tables, including classifications to the U.S.C. and U.S.C.A. and the sections amended, repealed or otherwise affected and a cumulative index. This is the primary source of legislative history in the DCAA law library. This multi-volume set has been maintained in the DCAA law library for over 20 years.

The “United States Code Annotated (U.S.C.A)” is a multivolume work published by West Group that contains the complete text of federal laws enacted by Congress that are included in the U.S.

Code, together with case notes (known as annotations) of state and federal decisions that interpret and apply specific sections of federal statutes, plus the text of presidential proclamations and executive orders.

2. Identify the specific characteristics of the material or service that limit the availability to a single source (unique features, function of the item, licensing agreement, urgency, brand name, etc.). Describe in detail why only this source can furnish the item or service to the exclusion of other sources.

Annual hardbound volumes published at the end of each session of Congress and monthly advance sheets. This is the only publication with monthly advance sheets. West Group is the only source for this legislative report with advance sheets. Moreover, the other publications do not contain the major committee reports or Presidential signing statements, so this publication contains the most complete legislative histories. FAR 6.302-1(a)(2) permits acquisition from one source when the supplies or services are only available from one source and no other source will satisfy agency needs.

U.S. Code: Updates to an existing multivolume set of books (over 400) maintained in the DCAA law library. If we were to purchase an annotated code from the other major source ((LEXIS/NEXIS)), it would require the acquisition of the entire multi-volume set of books rather than just updating the existing set. This would be considerably more expensive. Thus, FAR 6.302-1(a)(2)(iii)(A) permits acquisition from an original source for continued provision of highly specialized services when it is likely that award to another source would result in substantial duplication of costs.

U.S. Code Congressional & Administrative News: There is one other source of US legislative history-United States Statutes at Large, which is published by the Untied States Government Printing Office at the end of each session of Congress, but it does not provide monthly advance sheets.

U.S. Code Annotated: There is only one other source for an annotated version of the US Code-

LEXIS/NEXIS.

A sources sought was posted on GSA eBuy and only one response was received, which was from the proposed contractor, West.

Market Research will continue to be conducted to determine if changes occur in the marketplace that would enable future actions to be competed to the maximum extent possible.
