About this file

This is a Sole Source Authorization (SSA) Request Form submitted by the Idaho Department of Environmental Quality (DEQ) to the Division of Purchasing (DOP) seeking approval to procure services from Dr. Donald Zaroban for a five-year term beginning in Fiscal Year 2027. The DEQ requests access to Dr. Zaroban's intellectual property and technical expertise in laboratory-verified identification of native fish species for the Beneficial Use Reconnaissance Program (BURP). The BURP program monitors and assesses wadeable streams using three categories of biological data: fish data, macroinvertebrate data, and habitat data. The Quality Assurance Plan requires that any unidentified fish specimens be submitted for laboratory verification to ensure accurate species classification and meaningful biological scoring. Dr. Zaroban's specialized knowledge is necessary to identify difficult-to-discern species including Brook/Bull Trout hybrids, Cutthroat/Rainbow Trout hybrids, sculpin species, dace species, suckers, chub, juvenile salmonids, and invasive species such as Black and Brown Catfish and Oriental Weatherfish that DEQ's regional staff cannot reliably identify in the field.

The anticipated total cost for the five-year contract term is $50,000. The DEQ conducted research into alternative sources, contacting the Idaho Department of Fish and Game (IDFG) Native Fish Program, Sport Fish Program, the City of Boise, and EPA Region 10 office. Both IDFG and the City of Boise confirmed they also utilize Dr. Zaroban for laboratory-verified fish identification services. Alternative options identified, such as genetic analysis and otolith aging, were deemed either cost-prohibitive or unsuitable for the project's requirements. The request was submitted on September 29, 2026, and approved by DOP Deputy Administrator Mike Gwinn on October 16, 2026, with notation indicating posting for legal notice and appeal period prior to final approval.

Type of Exemption Check all that apply

Type of Exemption*

A solicitation has been completed and my Agency wishes to award contracts to multiple vendors for the same or smilar property (Multiple Award Authorization)

My Agency wishes to administer or award a solicitation at a dollar amount above its normal Delegated Purchasing Authority (Limited/One-Time DPA)

The property required is available on one or more open contracts, but my Agency wishes to purchase from a different vendor. (Note: if total value is over $10,000, Agency must also check the box for exemption from competition if requesting to pruchase from a specific vendor). (Utilization of Open Contract).

A solicitation is being developed (by my Agency under its DPA or in conjunction with DOP) and my Agency wishes to limit responses to a specific manufacturer/brand name (I.e. no substitutions). (Note: this option assumes that multiple vendors can offer the identified brand name; otherwise, select the option for exemption from competition to request a Sole Source Authorization (Brand Name Only)

A solicitation has been completed and there is a need to negotiate with one or more vendors. (Authorization to Negotiate)

My Agency is seeking to purchase directly from an identified vendor without completing a solicitation OR wishes to perform a level of competition that is less formal than would typically be required. (Various exemptions-additional questions to follow) mailto:christina.engels@deq.idaho.gov

Additional Questions*

There is an immediate threat to public health, safety, or welfare (Emergency Purchase Authorization)

The required property can only be procured from a single supplier (sole manufacturer and distributor) (Sole Source Authorization)

There is an existing Policy Directive on the DOP website which requires authorization to be utilized (Utilization of Policy Directive)

It would be impractical, unreasonable, or disadvantageous to complete the required competitive process under the circumstances (One Time Exemption).

Sole Source Authorization

IDAPA 38.05.01.042.02 provides that sole source purchase shall be used only if a requirement is reasonably available from a single supplier.

Property* Describe the property you are seeking

We are seeking access to the intellectual property and services held by Dr. Donald Zaroban. Dr. Zaroban is the preeminent regional authority on the lab verified identification of native fish species.

Justification* Check all that apply

Sole source provider of a licensed or patented good or service

Sole manufacturer AND distributor

Sole provider of factory-authorized/warranty service

Sole provider of items that are compatible with existing equipment, systems, programs, etc.

Other

Additional info if "Other" selected* Dr. Donald Zaroban is the sole provider of technical niche knowledge needed to perform this work.

Business Need* https://adminrules.idaho.gov/rules/current/38/380501.pdf

Describe the Agency's business need for the requested property

The Quality Assurance Plan for BURP also states that any fish a crew finds to be unidentified must be submitted for lab verified ID. Correctly IDing these fish species is the only way to connect the fish data with a meaningful biological score.

Description* Describe what makes the identified property unique. Why is it the only property that could meet your business need?

The Beneficial Use Reconnaissance Program (BURP) in the Surface Water group provides a methodology for the monitoring and assessment of wadeable streams using three categories of biological data: fish data, macroinvertebrate data, and habitat data. For the fish species compositions to be accurately classified at sites with hybridized fish, invasive/rare fish, juvenile fish, or notoriously difficult to discern species, IDEQ needs to send representative voucher specimens for a lab verified ID. Many native and invasive species commonly found in Idaho are extremely difficult to identify in the field, often requiring more robust taxonomic knowledge, as well as specialized dissection and magnification tools, that our regional staff lack. Examples of such species include but are not limited to: Brook/Bull Trout hybrids, Cutthroat/Rainbow Trout hybrids, all species of sculpin, certain species of dace, many species of suckers, chub, juvenile salmonids, and unusual invasives such as Black and Brown Catfish and Oriental Weatherfish.

Alternatives* Describe the research you conducted to identify other potential property/sources. What potential alternatives did you find and why will they not meet the Agency's business needs?

In searching for alternatives, I reached out to the Native Fish Program and the Sport Fish Program at Idaho Department of Fish and Game (IDFG), as well as the City of Boise (who recently collected fish for their Biological Conditional Gradient work), and the local EPA region 10 office. IDFG confirmed that they use DR. Zaroban for their lab verified fish IDs, as did City of Boise. EPA region 10 only knew of options for genetic analysis (more costly) and otolith ageing (not valid for our project).
