About this file
This is a Defense Production Act Questionnaire used by the Navy to evaluate national security concerns related to proposed real estate leases involving foreign persons.
The questionnaire serves as a screening tool to determine whether a proposed lease constitutes a Covered Real Estate Transaction under 50 U.S.C. § 4565 and 31 C.F.R. Part 802, and to identify any required mitigation measures for national security risks. Respondents must provide four categories of information: (1) names of all Foreign Persons having Control over the proposed Lessee; (2) names of any Foreign Person having Control over contractors or vendors with which the Lessee has or intends to have contracts for work on the Leased Property; (3) names and addresses of subcontractors involved in the proposed lease; and (4) identification of whether non-U.S. citizens will perform work on the Leased Property and a description of their planned duties. The questionnaire requires certification that all provided information is current, accurate, and complete, with signature, date, printed name, organization/company name, and title of the authorized signatory. All capitalized terms are defined in 31 C.F.R. Part 802 and the President and Committee on Foreign Investment in the United States (CFIUS) are authorized to review covered transactions under the amended Defense Production Act.
