About this file

This is a Memorandum to File documenting a sole-source justification for a FAR Part 13 acquisition under the Simplified Acquisition Threshold (SAT).

Marine Corps Recruit Depot Parris Island (MCRDPI) requires replacement, maintenance, and technical support for its Automated License Plate Reader (ALPR) system. The ALPR system provides critical security and law enforcement intelligence capabilities by capturing, recognizing, and comparing vehicle license plates against authorized databases and law enforcement hot lists, including wanted persons, stolen vehicles, BOLOs, AMBER Alerts, SILVER Alerts, and vehicles with expired registrations or unpaid citations. NDI Technologies, Inc. (NDI) is identified as the only reasonably available source for the required ALPR equipment, maintenance, and licensing. The justification for sole-sourcing is based on restrictive rights, specifically that NDI possesses proprietary rights and technology. The existing MCRDPI ALPR system uses NDI's proprietary VISCE back-office solution to maintain real-time connectivity to the South Carolina Law Enforcement Division's (SLED) Vehicle Intelligence Server and Communications Servers. Because the existing system is proprietary and must maintain uninterrupted SLED connectivity, another vendor cannot provide the required services without replacing or substantially modifying the existing system and losing critical data-sharing capability. The justification has been certified by the Technical/Requirements official (R.D.E.106543944, WATSON.SYRANA) and the Contracting Officer (MOHEAD.KACY.M ORRIS.107033217, MOHEAD.KACY.MORRI S.107033217). This document is controlled by the Department of the Navy, United States Marine Corps, and is limited to DoW Community distribution only.

Determination that Only One Source is Reasonably Available (Including Brand Name) – FAR Part 13 Acquisitions under the SAT

V 1.6 (20 December 2023)

DISTRIBUTION: DoW COMMUNITY ONLY

MEMORANDUM TO THE FILE

Subj: DETERMINATION THAT ONLY ONE SOURCE IS REASONABLY

AVAILABLE FOR A FAR PART 13 ACQUISITION UNDER THE SIMPLIFIED

ACQUISITION THRESHOLD

I. BACKGROUND:

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement (or portion of the requirement to be sole-sourced) is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

Marine Corps Recruit Depot Parris Island (MCRDPI) requires replacement, maintenance, and technical support for its Automated License Plate Reader (ALPR) system. The ALPR system provides critical security and law enforcement intelligence capabilities by automatically capturing, recognizing, and comparing vehicle license plates against authorized databases and designated law enforcement hot lists. These lists may include wanted persons, stolen vehicles, BOLOs, AMBER Alerts, SILVER Alerts, expired or improperly registered vehicles, vehicles associated with unpaid citations, and vehicles that are not authorized to enter the installation.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN

COMPETITION IS BASED ON THE FOLLOWING (select all that apply):

A. _x_ ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. __x__ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

Determination that Only One Source is Reasonably Available (Including Brand Name) – FAR Part 13 Acquisitions under the SAT

NDI Technologies, Inc. (NDI) is the only reasonably available source for the required ALPR equipment, maintenance, and licensing at MCRD Parris Island.

Supporting documentation establishes NDI as SLED's sole-source vendor for the required law-enforcement data-sharing interface.

The existing MCRD Parris Island ALPR system uses NDI's proprietary VISCE back-office solution to provide real-time connectivity to SLED's Vehicle Intelligence Server and Communications Servers, including access to applicable local hot lists. NDI possesses the required proprietary technology, system compatibility, and data rights necessary to maintain this capability.

Because the existing system is proprietary and must maintain uninterrupted SLED connectivity, another vendor cannot provide the required services without replacing or substantially modifying the existing system and losing the required real-time data-sharing capability.

Therefore, NDI is the only source reasonably available to provide the required maintenance and licensing services while maintaining the existing system's operational effectiveness and SLED connectivity.

2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. ___ OTHER REASONS.

B. ___ BRAND NAME

C. ___URGENT AND COMPELLING. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required:
