About this file
This is a Vendor Preference Certificate issued by the State of West Virginia for use in state and local contract opportunities. The document provides qualifying vendors the opportunity to request preference consideration based on residency status at the time of bid submission. The preference is applied as an evaluation method to the cost bid in accordance with West Virginia Code 5A-3-37 and is determined by the Purchasing Division. The certificate does not apply to construction contracts and requires bidders to certify their eligibility under one or more specified categories prior to contract award.
The document outlines seven preference categories with varying preference percentages. Bidders may qualify for a 2.5% preference if they meet residency requirements (either individually or as a business entity with four years of continuous West Virginia presence), if they commit to employing 75% West Virginia residents during contract performance, or if they are nonresident vendors with substantial West Virginia operations. An additional 2.5% preference is available for a combined total of 5% if bidders meet multiple criteria. A 3.5% veteran preference is available for individual or resident vendors who are veterans of the U.S. Armed Forces, Reserves, or National Guard with four years of continuous residency or who meet employment requirements. A separate 3.5% preference exists for certified small, women-, and minority-owned businesses under West Virginia Code 5A-3-59. Bidders must disclose any changes to their qualification status during contract performance and authorize the Department of Revenue to verify business tax compliance. Failure to maintain preference requirements may result in contract rescission or penalties up to 5% of the bid amount.
