DEFENSE LOGISTICS AGENCY
DLA CONTRACTING SERVICES OFFICE PHILADELPHIA
700 ROBBINS AVENUE
PHILADELPHIA, PENNSYLVANIA 19111-5092
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
(16.505(b)(2)
Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below using an exception to fair opportunity, pursuant to the authority cited herein.
1. REQUIRING AGENCY AND CONTRACTING ACTIVITY:
Agency Requiring Activity:
Defense Logistics Agency (DLA) Information Operations Logistics Catalog & Data Solutions Portfolio Defense Property Accountability System 74 Washington Avenue North Battle Creek, Michigan 49037-3084 l
Contracting Activity:
Defense Logistics Agency Contracting Services Office- Philadelphia 700 Robbins Avenue Philadelphia, PA 19111-5092
2. NATURE AND DESCRIPTION OF THE ACTION BEING APPROVED:
Pursuant to FAR 16.505(b)(2)(i)(C), the action being approved is an exception to the fair opportunity process. This justification authorizes the use of other than full and open competition to award a firm-fixed price task order under the Defense Property Accountability System (DPAS) Support services portfolio. This order will be issued on a sole-sourced basis in the interest of economy and efficiency and because it is a logical follow-on to an order already issued (SP4709-
17-D-0018 - SP4709-20-F-0078) via the J6 Enterprise Technology Services (JETS) contract vehicle. All IDIQ awardees were provided fair opportunity to be considered for the original task order award.
3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY’S NEED/ESTIMATED DOLLAR AMOUNT:
The DPAS portfolio provides the Department of Defense (DoD) support for the Defense Property Accountability System, which is the Accountable Property System of Record (APSR) for 36 Defense Agencies and the 4 Defense Services. The DPAS task order requires contractor support for requirements analysis and documentation, systems engineering, data migration, testing and deployment support for DPAS releases. The contract also provides customer support personnel consisting of a 24/7 help desk, personnel to conduct classroom training and develop electronic course material and assistance with the implementation of the system, to include system setup, establishing user accounts and data migration. Task 4 of DPAS Portfolio task order, Software Feature Enhancement, identifies the need for future Service Change Requests (SCRs). SP4709-20- F-0078 identified the “First Release” and required all offerors to provide a system and design, schedule, and pricing at the time of proposal. Due to the unique nature and vast range of customers and operating environments (36 Defense Agencies and the 4 Defense Services) any subsequent releases could not be identified at the time of solicitation and award. This modification is a subsequent SCR release under task 4 that requires SCRs for U.S. Marine Corps (USMC), Aircrew Flight Equipment (AFERMS) and the Air Force (AF).
The customers require SRCs identified under Task 4 of DPAS Portfolio task order in order to facilitate each Services’ audit program. USMC requires an SRC for a transaction inquiry that will be used to provide research/evidential matter to support their transactions and accounting events.
The AF requires an SRC for changes made to their Unit Identification Code (UIC) in order to match the organization during realignments and facilitate the AF audit. AFERMS has requested that artifacts be attached to the member profile; these artifacts are required supporting documentation for their audit. DPAS will be developing the SCRs using funds provided by the USMC, AF, and AFERMS by issuing a task order in accordance with the instructions provided in the DPAS Core Task Order SP4709-20-F-0078.
Below are descriptions of the requirements of this Task Order:
USMC (TASK 4):
• SCR 01672 – Individual Outstanding Returnable Items Inquiry
• SCR 01653 – Duplicate Document Numbers
• SCR 01667 – USMC DAI Interface
• SCR 01435 – Inventory Activity Reason Code
• SCR 01443 - Add the LIN/TAMCN Column to Manage Physical Inventory Screen
• SCR 01470 - Unit Scheduling Capability
AF (TASK 4):
• SCR 01623 -Add capability to perform mass updates to OReq and OAuth data fields
• SCR 01628 – When processing a disposition or transfer with the DAAS interface, assign the document number automatically by default to the gaining DODAAC
AFERMS (TASK 4):
• SCR 01677 - Add Inspection Type Column
• SCR 01678 - Inventory Over Under Site Change report
• SCR 01675 - Add Attachment to Member Profile
• SCR 01666 - Add Location and Container to the Repair Part Consumption Report
• SCR 01683 - Add delete capability to Due Before under the Inspection tab
• SCR 01673 - Check Box for Admin
• SCR 01674 - Add Different Appointment Times
This modification also exercises Task 8, Optional Joint Strike Fighter Funded Customer Support, which wasn’t priced at the time of award. This task was a requirement for the base year and continued support in Option Period 1 and Option Period 2 is at the discretion of the Joint Strike Fighter Program Office (JPO).
JPO (TASK 8):
The Joint Strike Fighter Program Office (JPO) has requested continued DPAS support for implementation and data gathering. The JPO has requested personnel to perform the following functions:
1) Data gathering from JSF Internal Organizations and from prime contractors
a) Data cleansing through Cataloging and data migration using the DPAS
Conversion Process to the DPAS Production environment
b) Assist with verification that assets remain in JPO ownership – data provided may be aged so assets may have been disposed or transferred to DoD Services or partner Countries
2) Training JSF personnel on DPAS functionality
3) Assist with asset valuation and update assets in DPAS with verified values
The estimated dollar value of this requirement is .
This will be a firm-fixed price task order with a 12-month period of performance, as follows:
Period of performance - Option Year 1: 1 September 2021 to 31 August 2022
4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY THE
SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION THAT THE
PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF
THE ACQUISITION REQUIRES USE OF THE EXCEPTION CITED:
Per FAR 16.505(b)(2)(i)(C), this exception to the fair opportunity process is justified in the interest of economy and efficiency because the resultant order is a logical follow-on to an order already issued to Leidos, Inc, (SP4709-17-D-0018 - SP4709-20-F-0078) via the J6 Enterprise Technology Services (JETS) contract vehicle. All JETS IDIQ vendors were provided fair opportunity to be considered for the original task order award.
The DPAS portfolio provides unique, specialized services to the entire DoD community and is a critical application for all portfolio member agencies. The primary DPAS requirement was solicited on July 9, 2020 for fair opportunity of all eligible JETS vendors. Task order award was issued to Leidos, Inc, under IDIQ SP4709-17-D-0018 - SP4709-20-F-0078.
Due to the unique operating environments supported, Task 4 of the original award, additional system enhancements, could not be reasonably identified at the time of solicitation and award.
Task 4 was included in the original PWS to cover future requirements from any customers that were unknown at the time of solicitation. This task order includes new requirements for the existing customers, USMC, AF and AFERMS.
This order is a logical follow-on to an order already issued under the contract because these requirements specify tasks contemplated in the original solicitation which could only be determined in the course of performance under IDIQ SP4709-17-D-0018 - SP4709-20-F-0078.
The newly identified work is essentially interconnected with the original tasks and necessary for their uninterrupted continuation. The extensions and efforts identified in this order do not represent a change in scope to the original task orders.
This task order is also a logical follow-on to Task 8, as contemplated in the original solicitation, as the JPO has a requirement to execute the optional CLIN to continue DPAS support.
At this time there are 300,000 assets that have been identified but it is unknown what percentage of overall assets of the JPO that this represents. Catalog (stock number) records and complete asset accountability records must be developed for these assets and verification that they remain in JPO custody must be completed. Once verified the assets must be loaded into DPAS using the DPAS Data Conversion/Migration Process. Continued DPAS support, as identified in this order, will ensure these tasks are not interrupted and continue to completion.
Because the contractor could not have reasonably anticipated these requirements at the time of proposal, execution of the operations support, and implementation of the new software enhancements listed above will require a separate project plan, schedule, level of effort, and negotiated pricing to commence performance. A competitive solicitation will result in unacceptable delays to performance and a duplication of efforts resulting in greater costs to the Government. Additionally, consideration of award to another contractor with no DPAS experience would lead to a duplication of every task and associated cost outlined in the original task order award.
Therefore, it is in the interest of economy and efficiency to award this task order on a sole-source basis because it is a logical follow-on to an order already issued under the contract, and all awardees were given a fair opportunity to be considered for the original order.
5. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable. It is anticipated that the Government will use various price analysis techniques including, but not limited to: (1) Comparison of proposed prices to historical prices paid; (2) Comparison of proposed prices with independent Government cost estimates; and (3)
