About this file

This document is an Amendment to a Solicitation for a contract issued by the District of Columbia Department of Transportation (DDOT). The amendment extends the solicitation due date to March 26, 2021 and provides answers to various questions from bidders regarding the Scope of Work. The Scope of Work requires the contractor(s) to receive, monitor, and update DDOT Miss Utility Service Requests; process work orders; investigate records and field conditions; perform regular and rapid responses to locate and mark DDOT utilities; and provide maintenance of traffic. The contract term is not specified.

The amendment clarifies that the contractor is required to mark DDOT utilities within a 50-foot radius of the proposed excavation, and that a 5% retainage will be held from each progress payment, which will be released upon contract expiration. The contract is not subject to the First Source Employment Agreement. The amendment also details the non-performance deduction amounts and procedures, which will be reviewed at weekly progress meetings.

Question 1:

Page 9 item 5.b. - Says to let customer know that the excavation is not planned within 5’ of a DDOT utility, but page 10 item 6.a. - Says to mark the utility if it’s within 50’ of proposed excavation. Which distance is DDOT requiring to the utility to be marked?.

Answer 1:

See Page 10 and 12 of the revised IFB Page 10 – 6.a revision: “One or more DDOT Utilities are within five-foot (5’) of the horizontal plane of the proposed excavation; and”

Page 12 – 3 Add a.: “When the condition stated above are met and field marking is required; the contractor shall field mark all DDOT utilities within a fifty-feet (50’) radius of the proposed excavation.”

Question 2:

Page 24 Section G.1.C. - Will retainage be held? If so, will it be 5% or 10%? If it’s held, when will it be released?

Answer 2:

Yes, See page 24 of the revised IFB Page 24 – C. revision:

The District will retain 5% of each progress payment. Retention will be released upon each contract period expiration, the CO, based upon guidance provided by the CA, will determine if the retainage should be released. Retainage will be releases when the District determines that the following conditions are met:

1. All services requests for the contract period have been completed and;

2. There are no outstanding issues/actions items from the weekly meeting.

Question 3:

Page 30 Section H.5. says local hiring requirements do not apply… the Bidder/Offeror Certification Form asks to certify you are aware of the First Source Employment Agreement. Is this contract covered under First Source?

Answer 3: No, this contract is NOT governed by First Source. The Bidder/Offeror form is a Standard form for all contracts.

Question 4:

Section H.12 Will the deductions be reviewed at the weekly meeting?

What is the time frame for correcting a non-performance issue before being charged again?

H.11 ADDITIONAL SPECIAL CONTRACT REQUIREMENTS

Non-Performance Deductions

1) On a monthly basis DDOT will calculate Non-Performance deductions, monetary deductions due to failure of the Contractor to meet contract requirements, as described herein.

2) DDOT will calculate monthly Non-Performance deductions based on the following events:

Non-Performance Event Amount Assessment Measure

Reassessment Measure

Failure to update District One Call Center records

$150.00 Each instance Every Hour

Failure to provide accurate information $150.00 Each instance Every 24 Hours Failure to open work order on time $150.00 Each instance Every Hour Failure to complete Regular Response work orders on time

$100.00 Each instance Every 48 Hours

Failure to complete Rapid Response work orders on time

$200.00 Each instance Every 2 Hours

3) DDOT AMS records will be used to assess Regular and Rapid Response compliance to the contractual response period. Shall a conflict between “Failure to Update” and “Failure to Complete” occur, then the latest Non-Performance event takes precedence for the calculation of the Non-Performance deduction.

For example, if a Regular Response completion date and time AMS records generate $500 Non-Performance deduction due to a 5 hours late response, then then Contractor cannot argue that the AMS records have not been properly updated.

4) DDOT will provide the Contractor with a monthly failure report listing all failure events and the rationale for applying a Non-Performance deduction. The Contractor must remediate immediately all the failures included in the monthly failure report.

5) The Contractor must remediate immediately any and all failures that DDOT has notified that Contractor about, including those found in the monthly failure report.

6) DDOT will deduct Non-Performance deductions from the monthly invoice. The deductions are final and cannot be recovered in future invoices.

7) There is no cap for the cumulative Non-Performance deductions that results from the application herein.

Attachment J.1 Since you have been performing the work in house, can you tell us what occupation code is used for your employees?
