About this file

This is a Domestic Workforce Utilization Certification form (BOP-1301) issued by the Commonwealth of Pennsylvania's Department of General Services for use in state and local contract solicitations, specifically applicable to the D8 Landscaping Welcome Center Site G project in Franklin County. The form requires contractors to certify the geographic location where direct labor will be performed under the contract scope of services. Offerors must select one of two certification options: either commit to performing all direct labor exclusively within the United States or within countries that are parties to the World Trade Organization Government Procurement Agreement, or specify the percentage of direct labor that will be performed in these approved locations and identify any labor to be performed outside these geographic boundaries along with the specific countries involved. The certification must be completed, signed, and submitted with the proposal to receive consideration for this evaluation criterion, with maximum scoring awarded to contractors committing to exclusively domestic or WTO-approved country labor.

The form emphasizes that domestic workforce utilization will be a scored criterion in the proposal evaluation process, with contractors performing labor exclusively within the United States or approved WTO countries receiving maximum consideration, while those proposing offshore labor outside these parameters receiving proportionally reduced scores. The certification becomes a contractual obligation upon contract execution, and any misstatements on the form are treated as fraudulent concealment punishable under Pennsylvania law. The landscaping services solicitation is set aside as a Micro Business Reserve, requiring all bidders to obtain Department of General Services Certified Micro Business status prior to the bid closing date to be eligible for award.

BOP-1301

Revised 02/23/2018

DOMESTIC WORKFORCE UTILIZATION CERTIFICATION

To the extent permitted by the laws and treaties of the United States, each proposal will be scored for its commitment to use the domestic workforce in the fulfillment of the contract. Maximum consideration will be given to those offerors who will perform the contracted direct labor exclusively within the geographical boundaries of the United States or within the geographical boundaries of a country that is a party to the World Trade Organization Government Procurement Agreement. Those who propose to perform a portion of the direct labor outside of the United States and not within the geographical boundaries of a party to the World Trade Organization Government Procurement Agreement will receive a correspondingly smaller score for this criterion. In order to be eligible for any consideration for this criterion, offerors must complete and sign the following certification. This certification will be included as a contractual obligation when the contract is executed. Failure to complete and sign this certification will result in no consideration being given to the offeror for this criterion.
