Amendment 0004 DOL089RP20511 APPLIED RESEARCH STUDIES

(DOL089RI20479)

The above referenced solicitation is hereby modified to post responses to questions concerning the solicitation as follows:

52.228.70 REQUIRED INSURANCE is hereby revised as follows:

(a) The Contractor shall procure and maintain the following insurance during the period of performance of this contract:

(1) Workmen's Compensation and Employer's Liability Insurance

(i) Compliance with applicable workmen's compensation and occupational disease statutes is required under this contract.

(ii) Employer's liability coverage.

(2) General Liability Insurance.

(3) Automobile Liability Insurance.

(b) (This is hereby deleted)

(c) Prior to the commencement of work hereunder, the Contractor shall furnish to the Contracting Officer a certificate or written statement of the above required insurance. The policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in the policies adversely affecting the interests of the Government in such insurance shall not be effective for such periods as may be prescribed by the laws of the state in which this contract is to be performed and in no event less than 30 days after written notice thereof to the Contracting Officer.

(d) The Contractor agrees to insert the substance of this clause including this paragraph, in subcontracts under this contract that require work on a Government installation. The subcontractor(s), will be obligated by the prime contractor, to provide and maintain the insurance required by virtue of this contract. At least five 5 days before entry of each such subcontractor's personnel on Government installation, the Contractor shall furnish (or ensure that there has been furnished) to the Contracting Officer a current certificate of insurance, meeting the requirements of paragraphs (b) and (c) under this clause.

Question 1: Will all task orders issued against the awarded contracts be competed?

Answer: No, none of the task orders will be competed.

Question 2: If all task orders will not be competed, will contractors have the flexibility to decline a directed task order award?

Answer: Yes, contractors will not be forced to accept a task order.

Question 3: With regard to Sections L.5.a.2 and M.2, what criteria will be used in the Technical Evaluation to evaluate an offeror’s proposed Sample Applied Research Study?

Answer: The technical evaluation criteria are described in the solicitation.

Question 4: With regard to Sections L.5 and L.6, will the budget (labor hours by labor category) for the Sample Applied Research Study be evaluated as part of the Business Proposal?

Answer: The budget will not be evaluated for price purposes, but will be evaluated for technical merit.

Question 5: What will be the contract type of all awarded contracts?

Answer: All contracts awarded will be time and materials contracts.

Question: An offeror referenced RFP Section H.1 and asked whether DOL would allow the contractor to publish reports produced under the contract, with prior DOL review and a disclaimer of any DOL responsibility for the contents of the publication.

Answer: As stated in Section H.1, the contractor will not be allowed to disseminate or publish information developed under the contract, except with prior written approval. To correct Section H.1, however, requests for such approval should be made to the COTR (not the contracting officer), who will grant or deny such approval. Approval may be conditioned on the insertion of an appropriate disclaimer.

Question 6: The response appears to be a little ambiguous and we need clarification. Is it correct to assume that DOL will either approve dissemination/publication or approve dissemination/publication with the insertion of an appropriate disclaimer?

Answer: The contractor may request prior written approval from the COTR for the contractor to disseminate or publish information. The COTR may grant approval or may deny approval. If approval is granted, it may be conditioned on the insertion of an appropriate disclaimer.

Question 7: Additionally, the original FBO link is still not "responding". Is there an updated link?

Answer: DOL Office of the Assistant Secretary for Administration and Management Procurement Services Center A -- Applied Research Studies for the Employment Benefits Security Administration (EBSA), Office of Policy and Research (OPR) Amendment http://www.fbo.gov/spg/DOL/OASAM/WashingtonDC/DOL089RP20511/listing.html
