Description of Required Services
The National Institute of Justice (NIJ) is the research, development, and evaluation agency of the U.S. DOJ. NIJ’s mission is to advance scientific research, development, and evaluation to enhance the administration of justice and public safety. There are specific grant programs of NIJ that involve the use of chemicals or fire testing and/or may involve renovations and/or construction, which trigger the implementation of the NEPA and cause the need for contractor support to NIJ and its grantees.
As a result, NIJ must compile environmental information and review various types of environmental analyses and activities in association with providing funds to applicants, reviewing draft Environmental Assessments (EAs), and sometimes a stand-alone evaluation required by Executive Order or environmental statute.1 Past analyses and activities have included identifying historic and cultural resources, assessing impacts, consulting with State or local grantee agencies, resolving adverse impacts and the issuance of a Finding of No Significant Impact (FONSI) when appropriate or the preparation of an Environmental Impact Statement (EIS) when appropriate.
NIJ currently has an approved Programmatic Environmental Assessment (PEA) and a blanket FONSI for specific grants.
The PEA includes a comprehensive checklist that must be completed by funded recipients of grants identified by NIJ who have projects involved with chemicals, fire testing, renovation and/or construction.
The purpose of this contract is to procure support services primarily focused on 3 (three) broad areas: 1) provide general technical assistance for the NEPA process as needed and assume full responsibility for coordination and management of the requirements of the PEA Checklist process; 2) prepare individual EAs as requested by NIJ for awards not eligible for the PEA waiver; and 3) provide other technical assistance to NIJ staff related to NEPA activity including annual and interim training for grantees and NIJ staff regarding but not limited to the completion of the PEA Checklist, and overall NEPA policies and protocols.
1 An example of a stand-alone evaluation is the semi-annual report to the Council on Environmental Quality (CEQ) on cooperating agency status.
NIJ anticipates awarding a time and materials contract for NEPA support services. The contractor will be required to have an expert understanding of the PEA, Checklist and other NIJ documents related to the NEPA process to ensure the delivery of the highest quality technical support NIJ and its grantees (PEA and Checklist attached). The contractor shall be well versed with all-applicable statutes, regulations, guidelines, and significant judicial decisions and must comply with them under this contract.
In general, the required work is listed below but not limited to:
Technical Assistance - Under the existing PEA, which serves as a waiver for nearly all NIJ grants involved with chemicals, there is a comprehensive checklist which must be completed each year by grantees identified by NIJ through the COR.
Individual EAs (on an as needed basis).
Specific NEPA Process Work Requirements - NIJ may identify additional grants involved with chemicals that are not eligible for waiver under the existing PEA. For these projects, the contractor will be expected to conduct an individual environmental assessment. Listed below are some tasks that are required but not limited to:
o Task 1 - Ensure All EAs Contain Appropriate Documentation.
o Task 2 - Ensure All EAs Include Adequate Discussion of Required Sections, EAs Shall Be Completed In
