About this file

This is an Emergency Purchase Extension Approval document submitted by the Illinois Department of Public Health (DPH) to the State of Illinois Chief Procurement Office for General Services, extending an emergency contract with Massachusetts General Hospital. The extension responds to a statutory mandate under Article 257 of Public Act 104, requiring the Department to develop and submit a comprehensive report to the Governor and General Assembly regarding the impact of federal policy changes, particularly H.R. 1, on Illinois's health care system by January 31, 2027. The original emergency contract, referenced as BidBuy B-53490, runs from July 28, 2026, through October 25, 2026, with the extension period running from October 25, 2026, through February 28, 2027. The contractor must provide professional research, policy analysis, and consulting services including project management, stakeholder coordination, data collection and analysis, assessment of patient access to care, evaluation of hospital financial stability, analysis of federal legislation impacts, policy option development, and preparation of comprehensive deliverables including a final report, executive summary, and legislative briefing materials.

The original emergency contract amount was $1,248,000, with the extension showing an estimated amount of $0, indicating no additional funds are being requested beyond the original contract value. The Department was unable to include Business Enterprise Program (BEP) participation due to the vendor's inability to practicably subdivide work to certified BEP firms and the absence of qualified BEP-certified contractors with the specialized expertise and capacity to meet compressed statutory timelines. No competitive procurement is in process to replace this emergency contract. The Department determined that conducting a standard competitive procurement would substantially reduce available time to complete the statutorily mandated work, creating significant risk of missing the January 31, 2027 deadline. Denial of the extension would prevent completion of work necessary to meet the legislative obligation and would waste already-expended resources, as the Department lacks independent capacity to conduct the required activities and insufficient time remains to conduct a successor procurement while meeting the legislative deadline. The extension was approved by the Chief Procurement Officer on October 9, 2026.

Is there BEP participation on this contract? If no, explain why

The Agency contacted the vendor to inquire about BEP participation in the extension of the contract. The vendor stated they would not be able to practicably subdivide or subcontract the work to any of the CEI BEP certified firms registered under the procurement's NIGP code. As such, it is not practical to include BEP participation in the extension under these circumstances.

For the initial emergency contract, IDPH did not identify any BEP certified vendors with the demonstrated qualifications and immediate capacity necessary to complete the required services within the compressed statutory timeframe. Given the emergency circumstances, the highly specialized nature of the work, and the legislative deadline, additional outreach would have delayed the procurement without a reasonable expectation of identifying a qualified BEP certified contractor capable of meeting the State's requirements.

The Illinois General Assembly enacted Article 257 of Public Act 104 during the final days of the 2026 legislative session, creating a new statutory requirement directing the Illinois Department of Public Health to develop and submit a comprehensive report to the Governor and General Assembly by January 31, 2027. The Act became effective on July 1, 2026, leaving the Department with approximately seven months to complete a complex statewide assessment requiring extensive research, stakeholder engagement, data collection, policy analysis, and preparation of a comprehensive report.

During this same period, Illinois is facing significant uncertainty resulting from recent federal policy changes under H.R. 1 and continued financial pressures affecting hospitals and health care providers throughout the State. These conditions create an immediate need for objective, evidence based analysis to evaluate the potential impacts on State finances, health care access, hospital sustainability, workforce capacity, and the continuity of essential health care services, particularly in rural and underserved communities.

The project work plan requires approximately twenty eight weeks to complete. Conducting a standard competitive procurement would substantially reduce the time available to perform the work required by statute, creating a significant risk that the Department would be unable to complete the report by the legislative deadline. Any delay would also postpone the availability of critical information needed by the Governor and General Assembly to evaluate the fiscal and policy implications of changing federal funding, assess risks to the Illinois health care system, and consider strategies to reduce the potential for additional hospital service reductions or closures.

The Act states that the Department may engage a third-party experienced and expert research entity to develop this report.

2. What is the scope of work of the initial emergency contract? Please detail below:

The contractor shall provide professional research, policy analysis, and consulting services to assist the Illinois Department of Public Health in fulfilling the requirements of 20 ILCS 2310/2310-716 by developing the statutorily required report for submission to the Governor and the General Assembly no later than January 31, 2027.

Services shall include, but are not limited to:

• Project initiation, project management, and development of a comprehensive project work plan.

• Coordination with the Illinois Department of Public Health, other State agencies, stakeholders, health care providers, and subject matter experts.

• Development of project governance, stakeholder engagement strategies, meeting schedules, and data governance protocols.

• Collection, aggregation, validation, and analysis of health care, demographic, epidemiological, utilization, workforce, financial, and other relevant data from State agencies and other appropriate sources

• Assessment of patient access to health care services throughout Illinois, including evaluation of geographic, economic, and demographic barriers to care.

• Evaluation of the current and projected financial stability of hospitals and other health care providers, including analysis of factors that may contribute to reductions in services or facility closures, particularly in rural and underserved communities.

• Analysis of the potential impacts of recent federal legislation, including H.R. 1, on Illinois' health care delivery system, Medicaid and other health care funding, provider reimbursement, hospital operations, and the State's fiscal obligations.

4. Provide justification for extending the original emergency contract:

Despite continuous efforts, work is not expected to be completed by the end of the emergency contract term, as the scope of work is expansive. The original emergency contract must be extended to allow the vendor sufficient time to complete the project. In order to ensure a high quality output, the vendor, State, and other engaged parties must be allowed the full extent of time permitted under 20 ILCS 2310/2310-716 to collect and analyze information, generate reports and recommendations, and finalize deliverables. Furthermore, the Agency is requesting a new term ending on February 28, 2027 - past the January 31st, 2027 deadline set in the statute - to enable the Vendor to assist in stakeholder engagement, refine materials, and off-board remaining activities to the Agency.

5. Does this emergency contract correct or eliminate the emergency condition?

Yes No Please detail:

By engaging the vendor in this emergency contract, the Department is able to meet its legislative obligation within the time frame required by law.

6. Explain why the need cannot be met through a competitive procurement process.

Requesting Agency: DPH - Public Health Division: Directors Office completing the extensive statewide research, stakeholder engagement, data collection, policy analysis, and report development required by law before the January 31, 2027 deadline. Delaying the procurement to conduct a traditional competitive solicitation would significantly reduce the time available to perform the required work and increase the risk that Illinois would be unable to obtain the evidence-based analysis necessary to inform critical health care policy and funding decisions before the federal changes become effective. Illinois needs to stay ahead of any unpredictable shifts and changes as the last one year has demonstrated that there is very limited advance warning to federal actions involving regulatory, policy and funding streams.

7. Is a competitive procurement in process to replace this emergency contract?

Yes No Status:

8. What is the effect of a denial of this extension request?

Denial of this extension would prevent the Vendor from completing work necessary to comply with the statutory mandate and to provide State leadership with timely, evidence based information needed to support policy and budget decisions affecting the health care system and the residents of Illinois. Furthermore, denial of this extension would waste already expended resources.

as the Agency does not have the ability to independently conduct the necessary activities to complete the statutory mandate., nor is their sufficient time to conduct a successor procurement and still meet the Legislative deadline.
