The procurement seeks a contractor to support compliance and enforcement of Massachusetts appliance efficiency standards for fifteen covered product types, including hot food holding cabinets, fryers, steam cookers, dishwashers, toilets, faucets, showerheads, electric portable spas, residential ventilation fans, spray sprinkler bodies, electric vehicle supply equipment, water coolers, and high CRI fluorescent lamps. Core services include developing educational materials and outreach messaging for covered parties, verifying product compliance through manufacturer documentation review, conducting site visits and online audits to monitor compliance, compiling compliance data, and recommending opportunities for future efficiency standards legislation and regulatory updates. The RFQ was issued September 29, 2026, with questions due October 9, 2026, answers provided October 16, 2026, and proposals due October 30, 2026 at 5:00 PM EST. The maximum contract value is $400,000 for the two-year period, with project-based pricing required rather than maximum billing rates. Respondents must provide budgets broken out by task, staff person, and hourly rate, including all ancillary services within the project price. The contract is subject to available funding, and DOER reserves the right to reduce scope if necessary to meet budget parameters. The contract will be performed under PRF74, which expires December 31, 2028, with automatic extension through June 30, 2029; continuation beyond June 2029 requires the contractor to be selected under the new Energy, Climate Action, and Facility Advisory Services contract. Proposals must not exceed ten pages, excluding resumes and budget proposals, and must include applicant qualifications, relevant experience, past project references, contact information for performance verification, and completion of the Digital Accessibility Questionnaire for Vendors. Evaluation criteria include effectiveness of the proposed approach, likelihood of achieving outcomes on schedule, relevant experience with similar projects and appliance standards in other jurisdictions, compliance with Digital Accessibility Standards, and best value to the Commonwealth.

Massachusetts Department of Energy Resources – RFQ-ENE-2027-006 Massachusetts Appliance Efficiency Standards Compliance 2027-2028

2 | P a g e

I. Introduction The Massachusetts Department of Energy Resources (DOER) develops and implements policies and programs aimed at ensuring the adequacy, security, diversity, and cost-effectiveness of the Commonwealth’s energy supply to create a clean, affordable and resilient energy future for all residents, businesses, communities, and institutions.

II. Background

Appliance efficiency standards drive large savings of energy and water for a very low cost by barring the statewide sale of less energy efficient products. The result is a transformed market where more efficient products are all that may legally be sold in the Commonwealth of Massachusetts (Commonwealth).

An Act Creating a Next-Generation Roadmap for Massachusetts Climate Policy was signed into law on March 26, 2021 (Act). Energy and water efficiency standards for fifteen (15) new products were a key component adopted in this Act. In connection with the adoption of the Act, appliance standard regulations were amended in December 2021 and can be found at 225 CMR 9.00 (Regulations) and guidelines for implementing the Regulations were released in November 2022 (Guidelines). The requirements for covered sellers and installers went into effect on January 1, 2023.

The regulated product types included in the Act that have not been preempted by federal rules are as follows:

• Hot food holding cabinets

• Fryers

• Steam cookers

• Ovens

• Dishwashers

• Toilets

• Urinals

• Faucets

• Showerheads https://malegislature.gov/Laws/SessionLaws/Acts/2021/Chapter8

3 | P a g e

• Electric portable spas

• Residential ventilation fans

• Spray sprinkler bodies (irrigation)

• Electric vehicle supply equipment

• Water coolers

• High CRI (Color-Rendering Index) Fluorescent lamps

An Act Promoting a Clean Energy Grid, Advancing Equity and Protecting Ratepayers was signed into law on November 20, 2024 (2024 Act). The 2024 Act amended ch.25B by giving the Commonwealths Department of Energy Resources (DOER)’Commissioner the ability to adopt and update regulations creating standards for any appliances to facilitate the deployment of flexible demand technologies. The selected Contractor (Contractor) under this Request for Quote (RFQ) will be responsible for supporting compliance for and enforcement of any flexible demand appliance standards adopted by DOER pursuant to the 2024 Act.

If the Massachusetts General Court passes new standards for additional product types within the term of the contract resulting from this RFQ, the selected Contractor may be required to meet deliverables associated with the new standards.

The Regulations, Guideline, and supplemental information with respect to Massachusetts Appliance Standards are available at https://www.mass.gov/service-details/appliance-energy-and-water-efficiency-standards.

Capitalized terms used in this document, not otherwise defined herein, are defined in the Regulations and Guidelines referenced above.
