About this file

This is a Darfur Contracting Act Certification form required by the State of California pursuant to Public Contract Code section 10478. The form applies to bidders and proposers with business activities or operations outside the United States within the previous three years. Prospective bidders must complete the certification by selecting one of three options: certifying they have no international business activities, disclosing that they are a scrutinized company with written Department of General Services permission to bid, or certifying that despite international operations, they are not a scrutinized company as defined in Public Contract Code section 10476. The form requires the company name, Federal ID Number, and the printed name and title of the person completing the certification.

For Option 3, an authorized company official must provide a signed certification under penalty of perjury, executed in a specified California county and state, confirming they are legally authorized to bind the prospective bidder to the certification statement. This form is a mandatory compliance document for bid eligibility and must be submitted with the bid or proposal package.
