About this file
This is a Darfur Contracting Act Certification form issued by the California Department of General Services (DGS) Procurement Division for use by companies bidding on State of California contracts. The form applies to any company that has conducted business activities or operations outside the United States within the previous three years. Companies meeting this criterion must certify their eligibility to bid by selecting one of two options: either certifying that they are not a scrutinized company under Public Contract Code Section 10476, or providing written permission from the DGS Director demonstrating that they are a scrutinized company but have been granted case-by-case authorization to submit a proposal. The form requires completion with company name, Federal ID Number, authorized signature, and printed name and title of the signing official.
Companies without international business activities or operations in the previous three years are exempt from completing this certification. The form establishes compliance requirements under Public Contract Code Sections 10475-10481 and must be submitted as part of bid packages for state contracts. Failure to properly complete and submit the appropriate certification option may render a bid non-responsive. The form was revised in December 2019 and serves as a mandatory prerequisite for contract eligibility when international business operations are present.
