QUESTION:
Solicitation Number DJD-14-R-0019 Rifles
Questions & Answers
The warranty states that it shall extend to "weapons with damage as a result of normal operational wear and tear." We are confused by this statement as it seems to result in the manufacturer having to repair weapons/parts or provide new weapons/parts just because the weapons already provided were used (even though they may not have defects). After normal usage (via training or operations), certain parts or weapons may require replacement even though the parts or weapons do not have manufacturing issues. A good analogy would be standard automobile repairs for normal wear and tear even though there is nothing wrong with the automobile ... parts or product need normal replacement after a certain amount and type of usage.
We recommend your agency to update the warranty requirement to exclude "normal wear and tear" from warranty coverage. Otherwise, the warranty would be never-ending and costly (as part of the price).
ANSWER: The manufacturer shall provide a recommended replacement parts interval (Replacement Parts page 12). During the 5 year warranty period any wear prone parts shall be provided by the manufacturer to DEA. DEA shall conduct all routine maintenance and service of worn parts until the factory refurbishment at 4 years and 6 months. Any parts that break during normal usage and are still within the manufacturer specified replacement interval shall be repaired by the manufacturer. The requirement is for a "bumper to bumper" warranty for 5 years.
The solicitation ()will (x) will not be amended to reflect this clarification.
2.)
QUESTION:
The warranty states that this "warranty shall include the replacement of any broken or worn parts that would render the carbines less than 100% safe and operable."
o Could you please define this section further? How do you define "safe?" How do you define "operable?"
o In addition, would you consider removing the word "worn"? It leads to the same issue as described above in question l(a).
ANSWER: See answer to question 1. We agree to remove the word "worn" from the referenced sentence.
The solicitation (x) will ()will not be amended to reflect this clarification.
3.)
QUESTION:
We acknowledge that a small business subcontracting plan is needed if the winner is a large business. In reading the RFP, it does not appear we need to propose it, just have one on file. Is that correct?
ANSWER: Correct. If applicable, the offeror shall have a small business subcontracting on file that the Government would approve prior to award.
The solicitation ( ) will (x) will not be amended to reflect this clarification.
4.)
QUESTION:
Will the weapons be returned to unsuccessful bidders?
ANSWER: Please refer to page 16-1 7, Instructions for Submission of Weapon Samples.
The solicitation ()will (x) will not be amended to reflect this clarification.
5.)
QUESTION:
Must the weapons be supplied with the proposed stock, sights, muzzle, case etc. or simply a weapon for a fit finish evaluation?
ANSWER: Please refer to page 16-17, Instructions for Submission of Weapon Samples.
The solicitation (x) will ( ) will not be amended to reflect this clarification.
6.)
QUESTION:
If we cannot supply the .308 caliber by the June 101 h deadline can we offer a weapon for review that is a caliber close to this size for evaluation. The chassis, accuracy and function will be the same.
ANSWER: No substitutions will be accepted.
The solicitation ( ) will (x) will not be amended to reflect this clarification.
7.)
QUESTION:
We are preparing a submission in response to solicitation DJD-14-R-OO 19 and are wondering about the temporary transfer of the firearms to the DEA for evaluation. Will the DEA provide a letter requesting demonstration so we are compliant with A TF regulations concerning transfers to US Gov't entities? If so, how do we go about receiving a demonstration letter?
ANSWER:
The manufacturer shall fill out ATF's "A&D book'', which accounts for where the weapons manufactured have gone. There is no form or additional paperwork. The Government is exempt on our end.
The solicitation ( ) will (x) will not be amended to reflect this clarification.
8.)
Concerning the requirement for magazines from two different suppliers; do we need to submit an equal number of each magazine, 3 and 3, with each rifle or is a single sample of the alternate magazine adequate?
ANSWER: 3 of each magazine type shall be provided with each rifle.
The solicitation ()will (x) will not be amended to reflect this clarification.
9.)
QUESTION:
The intent of the Destructive Endurance Test is to enable DEA to determine the durability of the weapon in terms of potential failure points and the estimated longevity/service life. The test is structured so that the failure of a single small part (e.g., the extractor) will cause the evaluation to stop. As certain parts are expected to break over time, and are user-replaceable, wouldn't the Government be better served by having the Vendors supply a small standard supply of spare parts for replacement and the Government continue the test until the desired round count is reached or the spare parts are expended? In this way the Government could still record the part failure (and then have a sample size larger than 1), but would have the benefit of assessing the health of the firearm after the full round count is reached, thereby providing a more thorough assessment of the weapon's overall capabilities. This will not be possible if firing is discontinued after the first part failure.
ANSWER: The intent of the Destructive Endurance Test is to test the longevity/service life of the rifles without benefit of an aggressive service regimen (when weapons are deployed in the field for extended periods away from an armorer or parts). DEA wants to know when the rifle will fail and what the likely failure points are.
The solicitation ( ) will (x) will not be amended to reflect this clarification.
10.)
QUESTION:
Will both submission weapon magazines be approved for the system if contract award?
ANSWER: Both submitted magazines would be approved for duty use with the rifle, assuming no magazine related problems arise during testing. We intend to select one magazine of the two that would be provided with the initial package and have the second magazine as a separate line item to purchase as needed.
The solicitation ( ) will (x) will not be amended to reflect this clarification.
11.)
QUESTION:
What is the throat erosion gauge being used for testing?
ANSWER: The throat erosion gauge will be used to establish a baseline and any subsequent erosion of the chamber throat over the course of testing.
The solicitation ( ) will (x) will not be amended to reflect this clarification.
12.)
QUESTION:
For past performance will any government, military, or law enforcement contract work? Or does the past performance need to be submission gun specific?
ANSWER: Past Performance does not need to be submission gun specific. All offerors must include sufficient information to demonstrate and describe their experience and expertise in providing the same or similar service to inside and/or outside of the Federal Government.
The solicitation ( ) will (x) will not be amended to reflect this clarification .
13.)
QUESTION:
The ammunition, PRC308FBI, is needed for the required test targets from the manufacturer.
"PRC308FBI" is not available for purchase commercially. Will the DOJ be supplying this ammunition? Or should we use PRC308W A for our test targets?
ANSWER: PRC308W A may be substituted for PRC308FBI for manufacturer testing.
PRC308FBI will be used for evaluation conducted by the FBI Ballistic Research Facility. DOJ will not supply ammunition for the manufacturer's testing.
The solicitation (x) will ()will not be amended to reflect this clarification.
14.)
QUESTION:
Delivery of Samples, due to our close proximity to the testing facility is it possible to hand deliver the sample guns?
ANSWER: Hand deliveries cannot be accepted due to base restrictions.
The solicitation ( ) will (x) will not be amended to reflect this clarification.
15.)
QUESTION:
Section l .2(a) - Schedule
ANSWER:
CLIN 0006 of the price schedules (for the base period and all option periods) lists only 50 EA magazines as the estimated quantity; however, we are directed that each system is to come with 6 magazines. Shouldn't each CLIN 0006 (base and option periods) read "300" as the EST QTY?
CLIN 0006 does not include the magazines that come with the weapon package. CLIN 0006 is for the ability to purchase magazines separately as needed.
The solicitation ( ) will (x) will not be amended to reflect this clarification .
16.)
Section 1.2( d) The solicitation makes no mention of the required delivery schedule for each CLIN once a delivery order is placed. It also does not provide sufficient details regarding FOB and place of delivery.
1) How many days from the placement of the delivery order to the receipt of product (e.g. CLIN OOOX is due "X" calendar days after issuance of an order)?
2) Is delivery FOB origin or destination?
3) What will be the destination location(s)?
Given the low quantity of annual deliveries, which translates to a cold production start for almost all orders, recommend no fewer than 90 days. 90 days will ensure we have sufficient time to order long-lead items and all other parts, assemble and test the guns, and make the delivery date in a timely fashion.
ANSWER: Delivery to Quantico, VA of all items shall be within 90 days after receipt of order.
FOB Destination.
The solicitation (x) will ( ) will not be amended to reflect this clarification.
17.)
QUESTION:
Section 2, Scope of Contract Almost any reputable Law Enforcement Carbine manufacturer is capable of producing far more than 50 of these carbines per year. Given that other Federal Agencies can order off of this contract, why is there such a low restriction as to the maximum guns produced each year? Recommend the contract be made much more flexible by significantly increasing the maximum number of guns produced annually.
Certainly, the Government is only obligated to purchase the minimum annual amount (5), and any purchase above the present maximum would be dependent on the availability of funds, a constraint which industry clearly understands.
Lastly, maintaining the 50 guns per year for the pricing schedule would still seem valid for proposal evaluation even if the maximum annual amount were indeed increased.
Increasing the volume would allow various Federal Agencies to place orders for more units if initial product deliveries meet requirements and are liked by end users. These agencies could do so without having to conduct a new (expensive and time consuming) competition.
ANSWER:
The CLIN maximum quantities have been changed.
The solicitation (x) will ( ) will not be amended to reflect this clarification.
18.)
QUESTION:
Section 2, Magazines (f) & Exhibit 1, 3A(i)
1) Must we supply magazines from two different manufacturers with our bid samples or simply provide verification of the existence of a second manufacturing source of compatible magazines?
2) If two magazines from two different manufacturers are required, do you require 6 of each per system or a 3 and 3 split?
3) Lastly, If two magazines from two different manufacturers are required can we propose a CLIN 0006A and CLIN0006B and list these prices separately?
ANSWER: 1) Samples of each magazine must be submitted with the bid samples. 2) 3 of each magazine type should be provided with each rifle. 3) Yes
The solicitation (x) will ( ) will not be amended to reflect this clarification.
19.)
QUESTION:

22.)
QUESTION:
Section 3 Comm & Correspondence, p.17 of 3 7
How long will it take for a response to questions? Decisions may hinge upon the answers and a long response time would adversely impact our ability to change course, coordinate with suppliers, and make timely delivery. Will an extension be granted if the responses are delayed?
ANSWER: Please refer to Paragraph 2 of the combined synopsis/solicitation in FBO.
The solicitation ( ) will (x) will not be amended to reflect this clarification.
23.)
QUESTION:
Section 2, Warranty and Quality Control/ Inspection, Testing and Acceptance (b ), (c), & (d)
ANSWER: Yes
The warranty that covers fair wear and tear part breakage over the 5-year life of the contract is fundamentally different than the 4.5 year refurbishment part of the warranty. Would the Government consider separating these two with two different CLINS (i.e. a "true" warranty CLIN that excludes normal wear and tear as a basis for a warranty claim and a refurbishment CLIN to address normal wear and tear)? This would also help ensure all competitors are providing the Government a better apples-to-apples pricing proposal.
The solicitation (x) will ( ) will not be amended to reflect this clarification.
24.)
QUESTION:
Section 2, Warranty and Quality Control/ Inspection, Testing and Acceptance (d)
What is the goal of the 4.5 year warranty refurbishment? Is it to refurbish to a degree that extends the life of the gun for the following year (the warranted period), or is it to extend the life of the gun another 5 years?
ANSWER: The goal is to extend the life of the rifle another 5 years. The intent is to have a total service life of 10 years (approximately 1 Ok rounds in that time period). We estimate the average shooter will fire approximately 5k rounds during 5 years of service. After the rifles are factory refurbished the 1 year warranty is to protect us from substandard parts replacement.
The solicitation ()will (x) will not be amended to reflect this clarification.
25.)
QUESTION:
Page 8, section a under "Muzzle Device" states "The muzzle device shall be less than three inches in length". Please clarify that either 1) The three inches restriction is the overall length of the muzzle device only when measured alone, or 2) The length that is added to the OAL of the weapon system when the muzzle device is added.
ANSWER: The length that is added to the OAL of the weapon system when the muzzle device is added.
The solicitation ()will (x) will not be amended to reflect this clarification.
26.)
QUESTION:
Page 5, section "b." describes how the bolt lock is to function, using either hand from a two handed grip, while section "d." discusses how the bolt is to be released, with the final statement in "d." that an ambidextrous bolt CATCH is preferred.
If the bolt can be released using a control that is no further from the trigger than the standard left side bolt release, does that satisfy the preference requirement to be considered an ambidextrous bolt catch as defined?
ANSWER: A control no further from the trigger than the standard left-side bolt release that releases the bolt from the right side of the weapon would satisfy the ambidextrous preference.
The solicitation ()will (x) will not be amended to reflect this clarification.
27.)
QUESTION:
On page 7, section a under "Sights", the sights described are oflower than usual height than typically used on AR type firearms. Would "equal" sights have the requirement to provide the same height above rail for the sighting plane?
ANSWER: Any standard AR type sight, approximately 2.5 inch height over bore, would meet the "equal" criteria.
The solicitation (x) will ()will not be amended to reflect this clarification.
28.)
At what sight radius is the 1/2 MOA deflection adjustment intended to be verified?
ANSWER: The sight radius will be adjusted to the maximum allowed by each rifle. A group will be shot at 50 yards with windage set at mechanical zero. A gross windage adjustment (approximately 20 clicks or the limit of the sight) will be made from the initial mechanical zero, and the center to center distance of the groups will be measured. That distance will be used to determine the approximate MOA per click deflection.
The solicitation ()will (x) will not be amended to reflect this clarification.
29.)
QUESTION:
The Troy sights recommended do not deploy with spring pressure and require a tool for sight adjustment. "Sights" sections b and c, page7 states " It is preferred that the front (rear) sight flips up under spring pressure and lock in the upright position." Please provide clarification as to the Government's preference.
ANSWER: The preference is for a sight similar in design and construction to the Troy sight that also flips up under spring pressure.
The solicitation (x) will ()will not be amended to reflect this clarification.
30.)
