JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND

OPEN COMPETITION

FACILITIES RELATED CONTROLS SYSTEMS –P207 UNITED STATES

COAST GUARD HANGAR 14 RENOVATION

1. Contracting Activity

The contracting activity is Naval Facilities Engineering Systems Command, Washington (NAVFAC Washington).

2. Description of the Action Being Approved

This Justification and Approval (J&A) authorizes and approves the use of brand name commercial equipment from Siemens Supervisory Control and Data Acquisition (SCADA) / Building Management System (BMS) into solicitation N4008024R0002 - P207 United States Coast Guard (USCG) Hangar 14 Renovation. The specific equipment is the Siemens APOGEE building automation system, the SCADA, and the BMS.

3. Description of Supplies/Services

The Government is acquiring the Siemens APOGEE building automation system, the SCADA and BMS. Joint Base Andrews uses an integrated system compromised of Siemens APOGEE that will integrate into the Energy Management Control System (EMCS) upon completion of the project. The project includes renovation of an existing hangar, Hangar 14.

During renovation, the existing Direct Digital Control (DDC) controller will remain and new expansion power modules will be utilized. The total estimated value of the following electronic security system and components is $1,333,465 in fiscal year 2024. The appropriation is

MILCON.

4. Statutory Authority Permitting Other Then Full and Open Competition

The statutory authority permitting other than full and open competition is 10 U.S.C.

2304(c)(1), as implemented by FAR Subpart 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements”.

5. Rationale Justifying Use of Cited Statutory Authority

It is the policy of Joint Base Andrews that every new building or building renovation of significant size incorporates DDC as the means of HVAC control. This is done in accordance with Air Force Regulation 91-24, Real Property Operation and Maintenance, Energy Management and Control Systems (EMCS). This regulation sets policies and procedures for managing, operating, repairing, and maintaining installed equipment for EMCS. This regulation applies to all regular Air Force Civil Engineering activities. Specifically, paragraph 3, Section c.7a states, “The complete system must consist of a single EMCS that monitors and controls mechanical equipment in all facilities containing centralized heating systems or air-conditioning units of 10-ton capacity or larger.” And paragraph 5 states, “expanding the

EMCS. The Air Force goal for EMCS expansion is to have a single EMCS at each base, to monitor and control facility energy consumption and utility metering.” The existing base wide EMCS is a Siemens Building Technologies, Inc. Landis Division System 600/Apogee Direct Digital Control (DDC) system.

The Siemens System 600 DDC system includes programmable components which are manufactured by Siemens Industries. This system is proprietary to Siemens Building Technologies. Thus, no other vendor is authorized to supply parts or provide services on this system. Also, DDC systems associated with the other vendors are not compatible with the current Siemens EMCS system. The cost, manpower, training and time associated with changing the Siemens system to another EMCS would be excessive.

DDC systems which do not fully communicate with the host workstation will (1) require an additional host workstation and (2) require maintenance personnel to learn a new program language which increases manpower and training requirements, and reduces reliability and responsiveness. The use of multiple DDC systems would increase costs for parts and system maintenance. In order to remove and replace all 184 Siemens panels and the equipment that accompanies them, it would cost the Government approximately $20M.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Per FAR 5.201, an Intent to Sole Source Notice was posted on the SAM website on 1 February 2023 and closed 14 February 2023 to determine whether other companies’ with similar products can meet or be modified to meet, the Government’s needs. The Government conducted additional market research by reviewing similar projects and comparable systems available on the market. No responses were received from any businesses, and research indicates that there no other sources capable of fulfilling the requirement.

7. Determination of Fair and Reasonable Cost

The Contracting Officer has determined that the anticipated cost to the government of the supplies/services covered by this J&A will be fair and reasonable.

8. Action to Remove/Overcome Barriers to Future Competition

For the reasons set forth in Paragraph 5, NAVFAC Washington does not intend to compete future requirements for the system covered by this document. NAVFAC Washington will continue to monitor industry to determine if another DDC system becomes available that is compatible with the Siemens DDC. If another potential source emerges, NAVFAC Washington will assess whether competition for future requirements is feasible.
