About this file
This is an Exemption from Competition (EFC) request form submitted by the Idaho Department of Health and Welfare (DHW) to the Division of Purchasing (DOP) for pharmaceutical services. The agency is seeking authorization to procure pharmaceutical services from Guardian Pharmacy Services in Boise for Southwest Idaho Treatment Center (SWITC), State Hospital West (SHW), and Payette Assessment Care Center (PACC) without conducting a competitive solicitation. The request was submitted on August 15, 2025, with a public comment period closing on August 21, 2025. The procurement is classified as a one-time purchase with an anticipated total cost of $36,250.00, and the agency intends to use the one-year exemption period to develop a comprehensive solicitation document for future competitive procurement.
DHW justifies the exemption by citing the specialized and complex nature of pharmaceutical services, the immediate life-safety threat posed by the lack of medication availability following PharMerica's contract termination, and the inability of the statewide contractor Cardinal Health to provide the required services. The agency notes that while currently utilizing a local pharmacy interim solution, exceeding the $15,000 delegated purchasing authority limit necessitates the exemption request under IDAPA 38.05.01.042.05, which permits exemptions when competitive procurement is impractical, unreasonable, or disadvantageous. The DOP Administrator intends to approve the exemption pending legal notice, with the opportunity for public input through IPRO Supplier Attachments or email to purchasing@adm.idaho.gov. No specific set-asides, incumbent contractors, or funding source details are identified in the documentation.

Exemption from Competition
IDAPA 38.05.01.042.05 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to:
special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.
Proposed Supplier * Enter Unknown if supplier is not known
Guardian Pharmacy Services
Duration *
One-Time purchase Ongoing
Anticipated Total Cost * $36,250.00
Background * Describe the circumstances
Southwest Idaho Treatment Center (SWITC) and State Hospital West (SHW) have contracted with Pharmacy Corporation of America (PharMerica) for pharmacy services. PharMerica terminated the contract and will no longer be providing services. The statewide contractor Cardinal Health is unable to provide the necessary services. The Department has found a local pharmacy to provide the necessary services outside of a contract in the interim but anticipate exceeding the $15,000 limit.
This field has a 500 character limit
Justification * Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?
Due to the complexity and very specialized requirements of the service it would be disadvantageous to post a soilication for competition at this time. The Department is requesting an exemption from competition to utilize Guardian Pharmacy Services in Boise to procure these necessary pharmacy services for SWITC, SHW, and the Payette Assessment Care Center (PACC) for one (1) year to provide time for the Department to compile information to compose a complete solicitation document. Without medications, this presents a life/safety scenario which may cause harm and even death to patients/clients.
Description * Describe the extent to which competition is possible
Given one (1) year to complete a detailed, accurate and comprehensive solicitation document, the competitive process is possible. This would ensure any potential vendors will have an opportunity to provide services.
Agency Certification *
The information provided above is true and accurate to the best of my knowledge, and supports the need for a direct procurement of the described goods or services, in the best interest of the State.
