About this file

This document is a Request for Qualifications (RFQ) and Request for Proposals (RFP) issued by the Georgia World Congress Center Authority (GWCCA) for design-build services to upgrade and refurbish the Olympic Ring Fountain at the Georgia World Congress Center in Atlanta, Georgia. The project involves updating the outdated control system and technology for the interactive, programmed fountain, with the goal of enhancing the guest experience. The RFQ solicits statements of qualifications from interested design-build firms, with a deadline of October 3, 2023. Finalist firms will then be invited to submit detailed project proposals and participate in interviews, with a proposal deadline of October 13, 2023. The selected design-build firm will commence services upon contract award and negotiation, with the project targeted for completion by May 24, 2024.

The RFP indicates the project will utilize a cost-plus contract structure with a guaranteed maximum price, and the design-build firm will be responsible for all design, pre-construction, construction, and warranty phase services. The GWCCA desires to incorporate sustainable design and construction concepts where feasible, and has requirements for the design-build firm's insurance, bonding capacity, and safety record. The contract will be awarded to the firm providing the highest-scoring proposal and interview based on criteria such as team qualifications, management approach, and fit to the project's needs.

I. REQUEST FOR QUALIFICATIONS

Design Build Services for

RFQ No. GWCC-0919-DB for

Project No. GWCC-0919, Olympic Ring Fountain Upgrade/Refurbishment

The Georgia World Congress Center Authority (“GWCCA” or “GWCC”) is seeking Requests for Proposals from firms interested in providing design-build services for a project known as Olympic ring fountain upgrade/refurbishment at the Georgia World Congress Center, located in Atlanta, Georgia. This Request for Proposals (RFP) seeks to identify the most qualified potential providers of the above-mentioned services.

Restriction of Communication: From the issue date of this RFP solicitation until a successful proposer is selected and the selection is announced, proposers are not allowed to communicate for any reason with any members of GWCCA except for the designated contact person.

1. GENERAL PROJECT INFORMATION (STEP I)

It is envisioned that the GWCCA will best be served by the employment of the services of a Design- Builder firm (DB) for the project. The GWCCA will contract with a General Contractor as the lead that has teamed with a Design Professional. The successful DB may not be eligible to bid or enter into a contract or subcontract for any of the construction or other services other than as set forth in the Design- Build Contract and General Requirements. All respondents to this RFP are subject to instructions communicated in this document and are cautioned to completely review the entire RFP and follow instructions carefully. GWCCA reserves the right to reject any or all proposals, and to waive technicalities, irregularities, and informalities, and retains the right to cancel or conclude this procurement at any time without selecting a firm to provide the described services, without any liability to any respondents, or any other person or entity, and is under no obligation to make an award relating to this RFP to any person or entity. The final terms of any Design-Build Agreement for the project contemplated by this procurement will be determined by the GWCCA subject, in all cases, to strict compliance with the applicable provisions of the laws of the State of Georgia.

Project Background

Since 1976 when the Georgia World Congress Center (GWCC) officially opened its doors, the Georgia World Congress Center Authority’s downtown Atlanta campus has continued to evolve, expand and take shape as the hub of the capital city’s entertainment and hospitality district. From its beginnings as a single exhibition hall (Building A), the GWCCA campus now includes 21-acre Centennial Olympic Park, Mercedes-Benz Stadium, International Plaza, multiple parking decks, the College Football Hall of Fame, Junior Achievement Discovery Center and the 3.9-million-square-footconvention center.

The goal of the Georgia World Congress Center Authority is to provide the highest level of service possible, while ensuring venue customers and attendees have a safe and positive experience. These actions hopefully translate into repeat business and accolades within the convention industry. A positive experience and a professional image enable GWCCA to accomplish its mission of promoting and facilitating events/activities that generate economic benefits to the state of Georgia and the city of Atlanta.

Project Description and Scope The Atlanta Centennial Park Olympic Rings Fountain is a significant interactive, programmed, show fountain located downtown that was built for the 1996 Summer Olympics and has become an iconic water feature for the State of Georgia. It includes approximately (260) individually controlled fountain nozzles with illumination. The fountain pumps, filtration system, and controls are in an equipment room below the fountain.

One of the main concerns with the Olympic Rings fountain is the outdated technology with the control center. Selected design firm will design a system with updated controls along with a user-friendly touchscreen interface that makes the selection of various pre-programmed fountain shows/songs, as well as general on/off operation of the fountain display and lighting an intuitive process. Additionally, the system will be capable of remote operation via remote login from a computer or handheld device such as an iPad.

Additional objectives by the design team should include the development of potential enhancements that should be considered by the GWCCA. GWCCA wants to use this project as an opportunity to not just make updates to the outdated technology, but also to elevate the experience for their guests.

The design proposal should include an appropriate number of site visits by all design team members to review the current fountain set-up and discuss the desired operation for the new fountain set-up.

The design team will produce a set of drawings to detail a modern, user-friendly, control system along with wiring for the sequencing display jets and LED lighting. Along with the layout, the drawings will include the required utility connections, a detailed description of the fountain operation, an equipment list, and all wiring/cable sizes & layout that is required for GWCC to gather installation.

Sustainable Design The project is subject to the Energy Efficiency and Sustainable Construction Act of 2008, and it is the desire of the GWCCA to incorporate sustainable design and construction concepts in the project where feasible to do so. Further, Georgia Peach certification is required with commissioning.

Project Budget Part of the services requested under this RFP include assisting the GWCCA with establishing the budget for this project as Task 1, which is further described below.

Project Schedule The Design Builder is anticipated to commence services upon selection and successful conclusion of contract negotiation. GWCCA desires to have the project underway within the third calendar quarter of 2023. The full schedule for design and construction will be determined following the completion of Task 1 of the services, however, if the project proceeds following Task 1, GWCCA’s desire would be to complete the project by May 24, 2024.

2. QUALIFICATIONS REVIEW PROCESS (STEP I)

Selection of the DB will be a multi-step process. GWCC will generally follow the requirements of Georgia Code Title 50 Chapter 22 with respect to the selection of DB for the proposed project.

II. REQUEST FOR PROPOSALS

(From Qualified Finalists)

Design Build for

RFP No. GWCC-0919-DB

For

Project No. GWCC-0919, Olympic Ring Fountain Upgrade/Refurbishment

To firms who have been issued notification as having been deemed eligible, the Georgia World Congress Center Authority (GWCCA or Authority), as “Owner,” issue this Request for Proposals (RFP), for those eligible firms to offer proposals for construction management at-risk services for the specific project.

1. CONTRACT INFORMATION (STEP II)

General The Design-Builder (DB) is normally under contract to supply both design services and construction services, to complete the project and place the GWCCA in occupancy of the project in a “turnkey” fashion. Once a Guaranteed Maximum Price (GMP) is agreed to between the GWCCA and the DB, the DB is “at risk” for project price, project schedule, and completion of all construction as set forth in the Contract Documents. The DB holds all trade contracts and trade supplier contracts. The price and financial structure of this Agreement is the “cost-plus” method, with an absolute cap on the total price of the contract (the GMP), and certain other maximum price allowances. The sole basis for the “plus” under this Agreement is the Design-Builder’s Fee, which is the DB’s “gross profit”. The sole basis for “cost” throughout this Agreement is Actual Cost. In addition to the GMP, there are total cost limitations imposed on Actual Costs for overhead, salary and labor costs, both as to type of cost and allowable amounts.

Actual cost is the only allowable cost under this Agreement, unless and until a Lump Sum Price is agreed to between the GWCCA and DB. The GWCCA can designate an Executive Administrator or a Program Manager to represent the GWCCA in administration of the Project.

GWCCA desires to pursue this project in two steps designated as Task 1 and Task 2. The general scope of Task 1 is to prepare a set of pricing documents to be used to assist the GWCCA in determining the project’s budget. This will also include cost estimating in support of that activity. Project Cost will include the cost of the work as well as the cost of design services to complete appropriate design documentation, as well as the DB’s general conditions and fees consistent with the description above. If the Project Cost is determined to be acceptable given the available funding, then the project would move into Task 2 with the execution of a GMP Agreement and complete the design documentation and construction under a Lump Sum Price. These two tasks are described in more detail below.

Contingencies There are two contingency amounts under the GMP. The first is the “construction contingency,” which is largely under the control of the DB pursuant to the terms of this Agreement and has a minimal requirement for GWCCA approval “not unreasonably withheld.” The second is the “design contingency” pursuant to the terms of this Agreement, in which the GWCCA retains substantial control. Both contingencies are eliminated if the GWCCA and DB ultimately agree to a Lump Sum Price for the

Contract Scope During Phases of Project The Design Builder’s services shall include all Design, Pre-construction, Construction, and Warranty Phase services. The DB will provide comprehensive administration and management of all aspects of the construction of the project and will work in concert with the GWCCA towards the successful completion of the project on schedule, at or below budgeted costs, meeting or exceeding standards stipulated by the design criteria, and in adherence with standards required by local authorities and other agencies having jurisdiction. It is expected that the DB will undertake such measures as surveys, programming, engineering design, preconstruction, and construction of the project.

The Proposer shall assemble and manage an appropriate team of qualified professionals capable of implementing all requirements of the Project, as outlined in the RFP. If a Proposal is submitted by a team of individuals or firms, the Proposal shall clearly define the Lead Firm making the Proposal. Design services shall be provided by a design professional registered to perform architectural and/or engineering services in the State of Georgia who retains all responsibilities for design and construction administration services of the Project.

The Owner may consider minor, reasonable revisions to the requirements stated herein as part of the design builder’s proposal provided there is evidence of improved operation, use, or benefit to the Using Agency. Any and all such deviations must be specifically and individually identified and justified in the design builder’s proposal. Deviations not identified in the proposal will not be considered.

The Design-Build (DB) services shall comprise two steps designated as Task 1 and Task 2. If the Project Cost is determined to be acceptable given the available funding, then the project would move into Task 2. Any additional information required (i.e., testing, environmental site assessments, etc.) will be the responsibility of the Owner.

If the project moves forward into Task 2, the Design-Builder (DB), under the general supervision of the Owner and Program Manager, will commit to a Guaranteed Maximum Price (GMP) for all design and construction backed by a surety bond. The DB shall competitively select all construction subcontracts and other work appropriate for competitive selection but is free to use qualification factors other than price of work to select construction subcontractors that will deliver the best value to the GWCCA and the State of Georgia. Project shall be constructed within this GMP.

During the construction phase DB will be responsible for means & methods of construction, safety programs, quality control, general conditions, prequalification of potential subcontractors and bidding of all work, certification of all work in place required for monthly payment requests, coordination, scheduling of all work associated with all construction contracts and other miscellaneous contracts required for the completion of the project within the predetermined budget and schedule. DB will assist GWCCA in management and administration of the project except that the GWCCA shall retain complete contractual control of all prime DB contracts, project funds, and disbursements. The DB shall retain all normal responsibilities for professional design, cost control, schedule and quality assurance including normal construction administration responsibilities.

The successful DB may not be eligible to bid or enter a contract or subcontract for any of the construction or other services other than as set forth in the Design-Build Contract and General Requirements. Click the following link to view a sample of the proposed DB Construction Contract. The actual contract may differ slightly.
