QUESTIONS AND ANSWERS SECTION:

Question 1: Are you able to provide the incumbent’s name for the above referenced project?

Answer 1: This is public information available on the DGS website. This is the direct link to access the information: https://dgs.maryland.gov/Pages/OFP/OnCallContracts.aspx

Question 2: From several comments, Q&As in today's meeting, it was clear, that design will be needed only incidentally and is not a primary part of the scope of this contract. We do understand people capable of design and registered as engineers and architects need to be involved. The evaluation criteria are listed in descending order of importance. The second and third evaluation factors pertain to design experience. - See below:

6.2.2 Originality and quality of design in previous work

In the evaluation of this item, the Evaluation Committee will consider photographs and drawings of built work; design awards; publication of design work in professional journals; review of work by independent authors; other recognitions and honors; and the consultant’s explanation of appropriateness and originality of illustrated work.

6.2.3 Special Experience, design approach or other special qualifications

In the evaluation of this item, highest consideration will be given to projects similar in size and scope to that described in the referenced project’s program. The Evaluation Committee will only consider five (5) projects.

With design being less important than quality control, inspections etc. can the weight/priority given to design in the evaluation factors be decreased?

Answer 2: No, it was only stated that design firms are not expected to provide stamped drawings.

Design and mechanical experience are an important part of this contract.

Question 3: If a JV submits, and one of the firms was in attendance at the pre-proposal meeting and the other was not. Does the JV get credit for attending the meeting?

Answer 3: Credit for attendance will be provided as long as one of the firms in the joint venture attended the pre-proposal conference.

Question 4: Does a JV between two MBE/DBE’s still get to count 50% of the MBE/DBE goal?

Answer 4: Correct, refer to the instructions in D-1A MBE Utilization and Fair Solicitation Affidavit & MBE Participation Schedule form.

https://dgs.maryland.gov/Pages/OFP/OnCallContracts.aspx

Question 5: Can a firm submit as a prime and also be included as a subcontractor on other prime submissions?

Answer 5: Yes, this is allowed.

Question 6: Page 15 of 69, Section 4.11 specifies that there is no Oral Presentation, whereas Page 34 of 69, Section 6.5.2 B specifies that "During this review, oral presentations and discussions may be held". Can the Agency please clarify which of these two statements is true? If it is the latter, who are the key people required to be present for the presentation?

Answer 6: There is no oral presentation required for this solicitation.

Question 7: Are there incumbents presently providing this service to the State? If yes, will the Agency please share their names and contracts awarded till date?

Answer 7: Refer to the answer for Question 1.

Question 8: Page 15 of 69, Section 4.9: When a PIA request is received by the Agency, will the Agency request a redacted version of the proposal?

Answer 8: Paragraph 4.9.1 of the RFP explains how the offerors identify confidential and/or proprietary commercial information or trade secrets in their technical and financial proposals. In the unusual request of a Public Information Act, the Procurement Officer is required to make an independent determination whether the information must be disclosed.

Question 9: Page 28 of 69, Section 5.3.2 F: There are 16 positions listed numbered 'a' thru 'p'. Are all 16 positions key personnel or is it left to us to decide who our key personnel are?

Answer 9: All disciplines listed on page 29 are required.

Question 10: Page 28 of 69, Section 5.3.2 F: RFP mentions that the positions identified with * are required to be registered engineers or architects. Should they be registered in the State of Maryland, or will the Agency accept registrations from other States?

Answer 10: Confirmed, all key personnel must be licensed in the State of Maryland or hold a certification as indicated on page 29 of the RFP.

Question 11: Page 28 of 69, Section 5.3.2 F: Can the contractor employ people with work authorization to work in US, such as H1B to work on the projects?

Answer 11: Any Individuals, corporations, partnerships, or other entities must meet the requirements of Maryland law and any licenses and permits issued by the appropriate Maryland State Board or authority.

Question 12: Page 20 of 69, Section 4.27.1 says MBE goals will be determined at the Work Order level. In the absence of these goals, please advise us on how we can fill and submit Attachment D1-A for MBE utilization.

Answer 12: Complete the entire D-1A MBE Utilization and Fair Solicitation Affidavit & MBE Participation Schedule form as applicable and just leave the percentages portion blank.

Question 13: Page 34 of 69, Section 6.5.2 D: In the absence of a Financial Proposal, please clarify the relevancy of Best and Final Offer (BAFO).

Answer 13: Financial Proposals will be requested from successful offerors only. Best and Final Offers (BAFOs) may be requested in the best interest of the State to allow Qualified Offerors to revise and resubmit their initial Proposals.

Question 14: Page 33 of 69, Section 6.5, Selection Procedures: Does this procedure refer to the process followed in the selection of a vendor to award at the Work Order level?

Answer 14: Section 6.5 is in reference to the award of the Master Indefinite Quantity Contract. Refer to RFP Section 3.13 for the work order assignment process.

Question 15: In Page 41 – with reference to Reciprocal Preference - Please clarify, does Maryland Offerors will be given preference than other states?

Answer 15: RFP Section 3.4 on Page 33, states that Maryland law does not authorize procuring agencies to favor resident Offerors in awarding procurement contracts but only to apply reciprocal preferences as discussed under section 6.4.1; however, the evaluation criteria under section 6.2.7 of the RFP gives greater consideration to firms located within a 150-mile radius.

Question 16: We are eMMA SBR certified SBR firm. We trust that GOSBA is not a separate certificate and that the 'eMMA SBR' registration will suffice for this response?

Answer 16: eMMA SBR registration will suffice.

Question 17: We have placed construction managers and inspectors as a sub-contractor to larger firms.

Does RFP allow us to show those projects as our Prime projects in our past performance? Please clarify.

Answer 17: The firm must be the prime on all submitted projects.

Question 18: Can projects done by JV in other states than Maryland been shown as overall past performance for the proposal? Please clarify.

Answer 18: Projects can be submitted as long as the firm was the prime. The evaluation committee will give greater consideration to work performed on State of Maryland projects per RFP section 6.2.5.
