About this file

This document is a Justification for Other than Full and Open Competition (JOFOC) for the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The document authorizes a sole-source, firm-fixed price purchase order for fire curtain repairs at the National Laboratory Center in Beltsville, MD. Property Management Resources (PMR), located in Sterling, VA, will perform the repairs for an estimated cost of $60,435.00, with a six-month performance period.

The repairs are deemed urgent due to the 20-year-old fire curtain system's deterioration, which could compromise life safety and property protection. PMR is a subcontractor under an existing Operations & Maintenance (O&M) contract and is responsible for fire curtain maintenance and inspections. The sole-source justification is based on avoiding potential future conflicts with contractors and ensuring warranty coverage by selecting the existing subcontractor rather than a third-party vendor.

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the authority.

The National Laboratory in Beltsville utilizes the original 20-year fire curtain system. It has been inspected, tested and determined that the rigging and some mechanical fasteners, tears in the curtain have exceeded their limits. This could cause a frailer in an actual fire emergency event.

The repairs are critical for life safety and the protection of ATF property.

PMR is the subcontractor of the O&M awarded contract (15A00025CAQA00083). As the sub of the prime contractor, they are tasked with all Fire Curtain maintenance and inspections.

Any other vendor selected to perform work related to repairs or newly installed system would not be covered under the existing O&M contract. Selecting the sub of the prime keeps any warranties, future repairs or services withing the scope of both parties. Selecting a 3rd party vendor will result in future conflicts with the Prime Contractor, their sub and the 3rd party in determining who is responsible for any future damage. This will result in a further unforeseen financial impact on the Government. Furthermore, delay in awarding a contract would result in displacement of personnel.

6. Certifications.
