About this file

This is a Certification of Noninvolvement in Prohibited Activities in Russia or Belarus form required by the State of New Jersey for vendors seeking to enter into or renew contracts with state agencies. Pursuant to N.J.S.A. 52:32-60.1 et seq. (L. 2022, c. 3), all vendors must complete this certification to verify their status on the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list. The form applies to vendors providing goods or services, or those purchasing bonds or other obligations from state agencies. Vendors must certify one of three conditions: that they are not identified on the OFAC list due to Russia or Belarus-related activity; that they are unable to certify non-involvement because they appear on the list for such activity; or that while identified on the OFAC list, their Russia or Belarus-related activities are consistent with federal law, regulation, licenses, or exemptions. The certification requires the vendor's authorized representative to sign and provide detailed company information including name, FEIN, address, phone, fax, and email.

The Department of the Treasury enforces compliance with this certification requirement and may impose sanctions, seek compliance, recover damages, declare vendors in default, or pursue debarment or suspension for false certifications. Vendors must review the current OFAC Specially Designated Nationals and Blocked Persons list before completing the form. The definition of "Vendor" under this requirement is broadly construed to include natural persons, corporations, partnerships, limited liability entities, governmental entities, and any parent, subsidiary, or commonly controlled entities. If vendors cannot certify non-involvement due to OFAC designation, they must provide detailed explanations of how their activities comply with applicable federal law and regulations on separate sheets as needed.
