About this file

This is a Single Source Justification (SSJ) form for a federal sole source acquisition under the Simplified Acquisition Threshold (SAT) issued by the U.S. Fish and Wildlife Service, Joint Administrative Operations, Acquisitions Operations.

The Alaska Maritime National Wildlife Refuge (AMNWR) requires an upgrade of its Headquarters/Visitor Center Building Automation System (BAS) from the obsolete Siemens Insight/Apogee workstation to the current Siemens Desigo CC platform. The existing BAS no longer provides reliable automated control and currently requires manual operation by maintenance personnel, reducing system reliability, alarm management, historical trending, remote diagnostics, and operational efficiency. The procurement will provide all labor, software, licensing, hardware, programming, database migration, graphics conversion, testing, training, and warranty necessary to restore the existing Siemens BAS to full operational capability while maintaining compatibility with existing Siemens field controllers and preserving existing programming, graphics, trend data, schedules, alarms, and system databases. The primary barrier to competition is the proprietary nature of the installed Siemens BAS, which consists of Siemens hardware, proprietary databases, licensed software, graphics, and communications architecture. Siemens Desigo CC software licensing, engineering tools, database conversion utilities, and manufacturer-supported migration processes are proprietary and only available through Siemens or its authorized representatives. Market research determined that while numerous BAS contractors (Johnson Controls, Schneider Electric, Trane, Honeywell, Automated Logic) install and support alternative systems, they cannot legally provide the proprietary Siemens software and migration services required. No written expressions of interest from alternate qualified sources have been received. Siemens Industry, Inc. is uniquely qualified to perform this work as the manufacturer and authorized provider, possessing factory-authorized engineering software, proprietary migration tools, manufacturer-supported software licensing, and factory-trained certified technicians. The Program/Project Officer and Contracting Officer have certified that sole source acquisition procedures under FAR Part 13 are appropriate for this purchase.

FWS Form (Rev. 2020) U.S. Fish and Wildlife Service

JOINT ADMINISTRATIVE OPERATIONS

Acquisitions Operations

No other known sources have been identified that can provide a complete migration of the existing Siemens Insight/Apogee BAS to Siemens Desigo CC while maintaining compatibility with the existing Siemens field controllers and preserving existing programming, graphics, trend data, schedules, alarms, and system databases.

Third-party BAS contractors would require replacement of significant portions of the existing control system or redevelopment of programming and graphics, substantially increasing project cost, schedule, operational risk, and system downtime. No written expressions of interest from alternate qualified sources have been received.

We reviewed available Building Automation System (BAS) manufacturers and service providers capable of providing BAS upgrades and modernization services. Market research determined that while numerous BAS contractors install and support systems such as Johnson Controls, Schneider Electric, Trane, Honeywell, and Automated Logic, these firms cannot legally provide Siemens proprietary Desigo CC software, licensing, firmware, engineering tools, or migration services required to convert an existing Siemens Insight/Apogee system into Siemens Desigo CC while preserving the existing Siemens controller architecture. We determined that migration of the existing Siemens system requires proprietary Siemens software, licensed engineering applications, manufacturer-specific databases, and factory-authorized programming tools that are not available to

The primary barrier to competition is the proprietary nature of the installed Siemens Building Automation System.

The Refuges existing BAS consists of Siemens hardware, proprietary databases, licensed software, graphics, programming, and communications architecture that must remain operational after migration. Siemens Desigo CC software licensing, engineering tools, database conversion utilities, and manufacturer-supported migration processes are proprietary and are only available through Siemens or its authorized representatives. Awarding this requirement to another manufacturer would require replacement of existing BAS infrastructure, extensive reprogramming, recreation of graphics and databases, replacement of field controllers, additional commissioning, and significantly greater project cost and schedule.

(Include a statement by the contracting officer that the anticipated cost will be considered fair and reasonable and provide the basis used for this determination. Examples may include the results of the restricted competition, comparison of proposed costs/prices with costs/prices for similar supplies or services, commercial price lists, prior acquisition history, etc.)
