of such controversy or issue via direct negotiation and settlement.

2. Initial attempts to resolve shall be sought between the CPW project manager and the Contractor’s lead project staff member.

3. If initial attempts to resolve are not successful, the dispute shall be set forth in writing and submitted for resolution to the CPW Invasive Species Program Staff and appropriate Contractor’s representative(s). If CPW and Contractor’s representative(s) are unable to resolve the dispute to the mutual satisfaction of both Parties within 10 business days, the dispute shall be forwarded for resolution to the CPW Director or designee and Contractor’s corresponding representative (e.g. Owner, VP, President, Account Manager, etc.) If they are unable to resolve the dispute within 10-business days, either Party may pursue other remedies and processes available at law or in equity. If the dispute or some portion thereof is resolved, the resolution shall be reduced to a writing signed by both Parties.

4. If resolution is still not reached, CPW and the Contractor may agree to seek resolution through mediation or non-binding arbitration.
