About this file

This document is an official response from the Massachusetts Department of Environmental Protection (MassDEP) to questions received regarding the Request for Response (RFR) for Marine and Inland Waterways Oil Spill Prevention & Response Services IV (MIWOSPRS IV). The RFR, identified as COMMBUYS Bid# BD-24-1045-BWSC0-BWSC1-90845, seeks to establish a list of contractors capable of providing some or all of the required services, which include implementing M.G.L. Chapter 21M, "Vessel Traffic Service" and Chapter 251 of the Acts of 2004, "An Act Relative To Oil Spill Prevention And Response In Buzzards Bay And Other Harbors And Bays Of The Commonwealth". MassDEP acknowledges that not all firms may have experience in all aspects of the services required, and encourages them to submit a response based on their capabilities. The current contract is available for review, and the presentation from the August 11, 2023 Pre-Bid Conference is available on COMMBUYS.

The document also addresses specific questions related to the Supplier Diversity Program (SDP) commitment, the scope of work, and the availability of the current contract and labor rate structure. MassDEP clarifies that all SDP partners must be certified by VetBiz and/or certified/recognized by the Supplier Diversity Office, and that firms are not required to respond to all aspects of the scope of work but will be evaluated based on their demonstrated experience and capabilities.

MASSDEP’S OFFICIAL RESPONSE TO QUESTIONS REGARDING

THE REQUEST FOR RESPONSE (RFR)

Marine and Inland Waterways Oil Spill Prevention & Response Services IV (MIWOSPRS IV)

COMMBUYS BD#: BD-24-1045-BWSC0-BWSC1-90845

Agency Document Number: BWSC-24-MIWOSPRS IV

On August 3, 2023, the Massachusetts Department of Environmental Protection (MassDEP) posted a Request for Response (RFR) for Marine and Inland Waterways Oil Spill Prevention & Response Services (COMMBUYS Bid#: BD-24-1045-BWSC0-BWSC1-90845). In accordance with the RFR’s Estimated Procurement Calendar, a virtual Bidders’ Conference was held on August 11, 2023. MassDEP received four questions that were submitted at the Bidder’s Conference or through COMMBUYS by the Procurement Calendar deadline of August 17, 2023. Presented below are MassDEP’s Official Responses to all questions received through COMMBUYS. The PowerPoint that was presented at the August 11th Bidders’ Conference will be posted on COMMBUYS by August 24, 2023.

Question 1 (Q1):

How do you reach the 1% threshold if you only identify labor rates?

Answer 1 (A1):

All bidders must comply with Appendix 2, section 2.7 (Supplier Diversity Program or SDP), which details the process and requirements for meeting the minimum 1% SDP Commitment. Each Bidder must propose one or more SDP Partner(s) to utilize to meet its SDP Commitment. Bidders may list those SDP Partner(s) that they have historically contracted with as either a subcontractor or on an ancillary basis to demonstrate their ability to meet the minimum SDP requirements. Refer to the Request for Response (RFR) and the Supplier Diversity Office “Frequently Asked Questions” at https://www.mass.gov/doc/sdp-frequently-asked-bid-questions/download

In addition, the linked SDO FAQs indicates that non-certified partners are acceptable to include in their SDP plan forms, however, DEP does not allow for this option. All partners listed MUST be certified by VetBiz and/or certified/recognized by SDO. Vendors will not receive SDO evaluation points for any vendors where current certification cannot be confirmed.

Q2:

Is it required to respond to all aspects of the Scope of Work (Attachment A)?

A2:

No. As noted in Section 1.1 and Attachment A of the RFR, MassDEP is seeking, through this solicitation, to establish a list of Contractors that have the capability to perform some or all of the listed categories of services. MassDEP acknowledges that some firms may not have experience or capabilities in all aspects of the services required but those firms are encouraged to submit a response. Each firm will be evaluated based in part on their experience and capabilities in those service areas that they have demonstrated experience.

Q3:

Where can I find a copy of the current contract and rate structure that is due to expire 12/15/23?

A3:

The current contract can be obtained at the following link:

https://www.commbuys.com/bso/external/purchaseorder/poSummary.sdo?docId=PO-17-1045-BWSC0-BWSC1-9366&releaseNbr=0&external=true&parentUrl=close

The current labor rates are included as Attachment A to this Q&A document.

Q4:

Could we receive a copy of the slides from the bidder’s conference?

A4:

The presentation from the August 11, 2023 Pre-Bid Conference is available on COMMBUYS.
