About this file

This is a certification form issued by the California Department of General Services (DGS) Procurement Division implementing the Darfur Contracting Act under Public Contract Code Sections 10475-10481. The form applies to any company that has conducted business activities or operations outside the United States within the previous three years and seeks to bid on or submit proposals for State of California contracts. Companies without international business activities during this three-year period are exempt from completion of this certification. The document provides two compliance pathways: Option 1 requires eligible companies to certify under penalty of perjury that they are not a "scrutinized company" as defined in Public Contract Code Section 10476, with certification executed by an authorized company representative; Option 2 accommodates scrutinized companies that have obtained written permission from the DGS Director to submit bids or proposals on a case-by-case basis when determined to be in the state's best interests, requiring submission of the DGS authorization letter with the bid or proposal.

The certification form requires completion of standard company identification information including the company or vendor name and Federal ID Number, along with the signature, printed name, and title of the authorized representative executing the certification. The form does not address pricing terms, set-asides, incumbency status, or contract funding sources, as it functions solely as a compliance and eligibility screening mechanism for state procurement processes rather than a substantive contract document.
