D.1 STATEMENT OF WORK – National Clean Slate Clearinghouse
D.1.1 BACKGROUND
• The Department of Labor (DOL), in partnership with the Department of Justice (DOJ), intends to support the development and implementation of a National Clean Slate Clearinghouse (NCSC). This Clearinghouse will provide information and resources to reentry, legal services and advocacy organizations that help individuals overcome the negative impacts of juvenile and criminal records. The Clearinghouse will: 1) gather content, launch, host and update a national website that provides, among other things, state-by-state information on sealing, expungement, and other related legal services that lessen the negative impact of having juvenile and criminal records; and 2) develop tools and provide technical assistance to reentry service providers and legal aid organizations on how to use and expand access to sealing, expungement, and other legal services. The Clearinghouse will disseminate information in the area of record sealing and expungement, pardons, certificates of rehabilitation, correcting inaccurate juvenile and criminal records and other strategies to diminish the often lifelong economic and social consequences associated with having a juvenile or criminal record. In addition, the Clearinghouse will provide guidance on the removal of other employment barriers that do not provide a public safety benefit.
• The Clearinghouse will provide a centralized resource to better:
o Educate and provide resources to individuals and organizations in the area of juvenile and criminal record sealing, expungement, and other means of record mitigation, including pardons, certificates of rehabilitation and correcting inaccurate juvenile and criminal records.
o Provide an online list of state-by-state policies, laws, and resources related to mitigating juvenile and adult criminal records.
o Provide a resource that connects juveniles and adults with criminal records with legal service practitioners that have expertise in juvenile and adult criminal record mitigation.
o Educate local legal aid organizations, local and county jails, public defender offices, judges, social workers, prosecutors and reentry service providers on the availability of expungement and other criminal record relief measures, which may result in increased capacity for civil legal aid services.
o Identify electronic and other technological resources and tools that simplify record mitigation processes for those with juvenile and criminal records ( e.g., the expungement generator or automated court queries that are run against databases to identify those individuals who may be eligible for expungement).
o Identify gaps in the research and provide recommendations on where additional tools and resources are needed; and o Bring coalitions of diverse stakeholders together that in turn serve to inform all of the issues and resources made available.
D.1.2 THE NEED
Each year, more than 630,000 individuals are released from state and federal prisons and almost 12 million cycle through local jails with close to 450,000 people in pretrial detention. Nationally, some 1 in 3 US adults – has an arrest record, often for relatively minor, non-violent offenses, sometimes decades in the past. The sometimes lifetime – impact of a criminal record will keep many people from obtaining employment, access to housing, higher education, student loans and other forms of credit, even after they’ve paid their debt to society, have turned their lives around, and are unlikely to reoffend. It is known that having a record of even a single arrest without a conviction can profoundly reduce a person’s earning capacity. However, research shows that people who stay out of trouble for just a few years are no more likely to be arrested than the general population.0F
1 Information and assistance regarding record mitigation, sealing, expungement, pardons, certificates of rehabilitation and the correcting of inaccurate juvenile and criminal records can play a critical role in giving people a second chance. Such actions can translate into reduced recidivism and increased chances for employment, housing, education and reintegration into the community.
The National Clean Slate Clearinghouse is designed to provide information and resources to link service providers and others in the field of juvenile and criminal justice with information and resources related to a host of record mitigation options. In addition, the Clearinghouse will provide other strategies that help mitigate the impact of having a juvenile or criminal record. The selected contractor is expected to gather, summarize, and develop materials and resources that would prove helpful in diminishing the negative impact of juvenile and criminal records along with state specific information on sealing, expungement and other related processes.
This contract will have a Base Year plus two one year options. The first year is expected to include all necessary implementation and start-up activities, including a planning period and an implementation phase, which includes the delivery of all required activities. In years two and three the contractor shall be expected to provide ongoing website maintenance and resource development as directed by DOL/DOJ staff.
D.1.3 OBJECTIVES
Through the establishment of a National Clean Slate Clearinghouse, DOL/DOJ will ensure that the following objectives, at a minimum, are met:
• Primary and secondary research is performed that documents state and national record sealing/expungement, as well as record mitigation;
• All results are adequate, well organized and presented so as to ensure maximum relevance and use by service providers, the target population and other stakeholders;
