Justification for an Exception to Fair Opportunity
This document is a Justification for an Exception to Fair Opportunity under IAW FAR 16.507-6(d)(2) for a GSA Class Deviation (RFO-2025-16).
The General Services Administration's Public Buildings Service, Acquisition Project Delivery Division, East Branch B is seeking to award a firm fixed price task order (GSA 300) against the Multiple Award Indefinite Delivery/Indefinite Quantity (IDIQ) Contract for General Construction Services in the East Coast Corridor. The work involves design and construction services (NAICS code 236220) to fit out an existing but currently unaccredited Sensitive Compartmented Information Facility (SCIF) at the John W. Powell Building in Reston, Virginia, for the Joint Strike Fighter (F-35) Group, an entity attached to the Pentagon under the Department of War. The estimated contract value is redacted in the document. Required work includes SCIF infrastructure fit-out, card reader installation, mini-split HVAC systems, white noise units, wall soundproofing, and electrical work, to be funded with customer-provided BA 80 funds (RWA).
The sole-source exception to fair opportunity is justified under FAR 16.507-6(b)(1) due to urgent mission requirements. The existing month-to-month lease costs $1.7 million per month ($56,667 daily), creating unacceptable financial and operational risk. A fair opportunity procurement would add one to two months to the timeline and require an additional $3.4 million in lease costs. Dubois Construction, Inc., of Windsor Mill, Maryland, has been identified as the best-suited contractor based on prior experience with two SCIF fit-out projects under GSA contract and demonstrated performance in timely proposals, negotiations, and post-award execution. The contractor is a woman-owned small business. The contracting officer will determine fair and reasonable pricing through comparison to an Independent Government Estimate and negotiations, utilizing maximum profit, overhead, B&I, and supervision labor rates from the IDIQ contract. Certified cost and pricing data is not required as the contract value falls below the $2.5 million threshold. No subsequent acquisitions are anticipated for this discrete project.
