About this file

This document is an Amendment to Solicitation DCKA-2021-B-0025 for the Cleveland Park Streetscape and Drainage Improvement Project issued by the District Department of Transportation (DDOT) Office of Contracting and Procurement. The amendment provides responses to questions regarding insurance requirements, including acceptable forms and exceptions, as well as specifications for finishes on bollards, stone seating, and cobblestone edging. The project includes roadway, streetscape, and drainage improvements within the Cleveland Park neighborhood from Macomb Street to Porter Street. The solicitation originally issued on June 10, 2021 and this amendment is effective as of July 6, 2021.

The insurance requirements include Commercial General Liability using specific ISO endorsement forms, as well as potential requirements for Railroad Protective Liability, Cyber Liability, Environmental Liability/Contractors Pollution Liability, and Employment Practices Liability for subcontractors. The amendment also clarifies acceptable finishes for project elements such as a "four-cut" finish for bollards and stone work, and a split-face finish for cobblestone edging. Contractors must acknowledge receipt of this amendment prior to the established bid deadline.

Q2: IFB document (page 37 of 63 paragraph 3) states, “The Government of the District of Columbia shall be included in all policies required hereunder to be maintained by the Contractor and its subcontractors (except for workers’ compensation and professional liability insurance).” Should the employer’s liability, cyber liability, employment practice liability, and professional liability insurance are also included in the exception?

Q2 Response: Employers Liability is part of Worker’s Compensation so is included in the exception. Cyber, Employment Practices and Professional Liability are not included in the exception because in some cases additional insured status is available. The contractor is required to carry the required lines of coverage.

Q3: Should subcontractors required to have cyber-Liability insurance, Environmental Liability/Contractors Pollution liability Insurance, and employment practices liability?

Q3 Response: General Requirement state The Contractor must provide proof of the subcontractor's required insurance prior to commencement of work by the subcontractor. If the Contractor engage a subcontractor without requesting subcontractor specific insurance requirements for the subcontractor, such subcontractor shall have the same insurance requirements as the Contractor. Attachment 1 to the Amendment 1 is the Subcontractors Insurance Requirements Form. It must be completed and provide brief the Statement of Work in designated column. Please submit prior to bid, prior to award or after award at Prime Contractor’s discretion for review and District’s response.

Q4: Section I.8 of the IFB document states that “the Contractor shall provide evidence satisfactory to the Contracting Officer of a RPL policy with respect to activities Contractor, or any of its officers, agents, employees, members, successors and assigns, or subcontractors, perform within fifty (50) feet vertically or horizontally of railroad tracks, but only prior to the initiation of any such activity, Contractor shall provide Railroad Protective Liability Insurance (ISO CG 00 35 or equivalent), in the name of the applicable railroad. However, is railroad insurance is required for this project because most of the work will be done not horizontally from the railroad track rather than we will be working on vertically from the railroad track?

Q4 Response: Requirement no. 7 states (50) feet vertically or horizontally. Please note this requirement if on an “if applicable” basis. The permit process may involve a nearby railroad in which case the contractor’s broker will need to place coverage at the Railroad’s direction as any applicable policy will require that the Railroad is the named insured.

Q5: Special provision called for ‘4-cut finish’ that is being called out for the bollard vertical sides. According to the supplier specified in the special provision, the company doesn’t supply the for ‘4-cut finish’. Is thermal cut for the vertical face is acceptable.

Q5 Response: Thermal finish for vertical sides is not acceptable for bollards, stone seating, and any other stonework called out in the project as Four Cut Finish. See below the description from the DDOT Standard Spec 2013 for this type of finish. Companies have different names for same finish. Comparable finishes are acceptable provided a thermal finish (for the top) and a four cut replacement finish are presented for approval.

708.07 FINISH FOR EXPOSED FACES

The kind of finish for the exposed faces of the masonry shall be as specified in the Contract Documents. Face stones shall be pitched to line along all beds and joints, with no depressions below the pitch line. Each stone shall be out of wind, i.e.

the 4 corners are in the same plane. No drill or quarry marks shall show on the face of any stone. The specified finish shall be in accordance with the following definitions:
