The State of Oregon, acting by and through the Department of Land Conservation and Development (“Agency” or “DLCD”), is issuing this Intermediate Procurement for consulting services related to rulemaking. The requested services include but are not limited to development of Fiscal Impact Statements, Housing Impact Statements, and Racial Equity Statements necessary to implement rulemaking efforts.

Agency anticipates the Award of up to four contracts from this solicitation to provide the requested services that are more clearly defined in Section 2.4. The initial term of the Contract is anticipated to be 12 months with options to renew up to a maximum of two years. Agency reserves the right to amend the resulting contract(s) for additional reasonably related services, dependent on need and approved budget, without conducting further solicitation activities.

By submitting an Offer, each Offeror agrees that it accepts all risks, and waives any claims, that may be associated with or arise out of the volume of the services under any contract awarded under this solicitation. The SPC for this solicitation is identified on the Cover Page, along with the SPC’s contact information. Offerors shall direct all communications related to any provision of the solicitation, whether about the technical requirements of the solicitation, contractual requirements, the solicitation process, or any other provision only to the SPC.

SECTION 2: AUTHORITY, OVERVIEW, AND SCOPE

2.1 AUTHORITY AND METHOD

Agency is issuing this solicitation pursuant to its authority under ORS 279A.050 and ORS 279A.140.

Agency is using the Intermediate Procurement solicitation method set forth in ORS 279B.070 and OAR 125-247-0270.

2.2 DEFINITION OF TERMS

For the purposes of this solicitation, capitalized words will refer to the following definitions.

2.2.1 General Definitions

Capitalized terms not specifically defined in this document are defined in OAR 125-246- 0110.

2.3 OVERVIEW AND PURPOSE

DLCD’s mission is to help communities and citizens plan for, protect, and improve the built and natural systems that provide a high quality of life. In partnership with tribes and local governments, DLCD fosters sustainable and vibrant communities and protects Oregon’s natural resources legacy.

Agency has been charged by the legislature with managing urban growth; protecting farm and forest lands, coastal areas, and natural resource lands; and providing for safe, livable communities in concert with the vision of the local communities. Under the statewide land use planning program, local governments are called upon to adopt and maintain comprehensive plans and implement zoning codes consistent with 19 statewide planning goals. Recognizing that each local government has unique values and aspirations, Agency’s job under this Project is to provide planning guidance and technical assistance to help communities plan for their future while considering the needs of the region and the state.

The purpose of this Project is to inform rulemaking processes by providing at least four Fiscal Impact Statements, Housing Impact Statements, and Racial Equity Impact Statements. The Successful Offeror, or Offerors, will coordinate with a DLCD representative to complete services requested. Agency’s proposed budget for the rulemaking support services is approximately $25,000 per rulemaking.

2.4 SCOPE OF WORK

The scope of work shall include, but is not limited to the following:

2.4.1. Fiscal Impact Statements

The purpose of a Fiscal Impact Statement (“FIS”) is to give notice to anyone who may have a fiscal impact from a new or updated Oregon Administrative Rule. The FIS should therefore describe the purpose of the rule, attempt to identify people or entities the rule will financially affect and to describe, as well as possible, what that financial effect will be.

http://arcweb.sos.state.or.us/pages/rules/oars_100/oar_125/125_246.html http://arcweb.sos.state.or.us/pages/rules/oars_100/oar_125/125_246.html

Per the Administrative Procedures Act (APA) manual, DLCD and by association its contractors, is not required to conduct original research. DLCD is required to use available information to identify any significant financial effect of the proposed rule.

DLCD is required to identify any persons this proposed rule could affect economically (quantitative estimate of how the proposed rule affects these entities or explain why DLCD cannot make the estimate) including:

Small businesses;

State agencies;

Local governments; and Public.

2.4.2 Housing Impact Statements

Oregon Revised Statute (ORS) 183.530 and 183.534 requires DLCD to include in a notice of rulemaking an estimate of the proposed rule's impact on housing costs. The Housing Impact Statement (“HIS”) should provide an estimate of the effect of the proposed rule:

• on the cost of development of a 6,000 square foot parcel; and

• on the construction of a typical1 1,200 square foot detached single-family dwelling on that parcel.

2.4.3 Statements Identifying How Rule Adoption Will Affect Racial Equity in this State

Consistent with House Bill 2993 (2021 Legislative Session) and the associated amendments to ORS 183.335(2)(a)(F), Contractor shall produce a racial equity impact statement (“REIS”). The racial equity statement must address only the effects of the rule. House Bill 2993 does not define “racial equity”, and there is no one meaning of the phrase as a term of art. The ordinary meaning of “racial equity” is treating people of all races fairly, justly, and without bias. A statement of how a rule will affect “racial equity”, means how the rule will affect the fair, just, and unbiased treatment of people of different races. The Department of Justice has produced a Frequently Asked Questions (“FAQ”) about this process which may be made available to the selected Offeror or Offerors.

2.4.4 Rulemaking Projects

Offerors may submit an Offer on providing all services outlined in Sections 2.4.1-2.4.3 for one or more of the following rulemaking projects:

2.4.4.1 Public Access Rulemaking

(anticipated date of impact review is February 17, 2026, with materials needing to be provided to the advisory committee by approximately

1 Typical – single story 3 bedrooms, 1 ½ bathrooms, attached garage (calculated separately) on land with good soil conditions with no unusual geological hazards.

2.4.4.3 Shoreline Stabilization

(anticipated date of impact review is Fall, 2026)

2.4.4.4 Oregon Homes/Middle Housing Rulemaking

(anticipated date of impact review is Spring 2026, and Spring 2027 in two parts)

Information on each rulemaking project is available on DLCD’s Rulemaking website:

https://www.oregon.gov/lcd/LAR/Pages/Rulemaking.aspx. DLCD staff will refine this anticipated schedule in negotiation with the selected contractor(s). Offerors should list their interest in the projects in descending priority order. DLCD may select more than one contractor for this work. Staff will work with the selected contractor(s) to define the schedule for each project.

Offers received prior to Opening will be reviewed for Responsiveness to all solicitation requirements including compliance with Minimum Requirements section and offer Content Requirements section. If the Offer is unclear, the SPC may request clarification from Offeror.

In accordance with OAR 137-047-0261(6)(a)(A), Agency may establish a Competitive Range of all Offerors who have made a good faith effort in submitting an offer in response to this solicitation for the purpose of correcting deficiencies in Offers for determining responsiveness during Round 1.

Offeror is cautioned that the State of Oregon believes modifications to the standard provisions constitute increased risk and increased cost to the State.

Agency will only negotiate the following provision:

• Term of the contract;

• Descriptions of goods and services; and

• Compensation.

In the event that the parties have not reached mutually agreeable terms within 30 calendar days, Agency may terminate Negotiations and commence Negotiations with the next highest-ranking Offeror.
