About this file

This document is a Determination of Brand Name Specification from the Oregon Department of Corrections (ODOC) for the procurement of PVI boiler parts. The agency has determined that the use of a brand name specification is necessary because the existing boilers at Snake River Correctional Institution (SRCI) are PVI-manufactured and require compatible parts to maintain proper functionality and efficiency. The total estimated cost for this procurement is $25,000.

The agency has found that the use of a brand name specification is justified because there is only one manufacturer of the required quality and functionality, and the acquisition of compatible goods is necessary for the efficient utilization of the existing equipment. The agency has the authority to approve this brand name specification under the DAS Delegation of Procurement Authority Policy.

DETERMINATION OF BRAND NAME SPECIFICATION

PART A. Introduction, Background, and Findings.

1. Agency Name: Department of Corrections

2. Date: 9/20/17 3. Agency 5-digit Number: 29100

4. Agency Contact Name: Tyler Blewett 5. Phone: (541) 709-7049

6. Total Estimated Cost: $ 25,000.00

7. Title; Brand Name to be Acquired: PVI

8. Background: Agency shall provide the background for this brand name determination.

The Boiler System at SRCI is manufactured by PVI and has been in service since 1998. SRCI has 11 PVI systems in service. Complex 2 has failed. The 1 ¼” tubes have substantial scaling – holes and leaks reduce efficiency resulting in loss of heat and increased power usage (SRCI has invoked a preventative maintenance schedule for servicing this machinery to reduce scaling and increase efficiency).

336097-OR is for $25,126.00 for parts only.

9. Findings to Satisfy the Required Standards: Agency determines that:

___N/A__ (a) Use of a brand name Specification is unlikely to encourage favoritism in the awarding of Public Contracts or substantially diminish competition for Public Contracts because:

__N/A__ (b) Use of a brand name Specification would result in substantial cost savings to the Agency; (i) will result in substantial cost savings to the contracting agency or to the public because:

___X____(c) There is only one manufacturer or seller of the product of the quality, performance or functionality required; because:

___X____ (d) Efficient utilization of existing Goods requires the acquisition of compatible Goods or Services. because:

The SRCI Physical Plant operates with highly technical equipment and machinery that operate with specific tolerances that warrant “Fit, Form, and Function” requirements to retain 100% functionality of the equipment reliability. The boiler plant functions under high pressure, high temperatures, and very specific product specifications.

PART B. Law, Authority, and Approval of Brand Name Specification.

STATUTE AND RULE:

ORS 279B.215 and OAR 125-247-0691 describe the processes for brand name or equal specifications.

AUTHORITY TO APPROVE BRAND NAME SPECIFICATIONS:

DAS Delegation of Procurement Authority Policy, number 107-009-010, effective November 3, 2005, Section V, delegates authority to Agencies to approve brand name specifications.

FINDINGS:

The market research confirms PVI has territorial rights for boiler parts. This procurement is quasi-sole source in that only specific distributors can sell PVI parts to ODOC.

The findings are accepted, adopted, and incorporated by reference herein.
