About this file

This is an open letter from the Department of the Air Force (DAF) Office of the Assistant Secretary announcing policy changes to federal contracting regulations issued on March 21, 2025.

The letter notifies DAF contractors that the Office of the Undersecretary of Defense for Acquisition & Sustainment has issued two Class Deviations: 2025-O0003 (Restoring Merit-Based Opportunity in Federal Contracts) and 2025-O0004 (Revocation of Executive Order on Sustainability). These deviations alter federal contracting regulations by removing certain solicitation provisions and contract clauses that are no longer enforceable. DAF Contracting Officers will amend open solicitations and modify existing contract awards to comply with these changes. To minimize costs, modifications to existing contracts will be made only when the next contract modification is required, with exceptions for contract actions nearing completion (less than 6 months remaining with no extension options). The provisions and clauses referenced in paragraph (1) of Attachment 1 became unenforceable on March 4, 2025, while those in paragraph (1) of Attachment 2 became unenforceable on March 7, 2025. The letter directs contractors to contact their respective Contracting Officer with questions about specific solicitations or contracts.

DEPARTMENT OF THE AIR FORCE

WASHINGTON DC

OFFICE OF THE ASSISTANT SECRETARY

21 March 2025

OPEN LETTER TO THE DEPARTMENT OF THE AIR FORCE (DAF) CONTRACTORS

FROM: SAF/AQC

1060 Air Force Pentagon Washington DC 20330-1060

SUBJECT: Restoring Merit-Based Opportunity in Federal Contracts and Revocation of

Executive Order on Sustainability

The Office of the Undersecretary of Defense for Acquisition & Sustainment’s Principal Director of Defense Pricing, Contracting, and Acquisition Policy issued Class Deviations 2025-O0003 (Attachment 1) and 2025-O0004 (Attachment 2), altering federal contracting regulations on merit-based opportunity in federal contracts and revoking an Executive Order on sustainability.

As a result of these Class Deviations, Contracting Officers will be amending open solicitations and modifying contract awards to remove solicitation provisions and contract clauses that are no longer enforceable. To avoid unnecessary costs, DAF Contracting Officers will modify existing contracts when the next modification is required. Contracting Officers are not required to modify contract actions nearing the end of the period of performance (i.e., less than 6 months remaining) and without options to extend. Please note that Class Deviation requirements for provisions and clauses in paragraph (1) of Attachment 1 have been unenforceable since March 4, 2025, and those in paragraph (1) of Attachment 2 have been unenforceable since March 7, 2025.

Thank you for your support to the DAF mission. Your partnership is appreciated during this process. For questions regarding a specific solicitation/contract, please reach out to your Contracting Officer.

ALICE W. TREVIÑO, Maj Gen, USAF Deputy Assistant Secretary (Contracting)

Assistant Secretary of the Air Force (Acquisition, Technology & Logistics)
